And it\u2019s a big one.<\/p>\n\n\n\n<p>According to <a href=\"https:\/\/www.gunowners.org\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-drops-appeal-atf-engaged-in-business-fight\" title=\"DOJ Drops Appeal in Biden's ATF 'Engaged in the Business' Rule\">Gun Owners of America <\/a>and the Gun Owners Foundation, the Department of Justice has officially moved to dismiss its appeal in the ongoing case challenging the ATF\u2019s \u201cEngaged in the Business\u201d rule.<\/p>\n\n\n\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">This is welcome news from DOJ, and helps fulfill President Trump&#39;s campaign promise to get rid of Biden&#39;s universal background checks.<br \/><br \/>GOA\u2019s preliminary injunction now returns to the district court, where we hope Biden\u2019s evil rule will be vacated once and for all. \ud83d\udc4f\ud83d\udc4f\ud83d\udc4f <a href=\"https:\/\/t.co\/2KSzYxUR96\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-drops-appeal-atf-engaged-in-business-fight\" title=\"DOJ Drops Appeal in Biden's ATF 'Engaged in the Business' Rule\">https:\/\/t.co\/2KSzYxUR96<\/a><\/p>&mdash; Gun Owners of America (@GunOwners) <a href=\"https:\/\/twitter.com\/GunOwners\/status\/2044830643490562479?ref_src=twsrc%5Etfw\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-drops-appeal-atf-engaged-in-business-fight\" title=\"DOJ Drops Appeal in Biden's ATF 'Engaged in the Business' Rule\">April 16, 2026<\/a><\/blockquote> <script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n\n\n\n<p>That rule, pushed during the Biden administration, aimed to significantly expand who qualifies as a firearm \u201cdealer,\u201d and by extension, who would be <a href=\"https:\/\/gunsamerica.com\/digest\/sheriffs-oppose-california-lt-gov-s-attempt-to-confiscate-magazines-ammo\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-drops-appeal-atf-engaged-in-business-fight\" title=\"DOJ Drops Appeal in Biden's ATF 'Engaged in the Business' Rule\" data-wpil-monitor-id=\"4140\">required to obtain a federal license and run background checks<\/a>.<\/p>\n\n\n\n<p>Critics argued it went much further than that.<\/p>\n\n\n\n<p>Under the rule, even a single private firearm sale could potentially trigger federal scrutiny, raising serious concerns about how broadly the ATF could interpret \u201cengaged in the business.\u201d<\/p>\n\n\n\n<p>That\u2019s what led to the lawsuit.<\/p>\n\n\n\n<p>GOA and GOF, alongside attorneys general from Texas, Louisiana, Utah, and Mississippi, <a href=\"https:\/\/gunsamerica.com\/digest\/rmgo-secure-preliminary-injunction-against-colorado-age-based-gun-ban\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-drops-appeal-atf-engaged-in-business-fight\" title=\"DOJ Drops Appeal in Biden's ATF 'Engaged in the Business' Rule\" data-wpil-monitor-id=\"4141\">secured a preliminary injunction<\/a> blocking enforcement of the rule, at least temporarily.<\/p>\n\n\n\n<p>Now, with DOJ stepping back and asking the <a href=\"https:\/\/gunsamerica.com\/digest\/fifth-circuit-smacks-down-age-based-handgun-ban\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-drops-appeal-atf-engaged-in-business-fight\" title=\"DOJ Drops Appeal in Biden's ATF 'Engaged in the Business' Rule\" data-wpil-monitor-id=\"4137\">Fifth Circuit<\/a> to drop the appeal, that injunction stays in place.  And the case heads back to district court. But it\u2019s no longer being actively defended at the appellate level, and enforcement remains blocked for now.<\/p>\n\n\n\n<p>From a policy standpoint?
