Montgomery County<\/em>. The filing supports the plaintiffs\u2019 request for a temporary restraining order or preliminary injunction blocking enforcement of the law while the case proceeds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At issue is <a href=\"https:\/\/apps.montgomerycountymd.gov\/ccllims\/DownloadFilePage?FileName=2911_1_26765_Bill_23-2026_Introduction_20260512.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"montgomery-county-gun-ban-faces-synagogue-challenge\" title=\"Montgomery County Gun Ban Faces Synagogue Challenge\">Expedited Bill 23-26<\/a>. The ordinance generally prohibits possessing or transporting firearms or ammunition in or within 100 yards of a \u201cplace of public assembly.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"DOJ sues Montgomery County over gun control law\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/DBMj5Y1pyPo?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That definition includes places of worship, schools, parks, libraries, recreational facilities, polling places, courthouses and several other locations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law contains exceptions for <a href=\"https:\/\/gunsamerica.com\/digest\/graphic-footage-officer-fatally-shoots-man-pretending-to-draw-weapon\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"montgomery-county-gun-ban-faces-synagogue-challenge\" title=\"Montgomery County Gun Ban Faces Synagogue Challenge\" data-wpil-monitor-id=\"7610\">police officers<\/a>, licensed security guards and limited forms of transportation. However, a Maryland wear-and-carry permit does not allow an ordinary permit holder to carry inside a synagogue or throughout the surrounding 100-yard zone.<\/p>\n\n\n\n<h2 id=\"h-see-also-kimber-cds9-review-1-300-rounds-no-excuses\" class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/kimber-cds9-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"montgomery-county-gun-ban-faces-synagogue-challenge\" title=\"Montgomery County Gun Ban Faces Synagogue Challenge\">Kimber CDS9 Review: 1,300 Rounds, No Excuses<\/a><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Silver Spring Jewish Center and Rabbi J. Menashe Shapiro argue that the restriction prevents trained members of the congregation from providing armed volunteer security. They say protecting the congregation is both a practical necessity and part of their religious responsibility to protect one another.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Montgomery County has argued that the synagogue can hire licensed security guards. NCLA says that response misses the point.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the reply, the First Amendment does not permit county officials to decide that hired security is interchangeable with protection provided by members of the religious community. NCLA argues that the synagogue\u2019s decision about how to protect its congregation is an internal religious matter protected by the Free Exercise and Establishment Clauses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The brief also attacks the ordinance under the <a href=\"https:\/\/gunsamerica.com\/digest\/people-book-celebrates-gun-owners-across-america\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"montgomery-county-gun-ban-faces-synagogue-challenge\" title=\"Montgomery County Gun Ban Faces Synagogue Challenge\" data-wpil-monitor-id=\"7608\">Second Amendment<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the framework established by the Supreme Court in <em><a href=\"https:\/\/gunsamerica.com\/digest\/ny-lawmakers-move-ban-child-operated-firearms\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"montgomery-county-gun-ban-faces-synagogue-challenge\" title=\"Montgomery County Gun Ban Faces Synagogue Challenge\" data-wpil-monitor-id=\"7607\">New York<\/a> State Rifle &amp; Pistol Association v. Bruen<\/em>, the government carries the burden of showing that a modern <a href=\"https:\/\/gunsamerica.com\/digest\/hunt365-june-backcountry-carry-solution-sig-sauer-p320-xten-10mm\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"montgomery-county-gun-ban-faces-synagogue-challenge\" title=\"Montgomery County Gun Ban Faces Synagogue Challenge\" data-wpil-monitor-id=\"7609\">gun<\/a> restriction is consistent with the nation\u2019s historical tradition of firearm regulation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Montgomery County cited several laws restricting firearms at churches and public gatherings. Most came from Georgia, Missouri, Virginia and Western territories during the late 1800s.<\/p>\n\n\n\n<h2 id=\"h-see-also-glenfield-model-a-review-sub-moa-for-529\" class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/glenfield-model-a-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"montgomery-county-gun-ban-faces-synagogue-challenge\" title=\"Montgomery County Gun Ban Faces Synagogue Challenge\">Glenfield Model A Review: Sub-MOA for $529?<\/a><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NCLA argues those examples arrived too late, were geographic outliers or were part of broader handgun restrictions that do not represent a widespread American tradition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More importantly, the reply says the county offered no historical justification for extending its prohibition 100 yards beyond every covered property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cDefendants have not offered any Second Amendment justification for that rule,\u201d NCLA attorneys wrote. They contend that the lack of a defense makes the plaintiffs \u201chighly likely\u201d to prevail on that part of their claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reply also rejects the county\u2019s suggestion that the plaintiffs waited too long to challenge the restrictions. NCLA says licensed carriers were exempt under an earlier version of the county ordinance and that the challenged restrictions had been blocked by a previous injunction before the latest law became enforceable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Silver Spring Jewish Center filed its lawsuit shortly after the new ordinance took effect.<\/p>\n\n\n\n<h2 id=\"h-see-also-seekins-element-hunter-m3-6-lbs-264-moa\" class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/hunt365-seekins-element-hunter-m3-7-prc-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"montgomery-county-gun-ban-faces-synagogue-challenge\" title=\"Montgomery County Gun Ban Faces Synagogue Challenge\">Seekins Element Hunter M3: 6 Lbs, .264 MOA<\/a><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">NCLA also pointed to increased threats against Jewish institutions following the October 7, 2023, terrorist attacks in Israel. The synagogue says those threats led it to organize and train its volunteer security team.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMontgomery County cannot defend this indefensible law,\u201d NCLA Senior Litigation Counsel Jacob Huebert said. \u201cIt can\u2019t justify prohibiting Orthodox Jews from fulfilling their religious obligation to defend themselves and each other. And it can\u2019t identify any historical tradition of restricting firearms in places of worship because none exists.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Montgomery County State\u2019s Attorney John McCarthy has reportedly agreed not to pursue criminal prosecutions under the ordinance until the constitutional challenge is resolved. NCLA subsequently dismissed him as a defendant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That agreement does not end the dispute. The county may still seek civil penalties, and the ordinance remains on the books.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">District Judge Deborah K. Chasanow is scheduled to hear arguments on the injunction request Sept. 3 at 9:30 a.m. in <a href=\"https:\/\/gunsamerica.com\/digest\/federal-appeals-court-puts-the-brakes-on-d-c-s-concealed-carry-permit-case\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"montgomery-county-gun-ban-faces-synagogue-challenge\" title=\"Montgomery County Gun Ban Faces Synagogue Challenge\" data-wpil-monitor-id=\"7611\">federal court<\/a> in Greenbelt, Maryland.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge will not decide the entire case at that hearing.
