{"id":244579,"date":"2026-05-20T10:49:11","date_gmt":"2026-05-20T15:49:11","guid":{"rendered":"https:\/\/gunsamerica.com\/digest\/?p=244579"},"modified":"2026-05-21T10:59:05","modified_gmt":"2026-05-21T15:59:05","slug":"virginia-rifle-ban-lawsuit","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/virginia-rifle-ban-lawsuit\/","title":{"rendered":"Lawsuit Seeks Emergency Block on Virginia\u2019s Incoming Rifle Ban"},"content":{"rendered":"\n<p class=\"wp-block-yoast-seo-estimated-reading-time yoast-reading-time__wrapper\"><span class=\"yoast-reading-time__icon\"><svg aria-hidden=\"true\" focusable=\"false\" data-icon=\"clock\" width=\"20\" height=\"20\" fill=\"none\" stroke=\"currentColor\" style=\"display:inline-block;vertical-align:-0.1em\" role=\"img\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewBox=\"0 0 24 24\"><path stroke-linecap=\"round\" stroke-linejoin=\"round\" stroke-width=\"2\" d=\"M12 8v4l3 3m6-3a9 9 0 11-18 0 9 9 0 0118 0z\"><\/path><\/svg><\/span><span class=\"yoast-reading-time__spacer\" style=\"display:inline-block;width:1em\"><\/span><span class=\"yoast-reading-time__descriptive-text\">Estimated reading time: <\/span><span class=\"yoast-reading-time__reading-time\">3<\/span><span class=\"yoast-reading-time__time-unit\"> minutes<\/span><\/p>\n\n\n\n<h1 class=\"wp-block-heading\" id=\"h-\"><\/h1>\n\n\n\n<p>A coalition of gun owners, firearm businesses, and manufacturers is racing to stop Virginia\u2019s new ban on Modern Sporting Rifles and standard-capacity magazines before the law takes effect this summer.<\/p>\n\n\n\n<p>And they\u2019re not wasting time.<\/p>\n\n\n\n<p>A lawsuit funded by NSSF has now filed an emergency motion for a preliminary injunction in Virginia state court, asking a judge to block enforcement of the law before its July 1 effective date.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/nssfpdf.s3.us-east-1.amazonaws.com\/Black+et+al+v+Hook+Brief.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-rifle-ban-lawsuit\" title=\"Lawsuit Seeks Emergency Block on Virginia\u2019s Incoming Rifle Ban\">challenge<\/a> was filed in the Circuit Court of Fauquier County by plaintiffs including Erick Black, Britton Condon, Clark&#8217;s Gun Shop, Optimus Arms LLC, and Hexmag USA LLC.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"The Virginia Gun Grab is Worse Than You Think\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/ozRN4uTc4cM?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>At the center of the lawsuit is Virginia\u2019s sweeping new restriction on <a href=\"https:\/\/gunsamerica.com\/digest\/assault-weapons-ban-passed-illinois\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-rifle-ban-lawsuit\" title=\"Lawsuit Seeks Emergency Block on Virginia\u2019s Incoming Rifle Ban\" data-wpil-monitor-id=\"5751\">so-called<\/a> \u201cassault weapons\u201d and magazines capable of holding more than 15 rounds.<\/p>\n\n\n\n<p>Critics say the law goes far beyond that label.<\/p>\n\n\n\n<p>According to the complaint, the ban sweeps in huge numbers of common semiautomatic rifles, pistols, and shotguns based largely on cosmetic features rather than how the firearms actually function.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-m-amp-p-shield-x-review-better-than-the-shield-plus\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/mp-shield-x-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-rifle-ban-lawsuit\" title=\"Lawsuit Seeks Emergency Block on Virginia\u2019s Incoming Rifle Ban\">M&amp;P Shield X Review: Better Than the Shield Plus?<\/a><\/h2>\n\n\n\n<p>That includes semiautomatic rifles with detachable magazines and features like adjustable stocks or threaded barrels: things <a href=\"https:\/\/gunsamerica.com\/digest\/sig-p365-vs-glock-43-vs-sw-shield\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-rifle-ban-lawsuit\" title=\"Lawsuit Seeks Emergency Block on Virginia\u2019s Incoming Rifle Ban\" data-wpil-monitor-id=\"5747\">gun<\/a> owners argue are standard on modern firearms used for home defense, sport shooting, and hunting.<\/p>\n\n\n\n<p>The lawsuit also points out something hunters in particular may not love hearing: even some common semiautomatic shotguns now fall under the ban.<\/p>\n\n\n\n<p>Lawrence G. Keane said allowing the law to take effect while litigation is ongoing would cause immediate harm to both gun owners and businesses.<\/p>\n\n\n\n<p>\u201cThis law is unconstitutional,\u201d Keane said, \u201cand allowing it to be enforced would rob law-abiding citizens of Virginia of their rights protected by both the Virginia Constitution and the U.S. Constitution.\u201d<\/p>\n\n\n\n<p>The challenge leans heavily on the Supreme Court\u2019s modern Second Amendment rulings, especially <em>District of Columbia v. Heller<\/em> and <em>New York State <a href=\"https:\/\/gunsamerica.com\/digest\/silencerco-omega-36m-centerfire-suppressor\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-rifle-ban-lawsuit\" title=\"Lawsuit Seeks Emergency Block on Virginia\u2019s Incoming Rifle Ban\" data-wpil-monitor-id=\"5749\">Rifle &amp; Pistol<\/a> Association v. Virginia\u2019s penalties are no joke either.<\/p>\n\n\n\n<p>Violating the law could reportedly bring a Class I misdemeanor charge carrying up to one year in jail and a $2,500 fine.<\/p>\n\n\n\n<p>That\u2019s part of why plaintiffs are pushing so aggressively for an emergency injunction before July arrives.<\/p>\n\n\n\n<p>This case could quickly become one of the next major battlegrounds in the national fight over state-level rifle bans, especially as courts around the country continue wrestling with how <em>Bruen<\/em> applies to semiautomatic firearms and magazine restrictions.<\/p>\n\n\n\n<p>And if the injunction gets granted before July 1, it would represent a major early setback for one of the most aggressive <a
