{"id":236775,"date":"2026-05-04T01:46:00","date_gmt":"2026-05-04T06:46:00","guid":{"rendered":"https:\/\/gunsamerica.com\/digest\/?p=236775"},"modified":"2026-05-05T13:51:13","modified_gmt":"2026-05-05T18:51:13","slug":"goa-breaks-down-atfs-34-new-rules","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/goa-breaks-down-atfs-34-new-rules\/","title":{"rendered":"GOA Breaks Down ATF\u2019s 34 New Rules"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p>The ATF just rolled out one of the biggest regulatory <a href=\"https:\/\/gunsamerica.com\/digest\/atf-rule-changes-2026\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"goa-breaks-down-atfs-34-new-rules\" title=\"GOA Breaks Down ATF\u2019s 34 New Rules\">shakeups<\/a> in years: 34 separate rule changes billed as a \u201cnew era of reform.\u201d  But according to Gun Owners of America (<a href=\"https:\/\/www.gunowners.org\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"goa-breaks-down-atfs-34-new-rules\" title=\"GOA Breaks Down ATF\u2019s 34 New Rules\">GOA<\/a>), gun owners shouldn\u2019t celebrate just yet.<\/p>\n\n\n\n<p>\u201cThere\u2019s some good and then there\u2019s a lot that we\u2019re skeptical about,\u201d GOA said in its initial breakdown of the package.<\/p>\n\n\n\n<p>After years of aggressive rulemaking under the Biden administration, this new package is being framed as a reset. GOA agrees, partially. But GOA isn\u2019t buying the victory lap.<\/p>\n\n\n\n<p>They argue rescinding rules without court settlements could actually weaken long-term protections. By pulling rules back administratively, the DOJ may be trying to moot ongoing lawsuits, preventing binding court decisions that would stop future administrations from bringing the same rules back.<\/p>\n\n\n\n<p>In other words: today\u2019s rollback could be tomorrow\u2019s reinstatement.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-modernization-convenience-or-a-bigger-registry\">Modernization: Convenience\u2026 or a Bigger Registry?<\/h2>\n\n\n\n<p>Several rules aim to \u201cmodernize\u201d the system:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Digital 4473 forms<\/li>\n\n\n\n<li>Electronic recordkeeping for FFLs<\/li>\n\n\n\n<li>Defined retention periods for firearm records<\/li>\n<\/ul>\n\n\n\n<p>Some of that sounds reasonable: less paperwork, fewer errors.  But GOA sees a major red flag.<\/p>\n\n\n\n<p>Digitizing records feeds directly into what they describe as an \u201cillegal registry\u201d of gun owners maintained by the ATF.  Even more concerning: proposed retention timelines could stretch up to 60 years total when combined with ATF storage.  That\u2019s not reform, GOA argues that\u2019s expansion.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-reduced-burden-real-wins-for-gun-owners\">Reduced Burden: Real Wins for Gun Owners<\/h2>\n\n\n\n<p>This is where GOA gives credit.  Several changes could meaningfully reduce friction for lawful gun owners:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>No more ATF approval for short-term interstate travel with NFA items<\/li>\n\n\n\n<li>Spousal co-registration for <a href=\"https:\/\/gunsamerica.com\/digest\/legally-buy-machine-guns-silencers-short-barrels-understand-the-nfa\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"goa-breaks-down-atfs-34-new-rules\" title=\"GOA Breaks Down ATF\u2019s 34 New Rules\"  data-wpil-monitor-id=\"4541\">NFA firearms<\/a><\/li>\n\n\n\n<li>Removal of CLEO notification requirements<\/li>\n\n\n\n<li>Stronger protections under FOPA for interstate travel<\/li>\n<\/ul>\n\n\n\n<p>These are practical improvements that gun owners will actually feel.  GOA rates many of these as clear positives.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-clarify-category-the-devil-s-in-the-details\">&#8220;Clarify\u201d Category: The Devil\u2019s in the Details<\/h2>\n\n\n\n<p>The largest group of rules falls under \u201cclarification,\u201d and that\u2019s where things get murky.<\/p>\n\n\n\n<p>Key areas include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Redefining \u201cwillful\u201d violations (used to revoke FFLs)<\/li>\n\n\n\n<li>Expanding or clarifying <a href=\"https:\/\/gunsamerica.com\/digest\/egregious-straw-purchase-plea-deal-a-slap-in-firearm-industry-face\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"goa-breaks-down-atfs-34-new-rules\" title=\"GOA Breaks Down ATF\u2019s 34 New Rules\"  data-wpil-monitor-id=\"4538\">straw purchase<\/a> definitions<\/li>\n\n\n\n<li>Adjusting mental health prohibitions<\/li>\n\n\n\n<li>Tweaking background check exemptions<\/li>\n<\/ul>\n\n\n\n<p>GOA\u2019s take? Proceed with caution.  Without final rule text, these \u201cclarifications\u201d could either protect <a href=\"https:\/\/gunsamerica.com\/digest\/duck-hunting-in-september\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"goa-breaks-down-atfs-34-new-rules\" title=\"GOA Breaks Down ATF\u2019s 34 New Rules\"  data-wpil-monitor-id=\"4540\">gun owners or quietly expand enforcement authority<\/a>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-alignment-amp-imports-more-guns-coming-in\">Alignment &amp; Imports: More Guns Coming In?<\/h2>\n\n\n\n<p>Some rules could open the door to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Easier firearm imports<\/li>\n\n\n\n<li>Relaxed restrictions on certain parts and training ammo<\/li>\n\n\n\n<li>Updated international sourcing rules<\/li>\n<\/ul>\n\n\n\n<p>That\u2019s good news for availability and pricing.  But again, GOA is waiting for final language before calling it a win.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-big-picture-reform-but-not-a-revolution\">The Big Picture: Reform\u2026 But Not a Revolution<\/h2>\n\n\n\n<p>GOA\u2019s bottom line is blunt:<\/p>\n\n\n\n<p>\u201cThis is a small step in the right direction\u2026 but very few changes that gun owners can be excited about.\u201d<\/p>\n\n\n\n<p>The organization argues the reforms don\u2019t go far enough.  And more importantly, they\u2019re not permanent.<\/p>\n\n\n\n<p>Without court victories or legislative changes, everything here could be reversed by the next anti-gun administration.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-happens-next\">What Happens Next?<\/h2>\n\n\n\n<p>GOA says its legal team is already preparing to review every rule as it hits the Federal Register, and challenge anything that infringes on Second Amendment rights.<\/p>\n\n\n\n<p>At the same time, they\u2019re pushing for bigger moves:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ending federal firearm registries<\/li>\n\n\n\n<li>Rolling back the NFA<\/li>\n\n\n\n<li>Securing court rulings that lock in protections<\/li>\n<\/ul>\n\n\n\n<p>Because in their view, real reform doesn\u2019t come from agency rulemaking.
