An altercation followed, during which one intruder shot Munroe\u2019s son in the leg.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Munroe then wrestled a <a href=\"https:\/\/gunsamerica.com\/digest\/canik-unveils-mete-mc9-prime-shot-show-2025\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"jason-munroe-self-defense-home-invasion\" title=\"Canadian Man Disarmed Son\u2019s Shooter, Convicted for Follow-Up Shots\" data-wpil-monitor-id=\"7513\">handgun away from one of the attackers and shot<\/a> him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The trial judge cleared Munroe of charges connected to his actions inside the house. The court determined that he was defending himself and his family from an immediate threat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That protection ended when the intruders fled.<\/p>\n\n\n\n<h2 id=\"h-the-legal-line-was-the-front-porch\" class=\"wp-block-heading\">The Legal Line Was the Front Porch<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Munroe chased the intruders from the house. He then stood on his porch and fired approximately three rounds at their escaping vehicle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He did not hit anyone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The trial court found that Munroe was no longer acting in self-defense because the attackers were leaving and the immediate threat had ended.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Munroe was convicted of recklessly discharging a restricted or prohibited firearm. He was also convicted of obstructing a peace <a href=\"https:\/\/gunsamerica.com\/digest\/graphic-footage-officer-fatally-shoots-man-pretending-to-draw-weapon\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"jason-munroe-self-defense-home-invasion\" title=\"Canadian Man Disarmed Son\u2019s Shooter, Convicted for Follow-Up Shots\" data-wpil-monitor-id=\"7512\">officer after initially telling police<\/a> he had not possessed or fired a gun.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Global News<\/em> <a href=\"https:\/\/globalnews.ca\/news\/12029177\/court-of-appeal-sentence-jason-munroe-whitby\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"jason-munroe-self-defense-home-invasion\" title=\"Canadian Man Disarmed Son\u2019s Shooter, Convicted for Follow-Up Shots\">reported<\/a> that Munroe later admitted firing at the vehicle. He told investigators that he had tried to kill the intruders and would have killed them if given the opportunity.<\/p>\n\n\n\n<h2 id=\"h-crown-wanted-a-tougher-sentence\" class=\"wp-block-heading\">Crown Wanted a Tougher Sentence<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Munroe received a conditional sentence of 729 days, or two years less a day, followed by three years of probation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His conditions include house arrest, except when traveling to work, and GPS monitoring.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Crown appealed, arguing that the sentence failed to adequately punish and deter reckless gunfire in a public place.  Ontario\u2019s Court of Appeal disagreed and upheld the original sentence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judges acknowledged that Munroe was no longer defending himself when he fired from the porch. Munroe showed remorse, pursued rehabilitation and maintained a stable job while supporting his family.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The handgun also belonged to the intruders. Munroe had not brought an illegally acquired firearm to the confrontation.<\/p>\n\n\n\n<h2 id=\"h-self-defense-is-judged-moment-by-moment\" class=\"wp-block-heading\">Self-Defense Is Judged Moment by Moment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Canadian law asks whether someone reasonably believed force was being used or threatened, acted to protect a person and responded reasonably under the circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That justification can disappear as the situation changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Munroe\u2019s first use of the <a href=\"https:\/\/gunsamerica.com\/digest\/we-shoot-the-new-smith-wesson-victory-22-lr-pistol\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"jason-munroe-self-defense-home-invasion\" title=\"Canadian Man Disarmed Son\u2019s Shooter, Convicted for Follow-Up Shots\" data-wpil-monitor-id=\"7514\">handgun<\/a> occurred while armed intruders remained inside his home after shooting his son. The court accepted that as self-defense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His later <a href=\"https:\/\/gunsamerica.com\/digest\/target-factory-appropriate-6-pack-range-shot-show-2018\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"jason-munroe-self-defense-home-invasion\" title=\"Canadian Man Disarmed Son\u2019s Shooter, Convicted for Follow-Up Shots\" data-wpil-monitor-id=\"7515\">shots targeted<\/a> people fleeing in a car. The court treated those rounds as retaliation or reckless pursuit rather than defense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case does not mean Canadians must simply surrender to <a href=\"https:\/\/gunsamerica.com\/digest\/armed-homeowner-drops-intruder-in-st-pete-home-invasion\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"jason-munroe-self-defense-home-invasion\" title=\"Canadian Man Disarmed Son\u2019s Shooter, Convicted for Follow-Up Shots\" data-wpil-monitor-id=\"7511\">armed home invaders<\/a>. It shows that courts evaluate each use of force separately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same incident produced two very different legal answers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Inside the home, Munroe was defending his family. Once the intruders fled, the court decided the threat was over and the legal protection ended with it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Self-defense doesn\u2019t end when the threat goes down.
