Gets the Smackdown It Deserves\">Washington Gun Law\u2019<\/a>s William Kirk, the latest development in <em><a href=\"https:\/\/www.dccourts.gov\/sites\/default\/files\/2026-03\/Benson%20v%20US%20et%20al%2023-CV-0541%20FINAL.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"d-c-gets-the-smackdown-it-deserves\" title=\"D.C. Gets the Smackdown It Deserves\">Benson v. United States<\/a><\/em> is another rough day for the District.<\/p>\n\n\n\n<p>We\u2019re talking full-on denial across the board.<\/p>\n\n\n\n<p>The D.C. Attorney General\u2019s office came in hot, asking the court to fast-track everything, skip key steps, and basically treat this case like a five-alarm emergency.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"D.C. Gets the Smackdown It Deserves\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/DIxOtHhAbK4?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>The court\u2019s response?  \u201cNo.\u201d<\/p>\n\n\n\n<p>Not once. Not twice. But repeatedly. Requests to bypass normal procedure? Denied.  Push for immediate en banc review? Denied. Demand to rush the opposing side? Also denied.<\/p>\n\n\n\n<p>In other words, the court wasn\u2019t buying the panic.  And that\u2019s where things get interesting.<\/p>\n\n\n\n<p>Because one judge, in a concurring <a href=\"https:\/\/gunsamerica.com\/digest\/kids-and-guns-take-your-children-hunting\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"d-c-gets-the-smackdown-it-deserves\" title=\"D.C. Gets the Smackdown It Deserves\" data-wpil-monitor-id=\"3986\">opinion highlighted by Washington Gun<\/a> Law, essentially called out the District for what it looks like: manufacturing a crisis.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-breek-omni-buster-review-the-suppressed-ar-fix\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/breek-omni-buster-review-suppressed-ar-fix\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"d-c-gets-the-smackdown-it-deserves\" title=\"D.C. Gets the Smackdown It Deserves\">Breek Omni-Buster Review: The Suppressed AR Fix<\/a><\/h2>\n\n\n\n<p>According to the court, the supposed \u201cchaos\u201d from striking down D.C.\u2019s <a href=\"https:\/\/gunsamerica.com\/digest\/27-states-join-fight-against-magazine-ban-at-scotus\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"d-c-gets-the-smackdown-it-deserves\" title=\"D.C. Gets the Smackdown It Deserves\" data-wpil-monitor-id=\"3987\">magazine ban<\/a> doesn\u2019t really exist at least not in the real world.<\/p>\n\n\n\n<p>Here\u2019s the kicker.  The federal government had already stopped prosecuting violations of the 11+ <a href=\"https:\/\/gunsamerica.com\/digest\/nationwide-magazine-ban\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"d-c-gets-the-smackdown-it-deserves\" title=\"D.C. Gets the Smackdown It Deserves\" data-wpil-monitor-id=\"3988\">round magazine ban<\/a> more than six months ago.<\/p>\n\n\n\n<p>So the argument that overturning it would suddenly unleash mayhem?  Yeah\u2026 the court wasn\u2019t impressed.<\/p>\n\n\n\n<p>Even better, D.C. tried to lean on the classic \u201cfloodgates\u201d argument.  You know, the idea that once a restriction is lifted, the streets will instantly fill with dangerous items.<\/p>\n\n\n\n<p>The judge\u2019s response boiled down to: show me the evidence.  Spoiler alert: there wasn\u2019t any.<\/p>\n\n\n\n<p>In fact, the court pointed out that nearly half of <a href=\"https:\/\/gunsamerica.com\/digest\/chiappa-firearms-x-caliber-finding-ammo-is-easier-than-pulling-a-sword-from-a-stone-shot-show-2014\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"d-c-gets-the-smackdown-it-deserves\" title=\"D.C. Gets the Smackdown It Deserves\" data-wpil-monitor-id=\"3985\">firearm prosecutions in D.C. already involved magazines<\/a> over the limit, even <em>with<\/em> the ban in place.<\/p>\n\n\n\n<p>So if the law was supposed to stop that\u2026 it wasn\u2019t doing a great job.<\/p>\n\n\n\n<p>Shocking, right?  But the real gut punch came when the court highlighted something D.C. didn\u2019t want to talk about.<\/p>\n\n\n\n<p>The reason certain charges couldn\u2019t be enforced wasn\u2019t because the law was struck down.  It\u2019s because the District refused to allow people to legally register firearms that complied with the rules they created.<\/p>\n\n\n\n<p>Read that again.  The system broke\u2026 because the system refused to function. Instead, the District doubled down, pushing urgency, panic, and yes, a little legal drama.<\/p>\n\n\n\n<p>Which brings us to maybe the most quietly brutal moment in the ruling.  D.C. asked the court to force the opposing side to respond faster than usual, despite taking nearly the full time themselves to file their own paperwork.<\/p>\n\n\n\n<p>The court essentially called that out as\u2026 let\u2019s say, bold.  Or as Kirk might put it, a bit of \u201cchutzpah.\u201d  So where does this leave things?<\/p>\n\n\n\n<p>The bigger fight, whether the <a href=\"https:\/\/gunsamerica.com\/digest\/saf-seeks-full-court-rehearing-in-sensitive-places-case\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"d-c-gets-the-smackdown-it-deserves\" title=\"D.C. Gets the Smackdown It Deserves\" data-wpil-monitor-id=\"3989\">full court will take up the case<\/a>, is still pending.  But if that doesn\u2019t happen, D.C. has two options:  Live with the ruling\u2026 or take it upstairs to the U.S. Supreme Court.<\/p>\n\n\n\n<p>And if you\u2019ve been watching this unfold, you can probably guess which direction they\u2019re leaning.
