Cook County<\/a> and <a href=\"https:\/\/www.scotusblog.com\/cases\/grant-v-higgins\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-assault-weapon-ban-cases\" title=\"Supreme Court to Finally Decide Constitutionality of 'Assault Weapon' Bans\">Grant v. They are the <a href=\"https:\/\/gunsamerica.com\/digest\/the-manson-family-murders-helter-skelter-part-2\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-assault-weapon-ban-cases\" title=\"Supreme Court to Finally Decide Constitutionality of 'Assault Weapon' Bans\" data-wpil-monitor-id=\"7116\">weapons of choice<\/a> for mass shooters,&#8221; said Janet Carter, managing director of Second Amendment litigation at Everytown Law.<\/p>\n\n\n\n<p>The organization argues the bans are constitutional and notes that six federal appeals courts have upheld similar laws. Everytown also points to research claiming that shootings involving so-called assault weapons result in significantly more victims than incidents involving other firearms.<\/p>\n\n\n\n<p>According to the group, 11 states and Washington, D.C., currently prohibit these rifles.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-nssf-they-re-america-s-most-popular-rifle\">NSSF: They&#8217;re America&#8217;s Most Popular Rifle<\/h3>\n\n\n\n<p>The <a href=\"https:\/\/gunsamerica.com\/digest\/nssf-hails-final-rule-rolling-back-biden-era-export-restrictions\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-assault-weapon-ban-cases\" title=\"Supreme Court to Finally Decide Constitutionality of 'Assault Weapon' Bans\" data-wpil-monitor-id=\"7115\">National Shooting Sports Foundation<\/a> sees the issue very differently.  NSSF celebrated the Court&#8217;s decision, arguing it&#8217;s long overdue.<\/p>\n\n\n\n<p>The organization says the cases involve the most commonly sold centerfire rifle in America, with more than 32 million Modern Sporting Rifles currently owned by law-abiding Americans.<\/p>\n\n\n\n<p>That&#8217;s important because the Supreme Court&#8217;s decisions in <em>District of Columbia v. Heller<\/em> and <em><a href=\"https:\/\/gunsamerica.com\/digest\/ny-lawmakers-move-ban-child-operated-firearms\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-assault-weapon-ban-cases\" title=\"Supreme Court to Finally Decide Constitutionality of 'Assault Weapon' Bans\" data-wpil-monitor-id=\"7119\">New York<\/a> State Rifle &amp; Pistol Association v. Bruen<\/em> held that firearms in &#8220;common use&#8221; for lawful purposes are protected by the Second Amendment.<\/p>\n\n\n\n<p>NSSF argues that&#8217;s exactly where these rifles fall.<\/p>\n\n\n\n<p>The trade association also expressed frustration that the Court declined to hear similar challenges last year, saying lower courts have continued to misapply <em>Heller<\/em> and <em>Bruen<\/em>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-saf-common-use-is-the-key\">SAF: Common Use Is the Key<\/h3>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"SCOTUS Is FINALLY Taking On Assault Weapon Bans!!!\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/UYlWJfUcskE?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>The Second Amendment Foundation also praised the Court&#8217;s decision.<\/p>\n\n\n\n<p>Executive Director Adam Kraut said the cases should finally answer whether commonly owned semi-automatic rifles receive the same constitutional protection as other firearms.<\/p>\n\n\n\n<p>&#8220;The modern semi-automatic rifles banned in Cook County, Connecticut and elsewhere are among the most commonly owned firearms in the country,&#8221; Kraut said.<\/p>\n\n\n\n<p><strong>SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/mossberg-590-bliksem-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-assault-weapon-ban-cases\" title=\"Supreme Court to Finally Decide Constitutionality of 'Assault Weapon' Bans\">Mossberg 590 Bliksem Review: 12-Gauge Thunder<\/a><\/strong><\/p>\n\n\n\n<p>He added that it&#8217;s difficult to argue the rifles fall outside the Second Amendment when there may be more of them in civilian hands than Ford F-150 pickups on American roads.<\/p>\n\n\n\n<p><a href=\"https:\/\/gunsamerica.com\/digest\/saf-files-suit-to-protect-4a-rights-of-high-school-gun-owner\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-assault-weapon-ban-cases\" title=\"Supreme Court to Finally Decide Constitutionality of 'Assault Weapon' Bans\" data-wpil-monitor-id=\"7118\">SAF founder Alan Gottlieb<\/a> said lawmakers have relied on &#8220;fearmongering&#8221; when regulating semi-automatic rifles based largely on their appearance and cosmetic features rather than how they function.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-why-this-case-matters\">Why This Case Matters<\/h3>\n\n\n\n<p>The Court isn&#8217;t deciding whether these rifles are good or bad.  The central legal question is much narrower:<\/p>\n\n\n\n<p><strong><em>Can states ban a class of firearms that millions of Americans commonly own for lawful purposes?<\/em><\/strong><\/p>\n\n\n\n<p>Gun-rights groups say the answer is clearly &#8220;no&#8221; under <em>Heller<\/em> and <em>Bruen<\/em>.<\/p>\n\n\n\n<p>Gun-control advocates argue these <a href=\"https:\/\/gunsamerica.com\/digest\/hunt365-savage-110-long-range-hunter-reaching-out-in-300-prc\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-assault-weapon-ban-cases\" title=\"Supreme Court to Finally Decide Constitutionality of 'Assault Weapon' Bans\" data-wpil-monitor-id=\"7117\">rifles are uniquely dangerous and that states have the authority<\/a> to restrict them in the interest of public safety.<\/p>\n\n\n\n<p>Sometime during the Court&#8217;s upcoming term, the justices will have the final word.  Whatever they decide won&#8217;t just affect Illinois and Connecticut.
