Lopez<\/em>, the Court ruled Hawaii violated the Second and Fourteenth Amendments by prohibiting licensed concealed carriers from bringing firearms onto private property open to the public unless the owner gave express permission.<\/p>\n\n\n\n<p>Justice Samuel Alito, writing for the majority, was rather direct. <\/p>\n\n\n\n<p>This regime hobbles what the <a href=\"https:\/\/gunsamerica.com\/digest\/people-book-celebrates-gun-owners-across-america\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-hawaiis-vampire-rule\" title=\"SCOTUS Strikes Down Hawaii's 'Vampire Rule'\" data-wpil-monitor-id=\"7064\">Second Amendment<\/a> protects: the right of Americans to carry arms for self-defense as they go about their daily lives,&#8221; Alito wrote.<\/p>\n\n\n\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">Gun laws keep people safe. Without it, entering armed became a crime.<\/p>\n\n\n\n<p>The Court said that burden was unconstitutional.<\/p>\n\n\n\n<p>Alito illustrated the problem by describing a woman with a valid carry permit trying to go about an ordinary day. Filling up at a gas station, grabbing lunch, shopping for groceries, or stopping at a dry cleaner could all expose her to criminal liability unless every business had posted <a href=\"https:\/\/gunsamerica.com\/digest\/duck-hunting-in-september\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-hawaiis-vampire-rule\" title=\"SCOTUS Strikes Down Hawaii's 'Vampire Rule'\" data-wpil-monitor-id=\"7071\">&#8220;Guns Welcome&#8221; signs or someone in authority<\/a> granted permission.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-9-16 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Supreme Court strikes down Hawaii restrictions on carrying guns on private property\" width=\"422\" height=\"750\" src=\"https:\/\/www.youtube.com\/embed\/xTfCW5xp36A?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-spirit-of-aloha-doesn-t-override-the-constitution\">&#8216;The Spirit of Aloha&#8217; Doesn&#8217;t Override the Constitution<\/h2>\n\n\n\n<p>One of the opinion&#8217;s most memorable passages rejected Hawaii&#8217;s argument that its unique history and culture justified the restriction.<\/p>\n\n\n\n<p>&#8220;The Second Amendment cannot give way to &#8216;the spirit of Aloha&#8217; in Hawaii,&#8221; Alito wrote, &#8220;any more than it can yield to the spirit of the Big Apple or the Windy City.&#8221;<\/p>\n\n\n\n<p>The Court emphasized that constitutional rights do not change from state to state simply because local officials have different attitudes toward firearms.<\/p>\n\n\n\n<p>It also rejected Hawaii&#8217;s historical arguments, including attempts to justify the law with colonial anti-poaching statutes and even an 1865 Louisiana Black Code that disarmed newly freed Black Americans. The Court called reliance on that law impossible to take seriously as evidence of the Second Amendment&#8217;s original meaning.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-another-bruen-rebuff\">Another Bruen Rebuff<\/h2>\n\n\n\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">We\u2019re disappointed by the Supreme Court\u2019s decision to strike down Hawaii\u2019s law requiring permission to carry guns onto private property. Bruen<\/em>, which held that law-abiding Americans have a constitutional right to <a href=\"https:\/\/gunsamerica.com\/digest\/hunt365-june-backcountry-carry-solution-sig-sauer-p320-xten-10mm\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-hawaiis-vampire-rule\" title=\"SCOTUS Strikes Down Hawaii's 'Vampire Rule'\" data-wpil-monitor-id=\"7062\">carry handguns in public for self-defense<\/a>.<\/p>\n\n\n\n<p>According to the majority, Hawaii responded by replacing one unconstitutional restriction with another. People have a right to carry firearms in public for personal protection, and that includes <a href=\"https:\/\/gunsamerica.com\/digest\/palm-beach-shopping-malls-dicks\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-hawaiis-vampire-rule\" title=\"SCOTUS Strikes Down Hawaii's 'Vampire Rule'\" data-wpil-monitor-id=\"7073\">shopping malls<\/a>, supermarkets, hotels, gas stations and other places.<\/p>\n\n\n\n<p>Gottlieb added that if a business wants to prohibit firearms, &#8220;the responsibility for posting that falls on the establishment,&#8221; not the law-abiding citizen.<\/p>\n\n\n\n<p>He also said the decision should prompt <a href=\"https:\/\/gunsamerica.com\/digest\/veto-west-vriginia-override\/\" target=\"_blank\" class=\"clickTracking\"
