The agency could also consider tools, jigs, templates, instructions and marketing materials when classifying an unfinished item.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That meant an incomplete piece of metal or polymer could become a regulated firearm before it functioned as one.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once classified as a firearm, federal licensing, background-check, serialization and recordkeeping requirements could apply.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Defense Distributed and SAF challenged the rule on several grounds.<\/p>\n\n\n\n<h2 id=\"h-court-says-the-rule-is-too-vague\" class=\"wp-block-heading\">Court Says the Rule Is Too Vague<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The court found that the regulation failed to clearly explain when unfinished material legally becomes a firearm frame or receiver.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ATF used terms such as \u201creadily\u201d completed and \u201cclearly identifiable.\u201d It also listed eight nonexclusive factors that agents could consider, including time, difficulty, expertise, tools, cost and parts availability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The problem, according to the court, was that the rule never established a clear dividing line.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe decision of when a hunk of metal or plastic\u201d becomes a <a href=\"https:\/\/gunsamerica.com\/digest\/comments-on-atfs-new-frame-or-receiver-rule-now-open\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-frame-receiver-rule-unconstitutional\" title=\"Federal Judge Rules ATF Frame and Receiver Rule Unconstitutional\" data-wpil-monitor-id=\"7484\">frame or receiver was left to ATF\u2019s<\/a> subjective judgment, the court wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/springfield-prodigy-3-5-aos-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-frame-receiver-rule-unconstitutional\" title=\"Federal Judge Rules ATF Frame and Receiver Rule Unconstitutional\">Springfield Prodigy 3.5 AOS: 500-Round Carry Test<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That uncertainty created two constitutional problems. Ordinary people lacked fair notice about what the rule prohibited, and ATF agents received too much discretion when deciding what to enforce.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge therefore found the rule unconstitutionally vague under the Fifth Amendment.<\/p>\n\n\n\n<h2 id=\"h-home-gunsmithing-is-protected-conduct\" class=\"wp-block-heading\">Home Gunsmithing Is Protected Conduct<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The court also sided with SAF and Defense Distributed on their <a href=\"https:\/\/gunsamerica.com\/digest\/people-book-celebrates-gun-owners-across-america\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-frame-receiver-rule-unconstitutional\" title=\"Federal Judge Rules ATF Frame and Receiver Rule Unconstitutional\" data-wpil-monitor-id=\"7483\">Second Amendment<\/a> claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both parties agreed that making or repairing a personal firearm falls within the Second Amendment\u2019s protection. That placed the burden on the government to show that the rule fit America\u2019s historical tradition of firearm regulation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The government cited early laws covering barrel inspections, proof marks and gunpowder storage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court found those laws were not close enough.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Historical barrel and gunpowder regulations focused on preventing defective products and accidental explosions. The ATF rule, by comparison, sought to control crime through firearm tracing and restrictions on unfinished components.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court also found a long American tradition of individuals building and repairing their own firearms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because the government failed to provide a sufficient historical comparison, the judge ruled that applying the regulation to the plaintiffs\u2019 products violated the Second Amendment.<\/p>\n\n\n\n<h2 id=\"h-who-does-the-injunction-protect\" class=\"wp-block-heading\">Who Does the Injunction Protect?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The court declared that the challenged portions of the rule cannot be enforced against:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Defense Distributed<\/li>\n\n\n\n<li>The Second Amendment Foundation<\/li>\n\n\n\n<li>Current SAF members<\/li>\n\n\n\n<li>Future SAF members<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The permanent injunction is narrower than that declaration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It blocks enforcement involving Defense Distributed\u2019s M1911 80% Frames, G80 Build Kit, Unfinished Receiver and Grip Module.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ruling does not create a nationwide injunction covering every gun owner, company or unfinished firearm product.<\/p>\n\n\n\n<h2 id=\"h-what-about-the-supreme-court-s-earlier-decision\" class=\"wp-block-heading\">What About the Supreme Court\u2019s Earlier Decision?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This case previously reached the U.S. Supreme Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2025, the Supreme Court ruled that the <a href=\"https:\/\/gunsamerica.com\/digest\/wisconsin-bill-allows-ban-owning-firearms\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-frame-receiver-rule-unconstitutional\" title=\"Federal Judge Rules ATF Frame and Receiver Rule Unconstitutional\" data-wpil-monitor-id=\"7482\">Gun Control Act allows<\/a> ATF to regulate at least some weapon parts kits and partially completed frames or receivers. That decision rejected a facial challenge claiming ATF exceeded the statute itself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the Supreme Court did not decide the constitutional questions raised here.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the case returned to the district court, Defense Distributed and SAF continued their Second Amendment and due-process challenges. Those claims produced the latest ruling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The district court rejected three additional claims alleging violations of the Administrative Procedure Act. The government therefore won summary judgment on those portions of the case.<\/p>\n\n\n\n<h2 id=\"h-saf-calls-it-a-major-victory\" class=\"wp-block-heading\">SAF Calls It a Major Victory<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">SAF Executive Director Adam Kraut said the rule was both unconstitutional and impossible for ordinary citizens to understand.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Court rightly held that the Biden ATF\u2019s rule not only sought to outright prohibit Second Amendment protected conduct but was written in such a vague and vaporous manner,\u201d Kraut said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/gunsamerica.com\/digest\/saf-files-suit-to-protect-4a-rights-of-high-school-gun-owner\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-frame-receiver-rule-unconstitutional\" title=\"Federal Judge Rules ATF Frame and Receiver Rule Unconstitutional\" data-wpil-monitor-id=\"7481\">SAF founder Alan Gottlieb<\/a> said the ruling confirms that Americans may manufacture firearms at home without automatically facing prosecution under the challenged provisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court issued its opinion on Aug. 17, 2026.
