The law that makes it illegal for civilians to possess machine guns manufactured after May 19, 1986.<\/p>\n\n\n\n<p>The case, <em>Temple Gun Club v. Bondi<\/em>, was filed in the U.S. District Court for the Northern District of Texas.  It argues that Congress overstepped its constitutional authority when it enacted the restriction.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"HUGE LAWSUIT | Is This The End of the 1986 Machinegun Ban?\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/amZa5G8prrg?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>The plaintiffs include the Temple Gun Club, a Texas nonprofit with more than 1,000 members, along with three individual members: a U.S. Army veteran, a licensed gunsmith, and a longtime firearms enthusiast. <\/p>\n\n\n\n<p>Their argument is straightforward: the Constitution gives Congress limited powers, and banning the mere possession of a firearm, without any connection to interstate commerce, goes beyond those powers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-this-tiny-380-might-be-california-s-best-carry-gun\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/ruger-lcp-max-review-california\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-lawsuit-federal-machine-gun-ban\" title=\"Texas Gun Club Takes Aim at Federal Machine Gun Ban\">This Tiny .380 Might Be California\u2019s Best Carry Gun<\/a><\/h2>\n\n\n\n<p>The lawsuit targets the so-called <a href=\"https:\/\/gunsamerica.com\/digest\/four-anti-gun-bills-race-toward-vote-in-pennsylvania\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-lawsuit-federal-machine-gun-ban\" title=\"Texas Gun Club Takes Aim at Federal Machine Gun Ban\" data-wpil-monitor-id=\"3888\">Hughes Amendment<\/a>, which was added to the Firearm Owners\u2019 Protection Act in 1986. That amendment froze the civilian machine gun registry.  Allowing private citizens to own only machine guns registered before the cutoff date.<\/p>\n\n\n\n<p>Today, that means legally transferable machine guns are limited to a finite pool.  Often costing tens of thousands of dollars on the collector market.<\/p>\n\n\n\n<p>The plaintiffs say the federal government never had the authority to impose that ban in the first place.<\/p>\n\n\n\n<p>According to the complaint, \u00a7 922(o) criminalizes the possession of post-1986 machine <a href=\"https:\/\/gunsamerica.com\/digest\/ak-47-hog-blaster\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-lawsuit-federal-machine-gun-ban\" title=\"Texas Gun Club Takes Aim at Federal Machine Gun Ban\" data-wpil-monitor-id=\"3890\">guns even when the firearm<\/a> has no connection to interstate commerce, which is the constitutional power Congress typically relies on when regulating firearms. <\/p>\n\n\n\n<p>The lawsuit also asks courts to revisit a key precedent: <em><a href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/ca8\/19-1737\/19-1737-2020-07-24.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-lawsuit-federal-machine-gun-ban\" title=\"Texas Gun Club Takes Aim at Federal Machine Gun Ban\">United States v. Knutson<\/a><\/em> (1997). In that case, the Fifth Circuit upheld the <a href=\"https:\/\/gunsamerica.com\/digest\/fed-court-strikes-down-machine-gun-ban\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-lawsuit-federal-machine-gun-ban\" title=\"Texas Gun Club Takes Aim at Federal Machine Gun Ban\" data-wpil-monitor-id=\"3892\">machine gun ban<\/a> under the Commerce Clause.<\/p>\n\n\n\n<p>But the plaintiffs argue that recent legal developments, along with skepticism expressed by several Fifth Circuit judges, mean the precedent deserves a fresh look.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-iron-sights-vs-red-dots-the-case-you-forgot\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/iron-sights-vs-red-dots-handguns\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-lawsuit-federal-machine-gun-ban\" title=\"Texas Gun Club Takes Aim at Federal Machine Gun Ban\">Iron Sights vs Red Dots: The Case You Forgot<\/a><\/h2>\n\n\n\n<p>Among the individual plaintiffs is Jeffrey Howard, a retired U.S. Army Sergeant Major who served for 26 years and now leads the Temple Gun Club. The complaint says he and the other plaintiffs are law-abiding gun owners who would acquire or manufacture post-1986 machine guns if the law were struck down. <\/p>\n\n\n\n<p>The lawsuit doesn\u2019t challenge the broader National Firearms Act itself. Even if the ban were overturned, machine guns would still be subject to the NFA\u2019s strict registration and tax requirements.<\/p>\n\n\n\n<p>Instead, the case zeroes in on a narrower question: whether Congress had the constitutional <a href=\"https:\/\/gunsamerica.com\/digest\/duck-hunting-in-september\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-lawsuit-federal-machine-gun-ban\" title=\"Texas Gun Club Takes Aim at Federal Machine Gun Ban\" data-wpil-monitor-id=\"3889\">authority to outlaw the possession of newly manufactured machine guns<\/a> altogether.<\/p>\n\n\n\n<p>\u201cIt\u2019s never too late to claw back liberties that the federal government has stolen,\u201d TPPF Attorney&nbsp;Laura Beth Latimer&nbsp;said in the press release. \u201cThe Commerce Clause does not give Congress unlimited power to regulate simple possession of anything. This case is a first step toward reclaiming rights that Congress never had the power to take away.\u201d<\/p>\n\n\n\n<p>If the plaintiffs ultimately succeed, it could reopen one of the most controversial chapters in federal gun law. And potentially allow civilians to legally register <a href=\"https:\/\/gunsamerica.com\/digest\/sig-sauer-selected-by-u-s-army-for-next-generation-weapons-with-new-ammunition-technology-lightweight-machine-gun-rifle-and-suppressors\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-lawsuit-federal-machine-gun-ban\" title=\"Texas Gun Club Takes Aim at Federal Machine Gun Ban\" data-wpil-monitor-id=\"3891\">new machine guns<\/a> for the first time in nearly 40 years.<\/p>\n\n\n\n<p>For now, the case is just getting started. But given the current legal climate surrounding gun rights, it\u2019s one that we&#8217;ll be watching closely.
