In its <a href=\"https:\/\/www.scribd.com\/document\/1014499997\/ATF-Says-Brace-Rule-Case-Is-Moot-Warns-Some-Braced-Pistols-Still-Face-NFA-Enforcement\" target=\"_blank\" class=\"clickTracking\" campaign=\"grieve-pistol-braces-felonies-again\" title=\"ATF: Pistol Braces Are Felonies AGAIN?\">filing<\/a>, the ATF acknowledged that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>It continues enforcing federal law on short-barreled <a href=\"https:\/\/gunsamerica.com\/digest\/silencerco-omega-36m-centerfire-suppressor\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"grieve-pistol-braces-felonies-again\" title=\"ATF: Pistol Braces Are Felonies AGAIN?\" data-wpil-monitor-id=\"3935\">rifles against some braced pistols<\/a>.<\/p>\n<\/blockquote>\n\n\n\n<p>Translation? Today, that number is likely much higher.<\/p>\n\n\n\n<p>And compliance with the 2023 rule?  Roughly 6\u20138%.  Meaning millions of Americans could be exposed if enforcement ramps back up.<\/p>\n\n\n\n<p>Grieve doesn\u2019t sugarcoat it.  This is essentially the ATF saying:<\/p>\n\n\n\n<p>\u201cYou may have won the battle in court\u2026 but we\u2019re still playing the game.\u201d<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-legal-chess-match\">The Legal Chess Match<\/h2>\n\n\n\n<p>Part of the issue comes down to how lawsuits are structured.  The GOA case focused on the Administrative Procedures Act (APA).  Basically arguing the ATF\u2019s rulemaking was flawed.<\/p>\n\n\n\n<p>Now that the rule is gone, the ATF claims that challenge is moot\u2026 and doesn\u2019t stop them from enforcing their interpretation of existing law.<\/p>\n\n\n\n<p>It\u2019s legal chess.<\/p>\n\n\n\n<p>And right now, the ATF is trying to shift the board.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-bottom-line\">Bottom Line<\/h2>\n\n\n\n<p>Pistol braces aren\u2019t officially \u201cbanned\u201d again.  But they\u2019re also not clearly in the safe zone either.<\/p>\n\n\n\n<p>And that uncertainty is where things get dangerous.<\/p>\n\n\n\n<p>Because when enforcement comes down to interpretation, it\u2019s not just about what the law says.  It\u2019s about how it\u2019s applied.  And according to this filing, the ATF hasn\u2019t backed off one bit.<\/p>\n\n\n\n<p>For <a
