During a recent deep dive (see below), attorneys Emily Taylor and Richard Hayes unpacked everything from the infamous &#8220;51% sign&#8221; to what they describe as legislative mistakes that still haven&#8217;t been cleaned up.<\/p>\n\n\n\n<p>The takeaway? Armed Attorneys note that&#8217;s why Chili&#8217;s, Texas Roadhouse, or similar restaurants aren&#8217;t automatically prohibited locations simply because they have a bar area.<\/p>\n\n\n\n<p>Taylor explains that before constitutional carry became law in 2021, these restrictions mainly applied to licensed handgun carriers. After lawmakers reorganized Texas&#8217; carry statutes, the prohibition now applies to all firearms, not just handguns.<\/p>\n\n\n\n<p>That&#8217;s where things get strange.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-signs-don-t-match-the-law\">The Signs Don&#8217;t Match the Law<\/h2>\n\n\n\n<p>One of the biggest quirks involves the familiar red &#8220;51%&#8221; signs.<\/p>\n\n\n\n<p>Even though Texas law now prohibits all firearms in qualifying bars, many of the required signs still reference only handguns, because the language was never fully updated after lawmakers rewrote portions of the Penal Code.<\/p>\n\n\n\n<p>Hayes said he believes courts would likely still uphold a conviction involving a long <a href=\"https:\/\/gunsamerica.com\/digest\/mossbermvp-prs\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-bar-carry-laws\" title=\"Texas Bar Carry Laws Are More Confusing Than You Think\" data-wpil-monitor-id=\"7226\">gun<\/a> despite the outdated wording, but he advised gun owners not to become the test case.<\/p>\n\n\n\n<p>&#8220;Let&#8217;s not mess around with that too much,&#8221; he said.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-license-holders-get-one-important-protection\">License Holders Get One Important Protection<\/h2>\n\n\n\n<p>Another wrinkle involves License to Carry (LTC) holders.<\/p>\n\n\n\n<p>According to Armed Attorneys, an LTC holder who enters a qualifying bar without receiving proper legal notice may have a statutory defense if the required signage wasn&#8217;t correctly posted. The attorneys point to Texas Penal Code 46.15, which exempts licensed carriers in certain situations when effective notice wasn&#8217;t provided.<\/p>\n\n\n\n<p>But they stress that doesn&#8217;t mean someone should stay once they discover the sign.<\/p>\n\n\n\n<p>&#8220;If you find yourself in this situation&#8230; I&#8217;d probably just leave,&#8221; Hayes said, warning that once you&#8217;re aware of the notice, &#8220;Don&#8217;t risk a felony.&#8221;<\/p>\n\n\n\n<p>Constitutional carriers, however, don&#8217;t receive the same protection.<\/p>\n\n\n\n<p>Armed Attorneys note that someone carrying without an LTC can still face <a href=\"https:\/\/gunsamerica.com\/digest\/california-man-12-felony-charges-registering-ar-15\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-bar-carry-laws\" title=\"Texas Bar Carry Laws Are More Confusing Than You Think\" data-wpil-monitor-id=\"7228\">felony charges<\/a> for entering a prohibited 51% establishment even if the business failed to post the required sign. That&#8217;s one reason they continue encouraging Texans to obtain an LTC even though permitless carry is legal.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-not-every-51-sign-is-legitimate\">Not Every 51% Sign Is Legitimate<\/h2>\n\n\n\n<p>The attorneys also discussed a surprisingly common problem: businesses posting the wrong sign.<\/p>\n\n\n\n<p>Taylor said some restaurants, coffee shops, barber shops and other establishments mistakenly display 51% signs even though they don&#8217;t legally qualify as bars.<\/p>\n\n\n\n<p>Fortunately, there&#8217;s a way to check.<\/p>\n\n\n\n<p><strong>SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/fn-reflex-review-micro-compact-9mm\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-bar-carry-laws\" title=\"Texas Bar Carry Laws Are More Confusing Than You Think\">FN Reflex Review: The Micro 9mm That Wouldn\u2019t Quit<\/a><\/strong><\/p>\n\n\n\n<p><a href=\"https:\/\/www.tabc.texas.gov\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-bar-carry-laws\" title=\"Texas Bar Carry Laws Are More Confusing Than You Think\">Texas Alcoholic Beverage Commission<\/a> records allow the public to verify whether a business is actually classified as a 51% establishment. If the listing shows a red sign, it&#8217;s a prohibited location. If it shows blue, it&#8217;s generally treated as a restaurant or other alcohol-serving business where different rules apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-a-legislative-hot-mess\">A Legislative &#8220;Hot Mess&#8221;<\/h2>\n\n\n\n<p>Perhaps the most surprising part of the discussion centered on another section of Texas law dealing with bar owners and managers.<\/p>\n\n\n\n<p>Taylor argued lawmakers accidentally left behind statutory references to sections that no longer exist after reorganizing the Penal Code in 2021. The result, she said, is what she repeatedly called a &#8220;hot mess.&#8221;<\/p>\n\n\n\n<p>Hayes agreed.<\/p>\n\n\n\n<p>&#8220;It&#8217;s a mess,&#8221; he said, adding that while there may be strong legal arguments on appeal if someone were prosecuted under the confusing language, trial courts could reach different conclusions until lawmakers fix it.<\/p>\n\n\n\n<p>As Armed Attorneys point out, <a href=\"https:\/\/gunsamerica.com\/digest\/crooks-knock-over-texas-gun-store-get-away-with-over-85-firearms\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-bar-carry-laws\" title=\"Texas Bar Carry Laws Are More Confusing Than You Think\" data-wpil-monitor-id=\"7229\">Texas gun<\/a> laws often look straightforward until you start reading the actual statutes.<\/p>\n\n\n\n<p><strong><em>Do you live in Texas?
