And one of the state\u2019s most controversial anti-carry rules is officially staying down.<\/p>\n\n\n\n<p>In a new ruling tied to <em><a href=\"https:\/\/www.firearmspolicy.org\/boron\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-sensitive-places-carry-ban-ruling\" title=\"Court Smacks Down Major Piece of NY's \u2018Sensitive Places\u2019 Carry Ban\">Christian v. James<\/a><\/em>, the United States Court of Appeals for the Second Circuit affirmed a lower court injunction blocking New York\u2019s so-called \u201cVampire Rule,\u201d which effectively banned lawful concealed carry on nearly all private property open to the public unless owners posted explicit permission signs.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"BREAKING NEWS: 2nd Circuit CRUSHES New York Gun Carry Ban\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/8t4-bXglvPk?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>In other words, the default was \u201cno carry\u201d almost everywhere.<\/p>\n\n\n\n<p>Gun rights groups argued the law was an obvious workaround to the Supreme Court\u2019s landmark <em>New York State Rifle &amp; Pistol Association v. Bruen<\/em> ruling after New York was forced to start issuing carry permits under constitutional standards.<\/p>\n\n\n\n<p>And the court appears to have agreed.<\/p>\n\n\n\n<p>\u201cNew York\u2019s carry ban on private property open to the public \u2013 essentially all private businesses \u2013 was intended as the state\u2019s next novel circumvention of the Second Amendment,\u201d said <a href=\"https:\/\/saf.org\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-sensitive-places-carry-ban-ruling\" title=\"Court Smacks Down Major Piece of NY's \u2018Sensitive Places\u2019 Carry Ban\">SAF<\/a> Senior Director of Legal Operations Bill Sack. \u201cWe are thrilled the Second Circuit saw through this ruse and tossed the ban out on its rear end.\u201d<\/p>\n\n\n\n<p>The lawsuit was brought by SAF alongside Firearms Policy Coalition and plaintiff Brett Christian.  But the ruling wasn\u2019t a total sweep.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-m-amp-p-shield-x-review-better-than-the-shield-plus\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/mp-shield-x-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-sensitive-places-carry-ban-ruling\" title=\"Court Smacks Down Major Piece of NY's \u2018Sensitive Places\u2019 Carry Ban\">M&amp;P Shield X Review: Better Than the Shield Plus?<\/a><\/h2>\n\n\n\n<p>The court also upheld New York\u2019s ban on carrying firearms in parks, rejecting SAF\u2019s arguments that the restriction also violates the Second Amendment. According to SAF, at least one judge issued a notable dissent on that portion of the opinion.<\/p>\n\n\n\n<p>That means the fight over what counts as a legitimate \u201csensitive place\u201d is far from over.<\/p>\n\n\n\n<p>Since Bruen dropped in 2022, anti-gun states like New York, California, New Jersey, and others have tried to redraw massive portions of public life into gun-free zones, often using broad \u201csensitive places\u201d language to restrict where permit holders can legally carry.<\/p>\n\n\n\n<p>Critics say the strategy was never about safety as much as making carry permits functionally useless.<\/p>\n\n\n\n<p>SAF founder Alan Gottlieb made it clear the organization isn\u2019t done pushing back.<\/p>\n\n\n\n<p>\u201cThe ideologues who think they can create \u2018sensitive places\u2019 to ban the legal carry of firearms should understand that SAF will continue to fight for the right to keep and bear arms for all Americans,\u201d Gottlieb said.<\/p>\n\n\n\n<p>For New York gun owners, today\u2019s ruling means one thing is now crystal clear: the state can\u2019t simply wave a wand and declare almost every privately-owned business off limits to lawful carry holders.<\/p>\n\n\n\n<p>At least not without a fight.<\/p>\n\n\n\n<p class=\"has-text-align-left\" style=\"font-size:24px\"><strong><em>*** <a href=\"https:\/\/gunsamerica.com\"
