Gavin Newsom and Attorney General Rob Bonta warning that if Assembly Bill 1127 (the law critics have dubbed California&#8217;s &#8220;Glock ban&#8221;) goes into effect on July 1, the federal government will file suit.<\/p>\n\n\n\n<p>The reason?  The DOJ says the law violates the Second Amendment.<\/p>\n\n\n\n<div class=\"wp-block-yoast-seo-table-of-contents yoast-table-of-contents\"><h2>Table of contents<\/h2><ul><li><a href=\"#h-america-s-most-popular-handgun\" class=\"clickTracking\" campaign=\"doj-lawsuit-california-glock-ban\" title=\"DOJ Threatens Lawsuit Over California Glock Ban\" data-level=\"2\">America&#8217;s Most Popular Handgun<\/a><\/li><li><a href=\"#h-doj-takes-aim-at-more-than-the-glock-ban\" class=\"clickTracking\" campaign=\"doj-lawsuit-california-glock-ban\" title=\"DOJ Threatens Lawsuit Over California Glock Ban\" data-level=\"2\">DOJ Takes Aim at More Than the Glock Ban<\/a><\/li><li><a href=\"#h-one-last-chance\" class=\"clickTracking\" campaign=\"doj-lawsuit-california-glock-ban\" title=\"DOJ Threatens Lawsuit Over California Glock Ban\" data-level=\"2\">One Last Chance<\/a><\/li><li><a href=\"#h-another-major-2a-fight\" class=\"clickTracking\" campaign=\"doj-lawsuit-california-glock-ban\" title=\"DOJ Threatens Lawsuit Over California Glock Ban\" data-level=\"2\">Another Major 2A Fight<\/a><\/li><\/ul><\/div>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"DOJ Dares California to Ban Glocks\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/8l5YW6e6fQA?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-america-s-most-popular-handgun\">America&#8217;s Most Popular Handgun<\/h2>\n\n\n\n<p>Beginning July 1, California firearm dealers will no longer be able to sell many of the most common semi-automatic pistols, including virtually all Glock and Glock-style handguns, according to the DOJ letter discussed by Kirk.<\/p>\n\n\n\n<p>In the letter, Dhillon reminds California that the Supreme Court has repeatedly recognized handguns as the firearm &#8220;chosen by Americans for self-defense.&#8221;<\/p>\n\n\n\n<p>&#8220;Because handguns are the most popular weapon chosen by Americans for self-defense, a prohibition of their use is invalid,&#8221; the letter states.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-doj-takes-aim-at-more-than-the-glock-ban\">DOJ Takes Aim at More Than the Glock Ban<\/h2>\n\n\n\n<p>The threatened lawsuit doesn&#8217;t stop with <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202520260AB1127\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-lawsuit-california-glock-ban\" title=\"DOJ Threatens Lawsuit Over California Glock Ban\">Assembly Bill 1127.<\/a><\/p>\n\n\n\n<p>According to Kirk, the DOJ also plans to challenge California&#8217;s controversial handgun roster, arguing it has denied Californians access to modern handguns for years.<\/p>\n\n\n\n<p>Dhillon&#8217;s letter points to California&#8217;s previous microstamping requirements, which effectively froze the handgun roster for roughly a decade.<\/p>\n\n\n\n<p><strong>SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/taurus-rpc-review-roller-delayed-9mm\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-lawsuit-california-glock-ban\" title=\"DOJ Threatens Lawsuit Over California Glock Ban\">Taurus RPC Review: MP5 Feel Under $1,000<\/a> <\/strong><\/p>\n\n\n\n<p>The letter also cites the federal court decision in <em>Boland v. Bonta<\/em>, where the court concluded Californians have a constitutional right to acquire modern handguns rather than being forced to rely on decade-old models.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-one-last-chance\">One Last Chance<\/h2>\n\n\n\n<p>The DOJ isn&#8217;t immediately heading to court.  Instead, the letter gives California until the close of business on June 30 to negotiate.  To avoid litigation, the DOJ says California would need to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Stop enforcing the challenged laws.<\/li>\n\n\n\n<li>Acknowledge they are unconstitutional.<\/li>\n\n\n\n<li>Agree to a court-enforceable consent decree preventing similar constitutional violations in the future.<\/li>\n<\/ul>\n\n\n\n<p>Given California&#8217;s long-running defense of its firearm regulations, Kirk said he fully expects state officials to reject the offer.  If that happens, he predicts the lawsuit will be filed on July 1.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-another-major-2a-fight\">Another Major 2A Fight<\/h2>\n\n\n\n<p>California has spent years defending some of the nation&#8217;s strictest gun laws, many of which have been challenged after the Supreme Court&#8217;s landmark <em>Bruen<\/em> decision.<\/p>\n\n\n\n<p>If the DOJ follows through, this case could become one of the highest-profile Second Amendment lawsuits filed by the federal government in years.<\/p>\n\n\n\n<p>And this time, it won&#8217;t be a gun-rights organization taking California to court.
