Hemani<\/em>, and if you thought this would be a clean, predictable Second Amendment case\u2026 think again.<\/p>\n\n\n\n<p>At the center of it all is a straightforward question with messy consequences:<\/p>\n\n\n\n<p><strong><em>Should it be a federal crime for someone who uses marijuana to possess a firearm?<\/em><\/strong><\/p>\n\n\n\n<p>Under current federal law, \u201cunlawful users\u201d of controlled substances are prohibited persons. Marijuana remains illegal under federal law, even if your state has legalized it. So yes, technically, someone who uses weed (even legally under state law) can lose their gun rights.<\/p>\n\n\n\n<p>But this case isn\u2019t just about cannabis. Hemani\">Fox 32 Chicago<\/a><\/em> that legislatures need the ability to make broad, categorical decisions.<\/p>\n\n\n\n<p>His example?<\/p>\n\n\n\n<p>Even if there\u2019s a wildly responsible, firearms-savvy seven-year-old prodigy somewhere out there, the law still says no seven-year-olds can own guns. Period.<\/p>\n\n\n\n<p>That\u2019s how categorical rules work.<\/p>\n\n\n\n<p>The argument from that side is simple: drug use (especially habitual use) falls into that same category. Legislatures should be able to say, \u201cThis group can\u2019t have guns,\u201d without needing a case-by-case hearing for every individual.<\/p>\n\n\n\n<p>But here\u2019s where things get sticky.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-alcohol-ambien-and-where-do-you-draw-the-line\">Alcohol, Ambien\u2026 and Where Do You Draw the Line?<\/h3>\n\n\n\n<p>Josh Blackman of <a href=\"https:\/\/gunsamerica.com\/digest\/hunt365-blackbuck-antelope\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-guns-marijuana-u-s-v-hemani\" title=\"SCOTUS Wrestles with Guns &amp; Marijuana in U.S. v. Hemani\" data-wpil-monitor-id=\"3821\">South Texas<\/a> College of Law pointed out something the justices clearly struggled with: alcohol.<\/p>\n\n\n\n<p>Alcohol isn\u2019t illegal. Plenty of people drink. Some abuse it. But alcohol use alone doesn\u2019t disqualify someone from gun ownership.<\/p>\n\n\n\n<p>So why does marijuana?<\/p>\n\n\n\n<p>The justices reportedly wrestled with distinctions between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Occasional use vs. addiction<\/li>\n\n\n\n<li>Impairment vs. moderation<\/li>\n\n\n\n<li>Marijuana vs. heroin vs. meth<\/li>\n\n\n\n<li>Even prescription drugs like Ambien<\/li>\n<\/ul>\n\n\n\n<p>Justice Barrett floated a hypothetical: what if someone takes their spouse\u2019s Ambien pill once in a while? Hemani\" data-wpil-monitor-id=\"3820\">gun laws must align with historical tradition<\/a>.<\/p>\n\n\n\n<p>So what\u2019s the historical analog for banning drug users from owning firearms?<\/p>\n\n\n\n<p>Back in the Founding era, there weren\u2019t meth labs or cannabis dispensaries. But there were restrictions involving \u201cdrunkards.\u201d That\u2019s why that term kept popping up during arguments.<\/p>\n\n\n\n<p>The real concern? Whatever rule the Court writes here won\u2019t just apply to marijuana users. It could impact:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Felon prohibitions<\/li>\n\n\n\n<li>Mental health commitments<\/li>\n\n\n\n<li>Other categorical bans<\/li>\n<\/ul>\n\n\n\n<p>If the <a href=\"https:\/\/gunsamerica.com\/digest\/court-says-no-guns-medical-marijuana-users\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-guns-marijuana-u-s-v-hemani\" title=\"SCOTUS Wrestles with Guns &amp; Marijuana in U.S. v. Hemani\" data-wpil-monitor-id=\"3823\">Court says you can\u2019t broadly disarm marijuana users<\/a> without individualized proof of dangerousness, what happens when someone convicted of a non-violent felony from 20 years ago makes the same argument?<\/p>\n\n\n\n<p>That\u2019s the Pandora\u2019s box the justices seem wary of opening.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-an-unusual-coalition\">An Unusual Coalition<\/h3>\n\n\n\n<p>Here\u2019s another twist: this case reportedly drew support from <a href=\"https:\/\/gunsamerica.com\/digest\/pro-2a-group-issues-travel-advisory-in-massachusetts-amid-gun-control-controversy\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-guns-marijuana-u-s-v-hemani\" title=\"SCOTUS Wrestles with Guns &amp; Marijuana in U.S. v. Hemani\" data-wpil-monitor-id=\"3824\">groups you don\u2019t typically see aligned on gun issues<\/a>.<\/p>\n\n\n\n<p>Marijuana advocates. Civil liberties groups. Gun rights supporters.<\/p>\n\n\n\n<p>It\u2019s not your standard <a href=\"https:\/\/gunsamerica.com\/digest\/red-cities-vs-blue-cities-which-have-the-lower-homicide-rates\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"scotus-guns-marijuana-u-s-v-hemani\" title=\"SCOTUS Wrestles with Guns &amp; Marijuana in U.S. v. Hemani\" data-wpil-monitor-id=\"3822\">red vs. blue<\/a> Second Amendment fight. It\u2019s more like constitutional consistency vs. regulatory authority.<\/p>\n\n\n\n<p>Even with a push to reschedule marijuana federally, the Court has to rule based on the law as it existed when Mr. Hemani allegedly violated it.<\/p>\n\n\n\n<p>And according to legal observers, don\u2019t expect a clean 6\u20133 ideological split. This could be fragmented. Multiple opinions. Narrow reasoning.
