There's Just One Problem.\">exactly<\/a> what&#8217;s happening with Brady&#8217;s latest <a href=\"https:\/\/democracyforward.org\/wp-content\/uploads\/2026\/06\/Compl-1-Brady-v.-ATF.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"brady-sues-atf-trace-data\" title=\"Brady Wants the ATF's Secret Trace Data Back. There's Just One Problem.\">program<\/a>, a long-running reporting requirement for firearm retailers whose guns are later traced by law enforcement under specific circumstances.<\/p>\n\n\n\n<p>The problem?  That data isn&#8217;t public for a reason.<\/p>\n\n\n\n<p>For more than two decades, Congress has protected firearm trace data through what&#8217;s known as the Tiahrt Amendment. The restrictions weren&#8217;t put in place to protect <a href=\"https:\/\/gunsamerica.com\/digest\/the-worst-gun-ever-made\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"brady-sues-atf-trace-data\" title=\"Brady Wants the ATF's Secret Trace Data Back. There's Just One Problem.\" data-wpil-monitor-id=\"6981\">bad gun<\/a> dealers. They were put in place because <a href=\"https:\/\/gunsamerica.com\/digest\/the-mil-leo-only-guns-from-your-favorite-companies\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"brady-sues-atf-trace-data\" title=\"Brady Wants the ATF's Secret Trace Data Back. There's Just One Problem.\" data-wpil-monitor-id=\"6978\">law enforcement<\/a> agencies, ATF officials, and even the Fraternal Order of Police have repeatedly warned that releasing trace data could compromise investigations and endanger officers and witnesses.<\/p>\n\n\n\n<p>Yet here we are.  Brady wants it anyway.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-magic-trick\">The Magic Trick<\/h2>\n\n\n\n<p>Here&#8217;s where things get interesting.  A <a href=\"https:\/\/gunsamerica.com\/digest\/ak-47-hog-blaster\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"brady-sues-atf-trace-data\" title=\"Brady Wants the ATF's Secret Trace Data Back. There's Just One Problem.\" data-wpil-monitor-id=\"6980\">firearm<\/a> trace does not tell investigators where a criminal got a gun.  It tells investigators where the firearm was originally sold at retail.  That&#8217;s a huge distinction.<\/p>\n\n\n\n<p>As the ATF itself has repeatedly warned, a firearm being traced to a dealer does not suggest that dealer did anything wrong. In fact, ATF has published disclaimers saying exactly that.<\/p>\n\n\n\n<p>Think of it this way:<\/p>\n\n\n\n<p>If police recover a stolen Ford F-150 used in a bank robbery, nobody assumes the dealership that sold the truck was part of the crime.  But somehow when it comes to firearms, some activists look at a trace and immediately start pointing fingers at the retailer.  That&#8217;s the entire problem Keane is highlighting.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-numbers-brady-doesn-t-like\">The Numbers Brady Doesn&#8217;t Like<\/h2>\n\n\n\n<p>The irony is that ATF&#8217;s own data undercuts much of the narrative.  According to ATF&#8217;s National Firearms Commerce and Trafficking Assessment, investigators examined roughly 9,700 firearm trafficking cases between 2017 and 2021.<\/p>\n\n\n\n<p>Only 136 involved a corrupt Federal Firearms Licensee.  That&#8217;s about 1.6 percent. There's Just One Problem.\">M&amp;P 2.0 10mm Review: Big Power, No Brick Feel<\/a><\/strong><\/p>\n\n\n\n<p>In other words, roughly 99 percent of firearm dealers weren&#8217;t implicated in trafficking investigations.<\/p>\n\n\n\n<p>Meanwhile, ATF found that <a href=\"https:\/\/gunsamerica.com\/digest\/egregious-straw-purchase-plea-deal-a-slap-in-firearm-industry-face\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"brady-sues-atf-trace-data\" title=\"Brady Wants the ATF's Secret Trace Data Back. There's Just One Problem.\" data-wpil-monitor-id=\"6977\">straw purchases<\/a> and private transfers accounted for about 80 percent of trafficking cases.  That&#8217;s not exactly the headline <a href=\"https:\/\/gunsamerica.com\/digest\/bill-social-security-nics\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"brady-sues-atf-trace-data\" title=\"Brady Wants the ATF's Secret Trace Data Back. There's Just One Problem.\" data-wpil-monitor-id=\"6979\">gun control<\/a> groups want printed on bumper stickers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-why-demand-letter-2-is-going-away\">Why Demand Letter 2 Is Going Away<\/h2>\n\n\n\n<p>The ATF has already announced that the Demand Letter 2 program is being phased out.<\/p>\n\n\n\n<p>Current ATF leadership has acknowledged concerns that advocacy groups have repeatedly attempted to misuse the data and circumvent disclosure protections.<\/p>\n\n\n\n<p>Translation?  The gravy train may be leaving the station.  And Brady appears determined to chase it down the tracks.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-follow-the-real-story\">Follow the Real Story<\/h2>\n\n\n\n<p>Keane argues this lawsuit isn&#8217;t really about transparency.  It&#8217;s about keeping alive a &#8220;name-and-shame&#8221; campaign that uses incomplete trace data to paint lawful firearm retailers as villains.<\/p>\n\n\n\n<p>Reasonable people can debate gun policy.  Reasonable people can debate ATF programs.<\/p>\n\n\n\n<p>But if the federal government, Congress, ATF leadership, and law enforcement organizations all agree that certain data should remain protected because it could jeopardize investigations and officer safety, that&#8217;s probably worth taking seriously.<\/p>\n\n\n\n<p>Especially when the alternative seems to be generating another round of misleading headlines.  At some point, the real question becomes simple:<\/p>\n\n\n\n<p><strong><em>If the data doesn&#8217;t prove what Brady claims it proves, why are they fighting so hard to get it?<\/em><\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\" style=\"font-size:24px\"><strong><em>*** <a href=\"https:\/\/gunsamerica.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"brady-sues-atf-trace-data\" title=\"Brady Wants the ATF's Secret Trace Data Back.
