No judge. And, no due process.<\/p>\n\n\n\n<p>Just a bureaucratic decision. Veterans.<\/h3>\n\n\n\n<p>GOA has long argued the numbers were staggering.<\/p>\n\n\n\n<p>At one point, over 98% of federal mental health records submitted to <a href=\"https:\/\/gunsamerica.com\/digest\/va-ends-nics-flag-on-veterans\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"vet-gun-ban-dead\" title=\"Vet Gun Ban is DEAD!\" data-wpil-monitor-id=\"3833\">NICS reportedly involved veterans<\/a>.<\/p>\n\n\n\n<p>That\u2019s not a typo.<\/p>\n\n\n\n<p>For decades, veterans made up the overwhelming majority of mental health-based federal prohibitions \u2014 largely because of this fiduciary reporting rule.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-fight-to-end-it\">The Fight to End It<\/h3>\n\n\n\n<p>GOA says it has been lobbying to overturn the policy since the 1990s.<\/p>\n\n\n\n<p>The breakthrough came in 2023, when language backed by GOA was included in the Consolidated Appropriations Act of 2024. That provision defunded the VA\u2019s ability to continue adding veterans to the prohibited persons list based solely on fiduciary status.<\/p>\n\n\n\n<p>That stopped new names from being added.<\/p>\n\n\n\n<p>But over a quarter-million veterans were already on the list.<\/p>\n\n\n\n<p>The next battle? Getting them off.<\/p>\n\n\n\n<p><a href=\"https:\/\/gunsamerica.com\/digest\/congress-slashes-atf-budget-again\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"vet-gun-ban-dead\" title=\"Vet Gun Ban is DEAD!\" data-wpil-monitor-id=\"3831\">GOA says it worked with members of Congress<\/a> and the newly appointed VA Secretary, Doug Collins, to end the policy entirely and begin the process of reversing past reports.<\/p>\n\n\n\n<p>In February, the VA announced the fiduciary reporting practice was wrongfully denying veterans their constitutional rights and that it would coordinate with the FBI to remove past entries.<\/p>\n\n\n\n<p>That\u2019s the part that makes this a full-circle victory: not just stopping future reporting, but undoing the damage.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-political-back-and-forth\">The Political Back-and-Forth<\/h3>\n\n\n\n<p>This didn\u2019t happen quietly.<\/p>\n\n\n\n<p>According to GOA, 140 anti-gun House Democrats sent a letter urging the VA to find ways to continue reporting veterans, citing concerns over suicide prevention.<\/p>\n\n\n\n<p>That raised another major policy question:<\/p>\n\n\n\n<p>Is stripping constitutional rights an effective mental health strategy?<\/p>\n\n\n\n<p>Or does it simply penalize veterans who seek financial help?<\/p>\n\n\n\n<p>The VA ultimately did not follow through with continuing the reporting.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-this-means\">What This Means<\/h3>\n\n\n\n<p>If the VA follows through as announced:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>No more automatic NICS reporting for fiduciary appointments<\/li>\n\n\n\n<li>No more treating financial assistance as a mental health adjudication<\/li>\n\n\n\n<li>Over 270,000 veterans potentially restored to lawful firearm ownership<\/li>\n<\/ul>\n\n\n\n<p>For many in the 2A community, this is being called a long-overdue correction.<\/p>\n\n\n\n<p>For veterans who were never convicted of a crime or declared mentally incompetent by a court, it\u2019s the end of a decades-long policy they argue should have never existed.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-bigger-picture\">The Bigger Picture<\/h3>\n\n\n\n<p>This fight highlights a recurring issue in gun policy debates:<\/p>\n\n\n\n<p>Who gets labeled \u201cprohibited,\u201d and how?<\/p>\n\n\n\n<p>And perhaps more importantly, what level of due process should be required before someone loses a constitutional right?<\/p>\n\n\n\n<p>For now, one thing is clear: After nearly 30 years, the VA fiduciary <a href=\"https:\/\/gunsamerica.com\/digest\/new-mexico-gun-ban-bill\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"vet-gun-ban-dead\" title=\"Vet Gun Ban is DEAD!\" data-wpil-monitor-id=\"3832\">gun ban<\/a> is over.<\/p>\n\n\n\n<p>And for hundreds of thousands of veterans, that\u2019s not just policy reform.
