Platkin<\/em> (also referred to as <em>ANJRPC v. Platkin<\/em>).<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"The Next Two Assault Weapon Bans to Fall Will Be . . .\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/BB1k-ArSk3Y?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to Kirk, the spotlight should especially be on the<a href=\"https:\/\/gunsamerica.com\/digest\/virgin-island-gov-signs-confiscation-order-ahead-hurricane-irma\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"delaware-us-virgin-islands-assault-weapon-ban\" title=\"Delaware, U.S. Virgin Islands AWBs Could Be Next to Fall\"> U.S. Virgin Islands,<\/a> where the U.S. Department of Justice has filed its second motion for a preliminary injunction seeking to block enforcement of the territory&#8217;s assault weapon and magazine ban while the lawsuit moves forward.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The timing is noteworthy. Just weeks before the Third Circuit ruled that New Jersey&#8217;s assault weapon and magazine bans likely violate the <a href=\"https:\/\/gunsamerica.com\/digest\/people-book-celebrates-gun-owners-across-america\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"delaware-us-virgin-islands-assault-weapon-ban\" title=\"Delaware, U.S. Virgin Islands AWBs Could Be Next to Fall\" data-wpil-monitor-id=\"7329\">Second Amendment<\/a>, lawmakers in the U.S. Virgin Islands expanded their own restrictions by passing Act 9113, which broadened the territory&#8217;s existing assault weapon ban.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kirk argues that puts the territory in a difficult legal position.<\/p>\n\n\n\n<h2 id=\"h-see-also-colt-python-3-inch-two-upgrades-that-perfect-it\" class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/colt-python-3-inch-upgrades\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"delaware-us-virgin-islands-assault-weapon-ban\" title=\"Delaware, U.S. Virgin Islands AWBs Could Be Next to Fall\">Colt Python 3 Inch: Two Upgrades That Perfect It<\/a><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In the DOJ&#8217;s motion, attorneys contend the Third Circuit&#8217;s recent ruling leaves little room to defend either the assault weapon ban or the <a href=\"https:\/\/gunsamerica.com\/digest\/new-reduced-capacity-full-sized-ar-magazines-say-what\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"delaware-us-virgin-islands-assault-weapon-ban\" title=\"Delaware, U.S. Virgin Islands AWBs Could Be Next to Fall\" data-wpil-monitor-id=\"7332\">magazine capacity<\/a> limits. The Justice Department argues the law should be blocked immediately because it is likely unconstitutional under controlling Third Circuit precedent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One issue highlighted in the motion involves magazines. While the Virgin Islands grandfathered in certain firearms already owned before the law took effect, Kirk notes the legislation does not provide the same protection for many magazines. According to the DOJ, that leaves some owners with an impossible choice: surrender or destroy their magazines, or keep them and risk criminal prosecution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kirk also points out that the DOJ brought the lawsuit under 34 U.S.C. \u00a7 12601, a federal law that allows the government to seek court orders when it believes <a href=\"https:\/\/gunsamerica.com\/digest\/the-mil-leo-only-guns-from-your-favorite-companies\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"delaware-us-virgin-islands-assault-weapon-ban\" title=\"Delaware, U.S. Virgin Islands AWBs Could Be Next to Fall\" data-wpil-monitor-id=\"7330\">law enforcement<\/a> agencies are engaged in a pattern or practice of violating constitutional rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Looking ahead, Kirk believes Delaware could soon find itself facing many of the same legal challenges because it falls under the same Third Circuit Court of Appeals. If the appellate court&#8217;s reasoning ultimately stands, he says both jurisdictions may be <a href=\"https:\/\/gunsamerica.com\/digest\/assault-weapon-ban-florida\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"delaware-us-virgin-islands-assault-weapon-ban\" title=\"Delaware, U.S. Virgin Islands AWBs Could Be Next to Fall\" data-wpil-monitor-id=\"7333\">forced to defend assault weapon bans<\/a> that now appear to be on increasingly uncertain legal footing. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As always, he encourages <a
