It arrives just months before the U.S. Supreme Court is set to hear two high-profile challenges to so-called &#8220;assault weapon&#8221; bans out of Connecticut and Illinois.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"U.S. appeals court overturns New Jersey&#039;s assault weapons ban\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/56cS8VbFVKA?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>The case, <em><a href=\"https:\/\/www.anjrpc.org\/page\/CourtStrikesDownNJAWBan\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-jersey-ar15-ban-third-circuit\" title=\"Federal Appeals Court Strikes Down New Jersey's AR-15, Magazine Ban\">Association of New Jersey Rifle and Pistol Clubs v. New Jersey Attorney General,<\/a><\/em> centered on whether New Jersey could prohibit the sale and possession of commonly owned semi-automatic rifles and magazines holding more than 10 rounds.<\/p>\n\n\n\n<p>The court&#8217;s answer was a clear no.<\/p>\n\n\n\n<p>After reviewing the Supreme Court&#8217;s decisions in <em>Heller<\/em>, <em>Bruen<\/em>, <em>Rahimi<\/em>, and <em>Wolford<\/em>, the majority concluded that New Jersey&#8217;s &#8220;complete prohibition on the possession of semi-automatic rifles runs afoul of the <a href=\"https:\/\/gunsamerica.com\/digest\/people-book-celebrates-gun-owners-across-america\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-jersey-ar15-ban-third-circuit\" title=\"Federal Appeals Court Strikes Down New Jersey's AR-15, Magazine Ban\" data-wpil-monitor-id=\"7245\">Second Amendment&#8217;s<\/a> protections.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-prodigy-coa-tested-100-yards-zero-malfunctions\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/springfield-prodigy-coa-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-jersey-ar15-ban-third-circuit\" title=\"Federal Appeals Court Strikes Down New Jersey's AR-15, Magazine Ban\">Prodigy COA Tested: 100 Yards, Zero Malfunctions<\/a><\/h2>\n\n\n\n<p>The court also rejected the state&#8217;s argument that only the <a href=\"https:\/\/gunsamerica.com\/digest\/colt-ar-15-m4-patrol-rifles-new-gun-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-jersey-ar15-ban-third-circuit\" title=\"Federal Appeals Court Strikes Down New Jersey's AR-15, Magazine Ban\" data-wpil-monitor-id=\"7247\">Colt AR-15<\/a> deserved constitutional protection. Instead, it ruled the district court was wrong to limit its earlier decision to one specific firearm and held that the ban applies to an entire class of commonly owned rifles.<\/p>\n\n\n\n<p>According to the opinion, there are at least 24 million AR-15-style <a href=\"https:\/\/gunsamerica.com\/digest\/new-barnes-precision-ars-shot-show-2017\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-jersey-ar15-ban-third-circuit\" title=\"Federal Appeals Court Strikes Down New Jersey's AR-15, Magazine Ban\" data-wpil-monitor-id=\"7246\">rifles<\/a> in circulation in the United States. NSSF says that number has now grown to more than 32 million.<\/p>\n\n\n\n<p>&#8220;This ruling vindicates what NSSF has argued for decades,&#8221; said Lawrence Keane, NSSF&#8217;s senior vice president and general counsel. &#8220;The MSR is a commonly used firearm that is protected for legal sale and lawful ownership under the Second Amendment.&#8221;<\/p>\n\n\n\n<p>The decision also tackled another hot-button issue: magazine bans.<\/p>\n\n\n\n<p>The Third Circuit became the first federal appeals court to explicitly hold that detachable magazines are protected &#8220;arms&#8221; under the Second Amendment, not merely accessories.<\/p>\n\n\n\n<p>The judges wrote that nothing in the Constitution suggests a magazine&#8217;s capacity determines whether it receives constitutional protection.<\/p>\n\n\n\n<p>&#8220;Because magazines are required to operate many firearms, they are &#8216;Arms&#8217; within the text of the Second Amendment,&#8221; the court wrote, adding that magazines capable of holding more than 10 rounds are &#8220;presumptively entitled to constitutional protection.&#8221;<\/p>\n\n\n\n<p>The court further concluded that New Jersey failed to show its magazine restrictions were consistent with the nation&#8217;s historical tradition of firearm regulation, as required under the Supreme Court&#8217;s <em>Bruen<\/em> framework.<\/p>\n\n\n\n<p>That finding could prove especially important as the Supreme Court prepares to hear similar cases this fall.<\/p>\n\n\n\n<p><a href=\"https:\/\/gunsamerica.com\/digest\/ccrkba-new-york-frees-criminals-then-blames-guns\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-jersey-ar15-ban-third-circuit\" title=\"Federal Appeals Court Strikes Down New Jersey's AR-15, Magazine Ban\" data-wpil-monitor-id=\"7243\">The Citizens Committee for the Right to Keep and Bear Arms<\/a> (CCRKBA) called the ruling a warning to states with similar laws.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-how-to-zero-a-red-dot-in-5-simple-steps\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/how-to-zero-a-red-dot\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-jersey-ar15-ban-third-circuit\" title=\"Federal Appeals Court Strikes Down New Jersey's AR-15, Magazine Ban\">How to Zero a Red Dot in 5 Simple Steps<\/a><\/h2>\n\n\n\n<p>This amounts to a warning shot across the bow of anti-gun-rights lawmakers,&#8221; said <a href=\"https:\/\/gunsamerica.com\/digest\/ccrkba-easier-to-get-a-gun-than-a-burger-your-fries-arent-cooked\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-jersey-ar15-ban-third-circuit\" title=\"Federal Appeals Court Strikes Down New Jersey's AR-15, Magazine Ban\" data-wpil-monitor-id=\"7244\">CCRKBA Chairman Alan Gottlieb<\/a>. &#8220;We&#8217;re encouraged by today&#8217;s ruling that the Supreme Court will spell that out in plain language when it takes up the issue this fall.&#8221;<\/p>\n\n\n\n<p>Gottlieb noted that the Supreme Court is expected to hear challenges to Connecticut&#8217;s statewide rifle ban and Cook County, Illinois&#8217; ordinance when the new term begins in October.<\/p>\n\n\n\n<p>While Friday&#8217;s decision applies directly only within the Third Circuit, it creates another split among federal appeals courts over the constitutionality of rifle and magazine bans. That makes the Supreme Court&#8217;s upcoming review even more significant.<\/p>\n\n\n\n<p>For gun owners, the timing couldn&#8217;t be bigger.<\/p>\n\n\n\n<p>The nation&#8217;s highest court has already agreed to decide whether bans on America&#8217;s most popular rifle are constitutional. Now, one of the country&#8217;s federal appeals courts has made its position unmistakably clear: commonly owned semi-automatic rifles and standard-capacity magazines are protected by the Second
