And it doesn\u2019t pull punches.<\/p>\n\n\n\n<p>In <em><a href=\"https:\/\/saf.org\/cases\/schmidt-v-paris\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"pa-gun-case-warrantless-inspections\" title=\"PA Gun Case Targets Warrantless Inspections\">Schmidt v. Paris<\/a><\/em>, gun owners and dealers are challenging a web of state laws, regulations, and policies they say cross a constitutional line. At the center of the fight: warrantless inspections, vague licensing standards, and what plaintiffs argue is an unelected agency making up the rules as it goes.<\/p>\n\n\n\n<p>The latest <a href=\"https:\/\/saf.org\/wp-content\/uploads\/2026\/03\/Schmidt-reply-brief-3.17.26.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"pa-gun-case-warrantless-inspections\" title=\"PA Gun Case Targets Warrantless Inspections\">brief<\/a> doubles down on a simple claim: Pennsylvania never authorized this.<\/p>\n\n\n\n<p>According to the filing, the Uniform <a href=\"https:\/\/gunsamerica.com\/digest\/bolt-action-remington-rifle-scope-starting-399-full-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"pa-gun-case-warrantless-inspections\" title=\"PA Gun Case Targets Warrantless Inspections\" data-wpil-monitor-id=\"3924\">Firearms Act does not include any statutory authority<\/a> for inspections of firearm dealers, let alone warrantless ones. Instead, the Pennsylvania State Police created that power through regulation. The plaintiffs argue that\u2019s not just overreach.  It\u2019s unconstitutional. <\/p>\n\n\n\n<p>They take it a step further, arguing the agency didn\u2019t just interpret the law.  It effectively wrote new law. And under Pennsylvania\u2019s Constitution, that\u2019s supposed to be the legislature\u2019s job.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-the-s-amp-w-940-vs-lcr-9mm-revolvers-slugfest\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/the-sw-940-vs-lcr-9mm-revolvers-slugfest\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"pa-gun-case-warrantless-inspections\" title=\"PA Gun Case Targets Warrantless Inspections\">The S&amp;W 940 vs LCR \u2013 9mm Revolvers Slugfest<\/a><\/h2>\n\n\n\n<p>Even more controversial is the inspection policy itself.<\/p>\n\n\n\n<p>Plaintiffs say dealers are being forced to submit to warrantless searches, turn over records, and answer questions all without probable cause. Refuse, and you risk losing your license. The brief frames that as a textbook violation of due process and an unconstitutional condition: give up your rights, or give up your business.<\/p>\n\n\n\n<p>And outside groups are backing that argument hard.<\/p>\n\n\n\n<p>\u201cSelling guns in accordance with state and federal law does not require that a seller waive their other constitutional rights,\u201d said <a href=\"https:\/\/gunsamerica.com\/digest\/register-2026-gun-rights-policy-conference\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"pa-gun-case-warrantless-inspections\" title=\"PA Gun Case Targets Warrantless Inspections\" data-wpil-monitor-id=\"3925\">SAF<\/a> Director of Legal Operations Bill Sack. \u201cWarrantless searches of these businesses are unlawful, and particularly egregious when you consider that many FFL dealers run their business out of their private residence.\u201d<\/p>\n\n\n\n<p>The filing also leans heavily on history and recent Supreme Court precedent.<\/p>\n\n\n\n<p>While the government tries to justify inspections under the \u201cclosely regulated industry\u201d theory, the brief argues that kind of power didn\u2019t exist at the Founding. Under <em>Bruen<\/em>, that\u2019s a problem. If there\u2019s no historical tradition, the regulation doesn\u2019t stand.<\/p>\n\n\n\n<p>The brief also hammers on the lack of clear standards in the law itself. Terms like \u201creputable applicant\u201d and \u201ccause\u201d to revoke a license aren\u2019t defined, giving regulators wide discretion and, according to the plaintiffs, opening the door to arbitrary enforcement.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/gunsamerica.com\/digest\/interview-with-alan-gottlieb-second-amendment-foundation\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"pa-gun-case-warrantless-inspections\" title=\"PA Gun Case Targets Warrantless Inspections\" data-wpil-monitor-id=\"3926\">Second Amendment Foundation<\/a> sees a bigger issue at play.<\/p>\n\n\n\n<p>\u201cThese regulations are <a href=\"https:\/\/gunsamerica.com\/digest\/the-five-biggest-threats-to-the-second-amendment-that-have-nothing-to-do-with-gun-control\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"pa-gun-case-warrantless-inspections\" title=\"PA Gun Case Targets Warrantless Inspections\" data-wpil-monitor-id=\"3928\">nothing more than an attempt to thwart the Second Amendment<\/a> rights of Pennsylvanians,\u201d said SAF founder Alan M. Gottlieb. \u201cWhether it\u2019s in Pennsylvania\u2014or any other state\u2014Americans are allowed to exercise their full constitutional rights without fear of government agencies enforcing frivolous laws.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-colt-s-blued-python-is-back-and-it-still-bites\">SEE ALSO: <a powers without legislative approval, the brief warns, it sets a precedent for expanding that authority across other industries and potentially into private homes.<\/p>\n\n\n\n<p>Bottom line: this case isn\u2019t just about firearms.<\/p>\n\n\n\n<p>It\u2019s about who makes the rules and whether constitutional protections still hold when agencies decide to push the limits.<\/p>\n\n\n\n<p>Now
