He added that the federal government should not permanently deny that right without considering whether someone still presents a public-safety risk.<\/p>\n\n\n\n<h2 id=\"h-rights-will-not-be-restored-automatically\" class=\"wp-block-heading\">Rights Will Not Be Restored Automatically<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The new process does not automatically restore anyone\u2019s firearm rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Applicants must convince the attorney general that they are unlikely to act in a manner dangerous to public safety. Granting relief must also be consistent with the public interest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">DOJ will review each applicant\u2019s:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Original reason for losing firearm rights<\/li>\n\n\n\n<li>Criminal or other relevant record<\/li>\n\n\n\n<li>Reputation<\/li>\n\n\n\n<li>Conduct since becoming prohibited<\/li>\n\n\n\n<li>Potential risk to public safety<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A successful application is not guaranteed.<\/p>\n\n\n\n<h2 id=\"h-who-will-face-a-presumption-against-relief\" class=\"wp-block-heading\">Who Will Face a Presumption Against Relief?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The rule establishes strong presumptions against restoring rights to applicants whose history or current status suggests an ongoing danger.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to DOJ, those presumptions will generally apply to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Violent felons<\/li>\n\n\n\n<li>Registered sex offenders<\/li>\n\n\n\n<li>Illegal aliens<\/li>\n\n\n\n<li>Other people who present an ongoing public-safety risk<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">An applicant facing one of those presumptions would need to demonstrate extraordinary circumstances to overcome it.<\/p>\n\n\n\n<h2 id=\"h-application-portal-coming-soon\" class=\"wp-block-heading\">Application Portal Coming Soon<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Martin said the Pardon Attorney\u2019s Office is developing an online portal for incoming applications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cFor those of you who are seeking relief, I know you\u2019re anxious to get started,\u201d Martin said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Until the portal opens, potential applicants can visit the DOJ\u2019s <a href=\"https:\/\/www.justice.gov\/ffrr?utm_source=chatgpt.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"federal-firearm-rights-restoration-portal\" title=\"DOJ Says Firearms Rights Restoration Portal Is Coming Soon\">Federal Firearm Rights Restoration website<\/a>. The department is posting information about eligibility, required documents and application instructions there.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Martin said DOJ will continue updating the site as the program moves toward launch.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The final rule will take effect 30 days after its publication in the Federal Register. DOJ has not provided a specific date for the application portal to begin accepting submissions.<\/p>\n\n\n\n<h2 id=\"h-federal-rights-only\" class=\"wp-block-heading\">Federal Rights Only<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Any relief granted through the program will remove only the applicable federal firearm prohibition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It will not override a separate restriction imposed under state law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That means someone approved through the federal program could still remain prohibited from possessing firearms in a particular state.<\/p>\n\n\n\n<h2 id=\"h-a-path-for-millions\" class=\"wp-block-heading\">A Path for Millions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Martin said the department built the program to provide a potential restoration path for the roughly 30 million Americans who have lost their Second Amendment rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not mean 30 million people will automatically qualify or receive relief. Every case will receive an individual review under the standards established by the rule.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For now, prospective applicants should begin by reviewing the
