Not by choice, but by court order.<\/p>\n\n\n\n<p>In a move that\u2019s being called a major legal victory, Gun Owners of America (<a href=\"https:\/\/www.gunowners.org\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"ny-social-media-gun-permit-requirement\" title=\"NY Backs Off Social Media Gun Permit Requirement\">GOA<\/a>) and the Gun Owners Foundation (<a href=\"https:\/\/foundation.gunowners.org\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"ny-social-media-gun-permit-requirement\" title=\"NY Backs Off Social Media Gun Permit Requirement\">GOF<\/a>) forced the state to abandon one of the more controversial pieces of its post-<em>Bruen<\/em> gun control scheme: the social media background check for concealed carry permits.<\/p>\n\n\n\n<p>Yeah\u2026 that one.<\/p>\n\n\n\n<p>The requirement that law-abiding citizens hand over three years of their social media history just to exercise a constitutional right.  That provision is now dead in the water.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Governor Hochul enacts ten new gun laws\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/5gTEyoGiLTU?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>According to the settlement in <em>Antonyuk v. James<\/em>, New York officials have agreed to a permanent injunction blocking enforcement of the rule. That means no more fishing expeditions through your Instagram, Facebook, or whatever you said about politics three summers ago.<\/p>\n\n\n\n<p>And it gets better.<\/p>\n\n\n\n<p>The New York State Police are now required to scrub that requirement from the official carry permit application entirely. No vague wording. No backdoor requests. It\u2019s out.  Gone.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-silencer-form-4s-exploded-after-the-tax-hit-0\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/silencer-form-4-applications-zero-tax-surge\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"ny-social-media-gun-permit-requirement\" title=\"NY Backs Off Social Media Gun Permit Requirement\">Silencer Form 4s Exploded After the Tax Hit $0<\/a><\/h2>\n\n\n\n<p>As GOA\u2019s Erich Pratt put it, the entire Concealed Carry Improvement Act has always been less about \u201cimproving\u201d anything and more about making it harder for regular people to carry.<\/p>\n\n\n\n<p>Hard to argue with that when the state was literally asking for your tweets as part of the process.<\/p>\n\n\n\n<p>GOF\u2019s John Velleco didn\u2019t mince words either, calling the requirement a \u201cblatant invasion of privacy\u201d and pointing out the obvious.  Your right to self-defense doesn\u2019t come with a requirement to hand over your digital life.<\/p>\n\n\n\n<p>And that\u2019s really the bigger picture here. This wasn\u2019t just a Second Amendment issue.  It was a First Amendment issue.  A Fourth Amendment issue. Tomorrow it\u2019s\u2026 what, exactly?  The courts didn\u2019t seem interested in finding out.  Now, before anyone starts celebrating like this whole thing is over.  It&#8217;s not. <\/p>\n\n\n\n<p>This lawsuit is still very much alive, and GOA is continuing to go after other parts of New York\u2019s carry law, including the ever-expanding list of \u201csensitive locations\u201d where carrying is banned.<\/p>\n\n\n\n<p>We\u2019re talking parks, zoos, and places that serve alcohol.  Basically, the kind of places people actually go.<\/p>\n\n\n\n<p>So yeah, this is a win.  A real one.  But it\u2019s one battle in a much bigger fight over what \u201cshall not be infringed\u201d actually means in 2026.
