According to the DOJ, that includes AR-15-style firearms.  By far the most popular <a href=\"https:\/\/gunsamerica.com\/digest\/henry-americas-250th-anniversary-heirloom\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-sues-denver-assault-weapons-ban\" title=\"DOJ Sues Denver Over AR-15 Ban\" data-wpil-monitor-id=\"4536\">rifle platform in America<\/a>, with tens of millions in circulation.<\/p>\n\n\n\n<p>That \u201ccommon use\u201d standard matters.<\/p>\n\n\n\n<p>The DOJ is leaning heavily on <em>District of Columbia v. Heller<\/em>, the 2008 Supreme <a href=\"https:\/\/gunsamerica.com\/digest\/saf-sues-connecticut-mag-ban\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-sues-denver-assault-weapons-ban\" title=\"DOJ Sues Denver Over AR-15 Ban\" data-wpil-monitor-id=\"4535\">Court decision that held the Second Amendment<\/a> protects firearms \u201cin common use for lawful purposes.\u201d<\/p>\n\n\n\n<p>Their argument is simple: you can\u2019t ban what Americans widely own and lawfully use.<\/p>\n\n\n\n<div class=\"wp-block-yoast-seo-table-of-contents yoast-table-of-contents\"><h2>Table of contents<\/h2><ul><li><a href=\"#h-doj-draws-a-line\" class=\"clickTracking\" campaign=\"doj-sues-denver-assault-weapons-ban\" title=\"DOJ Sues Denver Over AR-15 Ban\" data-level=\"2\">DOJ Draws a Line<\/a><\/li><li><a href=\"#h-washington-gun-law-exactly-what-we-hoped-for\" class=\"clickTracking\" campaign=\"doj-sues-denver-assault-weapons-ban\" title=\"DOJ Sues Denver Over AR-15 Ban\" data-level=\"2\">Washington Gun Law: \u201cExactly What We Hoped For\u201d<\/a><\/li><li><a href=\"#h-what-happens-next\" class=\"clickTracking\" campaign=\"doj-sues-denver-assault-weapons-ban\" title=\"DOJ Sues Denver Over AR-15 Ban\" data-level=\"2\">What Happens Next<\/a><\/li><li><a href=\"#h-final-take\" class=\"clickTracking\" campaign=\"doj-sues-denver-assault-weapons-ban\" title=\"DOJ Sues Denver Over AR-15 Ban\" data-level=\"2\">Final Take<\/a><\/li><\/ul><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-doj-draws-a-line\">DOJ Draws a Line<\/h2>\n\n\n\n<p>The lawsuit comes out of the DOJ\u2019s Civil Rights Division, which now includes a dedicated Second Amendment enforcement section.<\/p>\n\n\n\n<p>Assistant Attorney General Harmeet Dhillon made the mission clear:<\/p>\n\n\n\n<p>\u201cLaw-abiding Americans\u2026 should not have to live under threat of criminal sanction just for exercising their Second Amendment right.\u201d<\/p>\n\n\n\n<p>Before filing suit, the DOJ gave Denver an off-ramp: drop enforcement, acknowledge the law is unconstitutional, and avoid litigation.<\/p>\n\n\n\n<p>Denver declined.<\/p>\n\n\n\n<p>Instead, city officials fired <a href=\"https:\/\/www.9news.com\/article\/news\/local\/next\/next-with-kyle-clark\/denver-state-trump-doj-gun-laws\/73-0e844124-32b2-4e75-8354-cc30ebda8d5f\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-sues-denver-assault-weapons-ban\" title=\"DOJ Sues Denver Over AR-15 Ban\">back<\/a>, calling the DOJ\u2019s position \u201cbaseless\u201d and defending the ban as a public safety measure that has been in place for decades.<\/p>\n\n\n\n<p>That sets up a direct constitutional clash.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Denver mayor responds to DOJ demands on assault weapon law\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/4RPNgE9ZexQ?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-washington-gun-law-exactly-what-we-hoped-for\">Washington Gun Law: \u201cExactly What We Hoped For\u201d<\/h2>\n\n\n\n<p><a href=\"https:\/\/gunsamerica.com\/digest\/d-c-gets-the-smackdown-it-deserves\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-sues-denver-assault-weapons-ban\" title=\"DOJ Sues Denver Over AR-15 Ban\" data-wpil-monitor-id=\"4533\">Washington Gun Law<\/a> President William Kirk didn\u2019t hold back on what this means.<\/p>\n\n\n\n<p>\u201cThis is the exact thing we had hoped for,\u201d Kirk said, pointing to a DOJ now actively working to not just defend\u2014but expand\u2014Second Amendment protections.<\/p>\n\n\n\n<p>Kirk walked through the legal backbone of the DOJ\u2019s argument, noting that Denver\u2019s ordinance criminalizes possession of AR-15-style <a href=\"https:\/\/gunsamerica.com\/digest\/sw-mp15-sport-ii\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-sues-denver-assault-weapons-ban\" title=\"DOJ Sues Denver Over AR-15 Ban\" data-wpil-monitor-id=\"4534\">rifles<\/a>: firearms owned by \u201ctens of millions\u201d of Americans and used for lawful purposes every day.<\/p>\n\n\n\n<p>In his view, that makes the constitutional issue straightforward.<\/p>\n\n\n\n<p>\u201cThe city has banned an arm in common use\u2026 therefore, the ordinance violates the Second Amendment.\u201d<\/p>\n\n\n\n<p>Denver, however, is leaning on favorable rulings from multiple federal circuits that have upheld similar bans, at least for now.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-happens-next\">What Happens Next<\/h2>\n\n\n\n<p>This case is shaping up to be more than just a local dispute.<\/p>\n\n\n\n<p>It\u2019s a test case.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Can cities continue enforcing \u201cassault weapons\u201d bans post-<em>Bruen<\/em>?<\/li>\n\n\n\n<li>Does \u201ccommon use\u201d finally get a hard line from the courts?<\/li>\n\n\n\n<li>And is the DOJ now fully committed to taking these fights nationwide?<\/li>\n<\/ul>\n\n\n\n<p>Denver has already signaled it won\u2019t back down.  That likely means this case is headed for a prolonged legal battle and potentially another major Second Amendment ruling.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-final-take\">Final Take<\/h2>\n\n\n\n<p>For years, most of these fights were left to private groups and state-level challenges.  Now the federal government is stepping in directly.  That changes the game.<\/p>\n\n\n\n<p>Whether this ends in a district court or makes its way toward the Supreme Court, one thing is clear: The fight over so-called \u201cassault weapons\u201d bans
