It\u2019s in what it actually criminalizes.<\/p>\n\n\n\n<p>SB 749 doesn\u2019t focus on violent crime. It doesn\u2019t hinge on how a firearm is used. Instead, it zeroes in on possession, redefining a broad category of commonly owned firearms and magazines as illegal based largely on cosmetic features. <\/p>\n\n\n\n<p>AR-15\u2013style rifles, certain pistols and shotguns, and <a href=\"https:\/\/gunsamerica.com\/digest\/shield-arms-glock-43x-48-magazine-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-ar-ban-on-the-move\" title=\"Virginia AR Ban: On the Move!\" data-wpil-monitor-id=\"3362\">magazines holding more than ten rounds<\/a> are all swept into the bill\u2019s reach.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"They\u2019ve Completely Lost Their Minds With This New AR-15 Ban\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/ArIUULT3JVk?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>And that distinction matters.<\/p>\n\n\n\n<p>Under the bill\u2019s language, two firearms that function identically can be treated completely differently under the law simply because one has a listed feature and the other doesn\u2019t. That\u2019s not a functional standard. It\u2019s an appearance test. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-bersa-brings-more-capacity-shot-show-2026\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/bersa-brings-more-capacity-shot-show-2026\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-ar-ban-on-the-move\" title=\"Virginia AR Ban: On the Move!\">Bersa Brings More Capacity \u2014 SHOT Show 2026<\/a><\/h2>\n\n\n\n<p>As Noir notes, this is how bans move forward without lawmakers having to explain why a grip, a stock, or a barrel shroud suddenly <a href=\"https:\/\/gunsamerica.com\/digest\/hunt365-duck-hunt-turns-fatal\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-ar-ban-on-the-move\" title=\"Virginia AR Ban: On the Move!\" data-wpil-monitor-id=\"3359\">turns a legal firearm into a public safety<\/a> threat.<\/p>\n\n\n\n<p>Supporters lean heavily on the familiar \u201cweapons of war\u201d framing, comparing civilian-owned rifles to <a href=\"https:\/\/gunsamerica.com\/digest\/gao-sting-nets-1-2-million-govt-guns-using-fake-website\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-ar-ban-on-the-move\" title=\"Virginia AR Ban: On the Move!\" data-wpil-monitor-id=\"3364\">military hardware<\/a>. But as Noir points out, that comparison collapses under even light scrutiny. An <a href=\"https:\/\/gunsamerica.com\/digest\/sbr-vs-braced-pistol-read-this-first\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-ar-ban-on-the-move\" title=\"Virginia AR Ban: On the Move!\" data-wpil-monitor-id=\"3358\">AR-15 is not a select-fire military rifle<\/a>, and the lethality argument doesn\u2019t change based on aesthetics. The rhetoric may be emotionally effective, but it\u2019s technically thin.<\/p>\n\n\n\n<p>Where the bill really escalates is with a committee substitute that removes grandfathering protections. That means Virginians who legally purchased standard-capacity magazines (or <a href=\"https:\/\/gunsamerica.com\/digest\/holiday-gift-guide-hunt-perfect-gift-hunter-life\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-ar-ban-on-the-move\" title=\"Virginia AR Ban: On the Move!\" data-wpil-monitor-id=\"3360\">firearms that were perfectly<\/a> lawful at the time) could become criminals overnight without doing anything new. No misuse. No violent act. Just ownership.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-armasight-pro-series-a-thermal-overhaul-shot-show-2026\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/armasight-pro-series-thermal-overhaul-shot-show-2026\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-ar-ban-on-the-move\" title=\"Virginia AR Ban: On the Move!\">Armasight Pro Series: A Thermal Overhaul \u2014 SHOT Show 2026<\/a><\/h2>\n\n\n\n<p>Even supporters of the legislation acknowledge the obvious: criminals aren\u2019t the ones who will comply. <a href=\"https:\/\/gunsamerica.com\/digest\/violent-criminals-dont-get-their-guns-from-gun-stores-chicago-inmates-confess\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-ar-ban-on-the-move\" title=\"Virginia AR Ban: On the Move!\" data-wpil-monitor-id=\"3365\">Criminals don\u2019t<\/a> care about feature lists or magazine limits. The people who do care are the ones trying to follow the law, and SB 749 expands the definition of \u201ccriminal\u201d to include them.<\/p>\n\n\n\n<p>That reality is underscored by what lawmakers <em>didn\u2019t<\/em> advance. A proposal to increase penalties for the criminal use or display of firearms during felonies was rejected. In other words, the legislature declined to get tougher on actual violent misuse while simultaneously broadening penalties for possession, transport, and ownership.<\/p>\n\n\n\n<p>SB 749 doesn\u2019t just <a href=\"https:\/\/gunsamerica.com\/digest\/mass-bill-nearly-double-taxes-firearm-sales-ban-50-cals\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-ar-ban-on-the-move\" title=\"Virginia AR Ban: On the Move!\" data-wpil-monitor-id=\"3367\">ban sales<\/a>. It criminalizes importing, manufacturing, buying, owning, or transporting covered firearms. That\u2019s not a misuse statute; it\u2019s an existence clause. Touch it, move it, or already have it, and you\u2019re on the wrong side of the law.<\/p>\n\n\n\n<p>As Noir frames it, Virginia isn\u2019t necessarily the end goal.  It\u2019s the <a href=\"https:\/\/gunsamerica.com\/digest\/nra-news-ginny-simone-atfs-ammo-ban-a-test-case\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-ar-ban-on-the-move\" title=\"Virginia AR Ban: On the Move!\" data-wpil-monitor-id=\"3363\">test case<\/a>. Redefine what\u2019s \u201cnormal,\u201d <a href=\"https:\/\/gunsamerica.com\/digest\/la-law-criminalizing-possession-of-10-round-magazine-set-to-roll-out\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"virginia-ar-ban-on-the-move\" title=\"Virginia AR Ban: On the Move!\" data-wpil-monitor-id=\"3366\">criminalize possession<\/a>, label it safety, and see what sticks. If it works once, the idea travels.<\/p>\n\n\n\n<p>And that\u2019s the <a href=\"https:\/\/gunsamerica.com\/digest\/hk-parts-owner-gets-4-years-illegal-gun-sales-tax-evasion\/\" target=\"_blank\"
