No, it\u2019s not the endgame.  At least not yet.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"D.C. Strikes Down Its Magazine Ban.  How Big of a Deal Is It, Really?\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/qblHlqsAsSg?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>According to <a href=\"https:\/\/www.washingtongunlaw.com\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"dc-magazine-ban-crushed\" title=\"DC Magazine Ban Crushed!\">Washington Gun Law<\/a>\u2019s breakdown, the case, <a href=\"https:\/\/www.dccourts.gov\/sites\/default\/files\/2026-03\/Benson%20v%20US%20et%20al%2023-CV-0541%20FINAL.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"dc-magazine-ban-crushed\" title=\"DC Magazine Ban Crushed!\"><em>Benson v. United States<\/em><\/a>, comes from the District of Columbia Court of Appeals, not the federal D.C. Circuit Court of Appeals. That distinction matters. If this had come from the federal circuit, we\u2019d likely have the kind of clean circuit split that forces the Supreme Court\u2019s hand. But it didn\u2019t. So technically, no split.<\/p>\n\n\n\n<p>Still, what the court did here is significant.<\/p>\n\n\n\n<p>The D.C. court struck down the district\u2019s <a href=\"https:\/\/gunsamerica.com\/digest\/27-states-join-fight-against-magazine-ban-at-scotus\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"dc-magazine-ban-crushed\" title=\"DC Magazine Ban Crushed!\" data-wpil-monitor-id=\"3862\">magazine ban<\/a> on a facial challenge. Not a narrow ruling. Not a procedural dodge. A straight-up constitutional rejection.<\/p>\n\n\n\n<p>And here\u2019s the key: they actually applied <em>Heller<\/em> and <em>Bruen<\/em> the way they\u2019re written.<\/p>\n\n\n\n<p>The majority opinion opened with a blunt reality check: magazines holding more than 10 rounds are \u201cubiquitous,\u201d numbering in the hundreds of millions, and come standard with many of the most popular firearms sold in America today. First question: are 11+ round magazines \u201carms\u201d under the Second Amendment? Answer: yes. They feed ammunition into firearms, and ammunition is necessary for a firearm to function. No gymnastics. No philosophical detours. Just plain English.<\/p>\n\n\n\n<p>Second question: are they in <a href=\"https:\/\/gunsamerica.com\/digest\/no-guns-planes-law-common-sense-anti-gun\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"dc-magazine-ban-crushed\" title=\"DC Magazine Ban Crushed!\" data-wpil-monitor-id=\"3858\">common use for lawful<\/a> purposes like self-defense? Again, yes. Not just common: ubiquitous!<\/p>\n\n\n\n<p>Third question: is there any historical tradition of banning arms that are in such common use? No.<\/p>\n\n\n\n<p>That\u2019s it. Inquiry over.<\/p>\n\n\n\n<p>And that\u2019s what makes this opinion refreshing. The court even acknowledged that lawmakers might genuinely believe limiting magazines to 10 rounds could reduce harm. But (and this is the important part) the Supreme <a href=\"https:\/\/gunsamerica.com\/digest\/saf-sues-connecticut-mag-ban\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"dc-magazine-ban-crushed\" title=\"DC Magazine Ban Crushed!\" data-wpil-monitor-id=\"3859\">Court has already rejected interest-balancing under the Second Amendment<\/a>. Courts aren\u2019t supposed to weigh policy preferences against constitutional text.<\/p>\n\n\n\n<p>So the D.C. court followed the rule.<\/p>\n\n\n\n<p>Because the magazine ban was unconstitutional, the dominoes fell. Benson\u2019s conviction for the \u201chigh-capacity\u201d magazine was reversed. And since that <a href=\"https:\/\/gunsamerica.com\/digest\/chiappa-firearms-x-caliber-finding-ammo-is-easier-than-pulling-a-sword-from-a-stone-shot-show-2014\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"dc-magazine-ban-crushed\" title=\"DC Magazine Ban Crushed!\" data-wpil-monitor-id=\"3861\">magazine classification made his firearm<\/a> \u201cillegal,\u201d which then triggered charges for unregistered possession, carrying without a license, and unlawful ammo possession, all of those convictions collapsed too. Fruit of the poisonous tree.<\/p>\n\n\n\n<p>The dissent? Interestingly, it came from a Trump-appointed judge. The majority was two judges: one Trump, one Obama. That tells you something. This wasn\u2019t partisan activism. Not quite. Since this isn\u2019t a federal circuit decision, it doesn\u2019t create the clean, undeniable split that forces SCOTUS to step in.<\/p>\n\n\n\n<p>But it absolutely adds pressure.<\/p>\n\n\n\n<p>If the Third Circuit, for example, <a href=\"https:\/\/gunsamerica.com\/digest\/saf-pushes-supreme-court-to-strike-down-assault-weapons-ban\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"dc-magazine-ban-crushed\" title=\"DC Magazine Ban Crushed!\" data-wpil-monitor-id=\"3860\">strikes down New Jersey\u2019s assault weapon ban<\/a> in <em>Cheeseman v. Platkin<\/em>, and New Jersey appeals, that\u2019s when the chessboard shifts. A real split on major platform bans? That\u2019s when the justices have fewer excuses to keep punting.<\/p>\n\n\n\n<p>For now, this is a major win in principle and a roadmap in practice. It reinforces that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Magazines are arms.<\/li>\n\n\n\n<li>Common use actually means common use.<\/li>\n\n\n\n<li>And courts don\u2019t get to invent balancing tests the Supreme Court already rejected.<\/li>\n<\/ul>\n\n\n\n<p>Is it the knockout blow? No.<\/p>\n\n\n\n<p>Is it a clean, intellectually honest application of <em>Heller<\/em> and <em>Bruen<\/em>?
