Without repealing federal law.<\/p>\n\n\n\n<p>The legislation, <a href=\"https:\/\/www.wvlegislature.gov\/Bill_Status\/bills_text.cfm?billdoc=sb1071%20intr.htm&amp;yr=2026&amp;sesstype=RS&amp;i=1071\" target=\"_blank\" class=\"clickTracking\" campaign=\"bill-loophole-restore-machine-gun-transfers\" title=\"Bill Would Use Federal Loophole to Restore Machine Gun Transfers\">SB 1071,<\/a> would authorize the creation of a state entity to purchase and transfer machine guns to qualified law-abiding citizens under existing federal statutes. According to <a href=\"https:\/\/gunsamerica.com\/digest\/people-book-celebrates-gun-owners-across-america\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"bill-loophole-restore-machine-gun-transfers\" title=\"Bill Would Use Federal Loophole to Restore Machine Gun Transfers\" data-wpil-monitor-id=\"3706\">Gun Owners of America<\/a> (GOA), the proposal is carefully structured around a specific exemption written into federal law.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"BREAKING: GOA Un-Banning Machine Guns With West Virginia\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/UqE2skx1M3k?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><figcaption class=\"wp-element-caption\">States can and should <a href=\"https:\/\/gunsamerica.com\/digest\/wow-small-town-sheriff-sentenced-for-selling-machine-guns\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"bill-loophole-restore-machine-gun-transfers\" title=\"Bill Would Use Federal Loophole to Restore Machine Gun Transfers\" data-wpil-monitor-id=\"3705\">sell machine guns<\/a> to the general public.&#8221; &#8212; GOA<\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>At the center of the debate is 18 U.S.C. \u00a7 922(o), commonly known as the <a href=\"https:\/\/gunsamerica.com\/digest\/four-anti-gun-bills-race-toward-vote-in-pennsylvania\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"bill-loophole-restore-machine-gun-transfers\" title=\"Bill Would Use Federal Loophole to Restore Machine Gun Transfers\" data-wpil-monitor-id=\"3702\">Hughes Amendment<\/a>, which generally prohibits civilian possession of machine guns manufactured after May 19, 1986. But the statute includes an exception: the prohibition does not apply to transfers \u201cto or by, or possession by or under the authority of\u201d a State or political subdivision.<\/p>\n\n\n\n<p>SB 1071 would rely on that language.<\/p>\n\n\n\n<p>Under the proposal, West Virginia would establish state-run distribution centers <a href=\"https:\/\/gunsamerica.com\/digest\/duck-hunting-in-september\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"bill-loophole-restore-machine-gun-transfers\" title=\"Bill Would Use Federal Loophole to Restore Machine Gun Transfers\" data-wpil-monitor-id=\"3703\">authorized to acquire machine guns<\/a> and conduct transfers \u201cby\u201d the State to qualified members of the public. Supporters argue that if the transfer is conducted under state authority, it fits squarely within the statutory exemption.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-sig-p211-gto-review-flat-fast-relentless\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/sig-p211-gto-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"bill-loophole-restore-machine-gun-transfers\" title=\"Bill Would Use Federal Loophole to Restore Machine Gun Transfers\">Sig P211 GTO Review \u2013 Flat, Fast, Relentless<\/a><\/h2>\n\n\n\n<p>Erich Pratt, Senior Vice President of GOA, framed the bill as a direct challenge to decades of accepted interpretation.<\/p>\n\n\n\n<p>\u201cFor decades, Americans have been told that the 1986 <a href=\"https:\/\/gunsamerica.com\/digest\/fed-court-strikes-down-machine-gun-ban\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"bill-loophole-restore-machine-gun-transfers\" title=\"Bill Would Use Federal Loophole to Restore Machine Gun Transfers\" data-wpil-monitor-id=\"3704\">machine gun ban<\/a> permanently stripped them of access to modern arms,\u201d Pratt said. \u201cBut Congress included an explicit exemption for transfers \u2018to or by\u2019 a State, and that language matters.\u201d<\/p>\n\n\n\n<p>GOA\u2019s Director of State Affairs, Chris Stone, added that the effort is rooted in \u201cplain text\u201d statutory construction and an understanding of the Second Amendment that traces back to early American militia laws.<\/p>\n\n\n\n<p>Supporters point to the Militia Act of 1792 and historic surplus arms sales as evidence that the Founders envisioned citizens equipped with contemporary military arms. Critics, however, will almost certainly argue that Congress never intended the state-transfer exemption to function as a workaround for civilian machine gun access.<\/p>\n\n\n\n<p>The legal fight, if the bill advances, would likely be immediate.<\/p>\n\n\n\n<p>At minimum, SB 1071 tests whether states can use existing federal language to expand access to heavily regulated firearms. At maximum, it could trigger a direct showdown over the Hughes Amendment itself.<\/p>\n\n\n\n<p>Either way, West Virginia just entered the machine gun debate in a way few states have
