minutes<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A major Second Amendment win came out of Wisconsin last week, where the state&#8217;s Court of Appeals ruled that foster parents don&#8217;t have to give up their constitutional gun rights just to open their homes to children.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a lengthy 119-page <a href=\"https:\/\/www.wicourts.gov\/ca\/opinion\/DisplayDocument.pdf?content=pdf&amp;seqNo=1154587\" target=\"_blank\" class=\"clickTracking\" campaign=\"wisconsin-foster-parent-gun-ruling\" title=\"Wisconsin Appeals Court Strikes Down Foster Parent Gun Rule\">decision<\/a>, the court sided with Brian and Katie Lafferty, a Washington County couple who spent nearly five years fighting Wisconsin&#8217;s firearm rules for foster parents.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" happened<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Back in 2020, the couple was told they had to follow several new gun rules if they wanted to renew their foster care license.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those rules required them to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Keep every firearm unloaded.<\/li>\n\n\n\n<li>Lock firearms away from foster children.<\/li>\n\n\n\n<li>Store ammunition separately.<\/li>\n\n\n\n<li>Tell the state what firearms they owned and where they were stored.<\/li>\n\n\n\n<li>Stop carrying a concealed handgun around foster children, even though they had a valid <a href=\"https:\/\/gunsamerica.com\/digest\/can-center-axis-relock-make-faster-safer-accurate\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"wisconsin-foster-parent-gun-ruling\" title=\"Wisconsin Appeals Court Strikes Down Foster Parent Gun Rule\" data-wpil-monitor-id=\"7392\">concealed carry<\/a> license.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Laffertys argued those requirements violated both the U.S. Constitution and Wisconsin&#8217;s own constitutional right to keep and bear arms.<\/p>\n\n\n\n<h2 id=\"h-the-state-changed-the-rules-but-the-court-kept-going\" class=\"wp-block-heading\">The state changed the rules but the court kept going<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As the lawsuit worked its way through the courts, Wisconsin quietly rewrote much of its foster parent firearm policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The state dropped the <a href=\"https:\/\/gunsamerica.com\/digest\/clays-ultimate-holiday-gift-guide-ccw-edition-smith-crossbreed-crimson-trace\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"wisconsin-foster-parent-gun-ruling\" title=\"Wisconsin Appeals Court Strikes Down Foster Parent Gun Rule\" data-wpil-monitor-id=\"7393\">concealed carry<\/a> ban and relaxed some of the storage requirements, arguing those changes made much of the lawsuit moot.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The appeals court agreed that some issues had disappeared because the rules changed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But not all of them.<\/p>\n\n\n\n<h2 id=\"h-the-biggest-takeaway\" class=\"wp-block-heading\">The biggest takeaway<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The court&#8217;s most significant ruling centered on one remaining requirement: forcing foster parents to keep every firearm unloaded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judges struck that requirement down, holding that Wisconsin cannot require foster parents to surrender their constitutional right to have a usable <a href=\"https:\/\/gunsamerica.com\/digest\/hunt365-june-backcountry-carry-solution-sig-sauer-p320-xten-10mm\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"wisconsin-foster-parent-gun-ruling\" title=\"Wisconsin Appeals Court Strikes Down Foster Parent Gun Rule\" data-wpil-monitor-id=\"7396\">firearm for self-defense<\/a> inside their own home as a condition of receiving a foster care license.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In other words, the state can&#8217;t tell someone:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>&#8220;You can foster children\u2014but only if you give up part of your <a href=\"https:\/\/gunsamerica.com\/digest\/people-book-celebrates-gun-owners-across-america\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"wisconsin-foster-parent-gun-ruling\" title=\"Wisconsin Appeals Court Strikes Down Foster Parent Gun Rule\" data-wpil-monitor-id=\"7394\">Second Amendment<\/a> rights.<\/em><\/p>\n\n\n\n<h2 id=\"h-you-didn-t-waive-your-rights\" class=\"wp-block-heading\">&#8220;You didn&#8217;t waive your rights&#8221;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the state&#8217;s biggest arguments was that the Laffertys voluntarily agreed to these conditions when they chose to become foster parents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court rejected that argument.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judges found the couple never voluntarily gave up their constitutional rights. Instead, they signed the paperwork under protest while simultaneously challenging the rules in court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That&#8217;s not the same thing as waiving a constitutional right, the court said.<\/p>\n\n\n\n<h2 id=\"h-the-firearm-disclosure-rule-also-took-a-hit\" class=\"wp-block-heading\">The firearm disclosure rule also took a hit<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The court also ruled Wisconsin went too far by demanding detailed information about the couple&#8217;s firearms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Officials wanted the Laffertys to identify every firearm they owned\u2014and in some cases had owned previously\u2014including where each gun and its ammunition were stored.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The appeals court called those disclosure demands overly broad and impermissible.<\/p>\n\n\n\n<h2 id=\"h-what-the-ruling-doesn-t-do\" class=\"wp-block-heading\">What the ruling doesn&#8217;t do<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The decision does not eliminate every <a href=\"https:\/\/gunsamerica.com\/digest\/top-five-lessons-learned-training\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"wisconsin-foster-parent-gun-ruling\" title=\"Wisconsin Appeals Court Strikes Down Foster Parent Gun Rule\" data-wpil-monitor-id=\"7395\">firearm safety<\/a> rule for foster parents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wisconsin can still require guns to be secured so foster children can&#8217;t easily access them. The state had already updated its rules to allow licensed foster parents to carry concealed handguns while around foster children, provided they remain under the adult&#8217;s control.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What the court said the state cannot do is require firearms to be unloaded as a blanket condition for becoming\u2014or remaining\u2014a foster parent.<\/p>\n\n\n\n<h2 id=\"h-why-it-matters\" class=\"wp-block-heading\">Why it matters<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The ruling reaches beyond foster care.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At its core, the decision says government agencies generally can&#8217;t force people to choose between receiving a government benefit and exercising a constitutional right.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judges repeatedly emphasized that constitutional rights don&#8217;t disappear simply because someone volunteers to serve the public in another role.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case now heads back to the lower court with instructions consistent with the appeals court&#8217;s ruling, unless Wisconsin seeks further review before the state
