Kathy Hochul is promising to fight a package of federal firearms reforms before many of them even become final.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During a July 30 event, Hochul <a href=\"https:\/\/www.governor.ny.gov\/news\/video-audio-photos-rush-transcript-governor-hochul-announces-new-gun-safety-actions-protect\" target=\"_blank\" class=\"clickTracking\" campaign=\"hochul-block-pro-2a-atf-reforms\" title=\"Hochul Vows to Block Trump\u2019s Pro-2A ATF Reforms\">accused<\/a> the Trump administration of abandoning public safety through more than 30 proposed ATF rule changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She called the proposals a \u201cshameless giveaway to the gun lobby\u201d and announced several state actions intended to limit their effect in <a href=\"https:\/\/gunsamerica.com\/digest\/i-got-the-new-york-blues\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"hochul-block-pro-2a-atf-reforms\" title=\"Hochul Vows to Block Trump\u2019s Pro-2A ATF Reforms\" data-wpil-monitor-id=\"7505\">New York<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe\u2019re here to fight back,\u201d Hochul said.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Governor Hochul Announces New Gun Safety Actions in Response to Federal Firearm Regulation Rollbacks\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/wIjwydDK6YA?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<div class=\"wp-block-yoast-seo-table-of-contents yoast-table-of-contents\"><h2>Table of contents<\/h2><ul><li><a href=\"#h-more-inspections-for-new-york-gun-dealers\" class=\"clickTracking\" campaign=\"hochul-block-pro-2a-atf-reforms\" title=\"Hochul Vows to Block Trump\u2019s Pro-2A ATF Reforms\" data-level=\"2\">More Inspections for New York Gun Dealers<\/a><\/li><li><a href=\"#h-interstate-gun-task-force-returns\" class=\"clickTracking\" campaign=\"hochul-block-pro-2a-atf-reforms\" title=\"Hochul Vows to Block Trump\u2019s Pro-2A ATF Reforms\" data-level=\"2\">Interstate Gun Task Force Returns<\/a><\/li><li><a href=\"#h-hochul-targets-remote-firearm-sales\" class=\"clickTracking\" campaign=\"hochul-block-pro-2a-atf-reforms\" title=\"Hochul Vows to Block Trump\u2019s Pro-2A ATF Reforms\" data-level=\"2\">Hochul Targets Remote Firearm Sales<\/a><\/li><li><a href=\"#h-other-atf-changes-in-her-sights\" class=\"clickTracking\" campaign=\"hochul-block-pro-2a-atf-reforms\" title=\"Hochul Vows to Block Trump\u2019s Pro-2A ATF Reforms\" data-level=\"2\">Other ATF Changes in Her Sights<\/a><\/li><\/ul><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 id=\"h-more-inspections-for-new-york-gun-dealers\" class=\"wp-block-heading\">More Inspections for New York Gun Dealers<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Hochul said New York State Police will increase on-site inspections of <a href=\"https:\/\/gunsamerica.com\/digest\/ak-47-hog-blaster\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"hochul-block-pro-2a-atf-reforms\" title=\"Hochul Vows to Block Trump\u2019s Pro-2A ATF Reforms\" data-wpil-monitor-id=\"7503\">gun dealers connected to firearms<\/a> later recovered at crime scenes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dealers who violate state law could face enforcement from State Police, Attorney General Letitia James and local district attorneys.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cFollow the laws or we\u2019re shutting you down,\u201d Hochul warned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Her administration will also launch an education campaign reminding dealers and licensing officials that <a href=\"https:\/\/gunsamerica.com\/digest\/ny-lawmakers-move-ban-child-operated-firearms\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"hochul-block-pro-2a-atf-reforms\" title=\"Hochul Vows to Block Trump\u2019s Pro-2A ATF Reforms\" data-wpil-monitor-id=\"7502\">New York\u2019s firearm<\/a> restrictions remain in effect regardless of changes at the federal level.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The campaign will use direct mail and email to explain which federal changes are blocked or limited by existing state law.<\/p>\n\n\n\n<h2 id=\"h-interstate-gun-task-force-returns\" class=\"wp-block-heading\">Interstate Gun Task Force Returns<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Hochul also plans to reconvene New York\u2019s Interstate Task Force on Illegal Guns this fall.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The task force currently involves New York and 11 other states. Its stated mission is to share information and target interstate firearm trafficking.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hochul claimed that 80% of guns recovered at New York crime scenes originated outside the state. She blamed firearms moving through states such as Pennsylvania and Georgia for feeding what officials often call the \u201ciron pipeline.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She also accused ATF leadership of stepping away from interstate enforcement, although she did not provide specific evidence that agents had stopped investigating gun trafficking.<\/p>\n\n\n\n<h2 id=\"h-hochul-targets-remote-firearm-sales\" class=\"wp-block-heading\">Hochul Targets Remote Firearm Sales<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The biggest legislative proposal involves remote firearm transactions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ATF has proposed expanding non-over-the-counter sales conducted by federally licensed dealers. Hochul described the proposal as allowing guns to be ordered online and delivered like food or shoes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhat, are you going to have the guns delivered to your door now?\u201d she asked. \u201cA few clicks and boom, a firearm is on the way.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the actual <a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/05\/08\/2026-09157\/revising-non-over-the-counter-firearms-transaction-requirements\" target=\"_blank\" class=\"clickTracking\" campaign=\"hochul-block-pro-2a-atf-reforms\" title=\"Hochul Vows to Block Trump\u2019s Pro-2A ATF Reforms\">ATF proposal<\/a> does not eliminate background checks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It would apply to sales by federally licensed dealers to buyers residing in the same state as the dealer. The buyer\u2019s identity would need to be verified remotely. The dealer would still complete the required transaction procedures and initiate a <a href=\"https:\/\/gunsamerica.com\/digest\/g-jeff-sessions-orders-fbi-atf-review-nics\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"hochul-block-pro-2a-atf-reforms\" title=\"Hochul Vows to Block Trump\u2019s Pro-2A ATF Reforms\" data-wpil-monitor-id=\"7501\">NICS background check<\/a> before shipping or delivering the firearm.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The dealer would also have to wait for the NICS response or the end of the legally permitted investigative period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is considerably more involved than Hochul\u2019s DoorDash comparison suggests.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Still, Hochul wants New York to prohibit the process entirely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She promised to introduce legislation during the next state legislative session requiring every firearm sale in New York to occur in person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNo online sales,\u201d Hochul said. \u201cNone. None. Not happening.\u201d<\/p>\n\n\n\n<h2 id=\"h-other-atf-changes-in-her-sights\" class=\"wp-block-heading\">Other ATF Changes in Her Sights<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The federal proposals cover far more than remote transactions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One would revise the Biden administration\u2019s expansive definition of who is \u201cengaged in the business\u201d of selling firearms. The revision would remove several regulatory presumptions while retaining the definition passed by Congress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Other proposals would clarify when an unexpired state permit can serve as an alternative to a new NICS check, allow electronic recordkeeping and reduce paperwork for lawful interstate travel with certain <a href=\"https:\/\/gunsamerica.com\/digest\/legally-buy-machine-guns-silencers-short-barrels-understand-the-nfa\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"hochul-block-pro-2a-atf-reforms\" title=\"Hochul Vows to Block Trump\u2019s Pro-2A ATF Reforms\" data-wpil-monitor-id=\"7504\">NFA firearms<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hochul characterized the entire package as an effort to weaken background checks and help bad actors in the firearm industry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The federal proposals, however, remain subject to the rulemaking process.
