{"id":23056,"date":"2014-08-07T10:28:46","date_gmt":"2014-08-07T14:28:46","guid":{"rendered":"http:\/\/www.gunsamerica.com\/blog\/?p=23056"},"modified":"2014-08-07T10:28:46","modified_gmt":"2023-08-17T21:20:19","slug":"white-house-website-butchers-2a-gun-group-requests-corrections","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/white-house-website-butchers-2a-gun-group-requests-corrections\/","title":{"rendered":"White House website butchers 2A, Gun group requests corrections"},"content":{"rendered":"<p>Unhappy with the way that the Obama administration defines the Second Amendment on its <a href=\"https:\/\/www.whitehouse.gov\/our-government\/the-constitution\" target=\"_blank\" class=\"clickTracking\" campaign=\"white-house-website-butchers-2a-gun-group-requests-corrections\" title=\"White House website butchers 2A, Gun group requests corrections\" target=\"_blank\" rel=\"noopener\">website<\/a>, Gun Owners of America released <a href=\"https:\/\/gunowners.org\/media8052014b.htm\" target=\"_blank\" class=\"clickTracking\" campaign=\"white-house-website-butchers-2a-gun-group-requests-corrections\" title=\"White House website butchers 2A, Gun group requests corrections\" target=\"_blank\" rel=\"noopener\">an open letter<\/a> on Tuesday asking the president to make the appropriate corrections.<\/p>\n<p>Currently, WhiteHouse.gov states that &#8220;The Second Amendment gives citizens the right to bear arms,&#8221; which GOA argues is &#8220;highly inaccurate.&#8221;<\/p>\n<p>Briefly put, GOA wants the president to (a) include the word &#8220;keep&#8221; in the description and (b) acknowledge that the 2A doesn&#8217;t give or bestow the right to own and carry firearms, but protects and codifies that fundamental right.<\/p>\n<p>Here is the full text of the letter:<\/p>\n<p><em>An Open Letter to President Barack H. Obama<\/em><\/p>\n<p><em>The Honorable Barack H. Obama<\/em><br \/>\n<em> President of the United States<\/em><br \/>\n<em> The White House<\/em><br \/>\n<em> 1600 Pennsylvania Avenue N.W.<\/em><br \/>\n<em> Washington, DC 20500<\/em><\/p>\n<p><em>Re: White House Website: The Need to Correct a<\/em><br \/>\n<em> False Description of the Second Amendment<\/em><\/p>\n<p><em>Dear President Obama:<\/em><\/p>\n<p><em>As Executive Director of Gun Owners of America, Inc., and Executive Vice President of Gun Owners Foundation, and on behalf of our over 300,000 members and supporters, I respectfully bring to your attention a matter that requires your immediate action.<\/em><\/p>\n<p><em>The official White House website includes a page1 which purports to describe key provisions of the United States Constitution. With respect to the Second Amendment, the complete description of the Second Amendment on the website is as follows:<\/em><\/p>\n<p><em>&#8220;The Second Amendment gives citizens the right to bear arms.&#8221; [Emphasis original.]<\/em><\/p>\n<p><em>Even recognizing that the website attempts to present only a simple summary of provisions of the Constitution, the description is highly inaccurate, and should be immediately corrected so as not to mislead the American people as to the true nature and scope of the Second Amendment. There are two separate problems with the White House website.<\/em><\/p>\n<p><em>Correction Number 1<\/em><\/p>\n<p><em>The Second Amendment does not \u201cgive\u201d citizens any rights. Rather, as the U.S. Supreme Court explained in District of Columbia v. Heller, 554 U.S. 570 (2008), the Second Amendment \u201ccodifies,\u201d2 \u201cprotects,\u201d3 and \u201csecure[s]\u201d4 a right \u2014 rather than \u201cgrants,\u201d \u201cbestows,\u201d or \u201cgives\u201d one.<\/em><\/p>\n<p><em>The Supreme Court explicitly stated that \u201cit has always been widely understood that the Second Amendment, like the First and Fourth Amendments, codified a pre-existing right. The Second Amendment text recognizes the right as pre-existent, declaring only that it \u2018shall not be infringed.\u2019\u201d Id. at 592 (emphasis added). That is why the Court concluded in Heller that the right to keep and bear arms \u201cbelongs to all Americans.\u201d Id. at 581 (emphasis added).5<\/em><\/p>\n<p><em>Thus, the Second Amendment protects a right granted us by our Creator, as described in the nation\u2019s charter, the Declaration of Independence:<\/em><\/p>\n<p><em>We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. [Emphasis added.]<\/em><\/p>\n<p><em>You can understand our concern here, for if the Second Amendment is a mere privilege given to American citizens by government, it is a privilege which can be overcome by naked assertions of public safety. Indeed, this misunderstanding of the Second Amendment undergirds the erroneous positions being argued in many cases across the country by your Attorney General and the U.S. Justice Department.<\/em><\/p>\n<p><em>Correction Number 2<\/em><\/p>\n<p><em>Additionally, the description on the White House website completely ignores the fact that the Second Amendment protects not only the right to \u201cbear\u201d arms but also to \u201ckeep\u201d them.<\/em><\/p>\n<p><em>Indeed, the U.S. Supreme Court in Heller expressly addressed the right to \u201ckeep\u201d a handgun for self-defense within the home. In its analysis, the Supreme Court, in parsing the words of the Second Amendment, analyzed the right to \u201ckeep\u201d separately from the right to \u201cbear\u201d arms. Id. at 581. These two words have specific, and different, meanings, protecting different sets of activities. One must first enjoy the right to own (\u201ckeep\u201d) a firearm in order to protect its use (\u201cbear\u201d).<\/em><\/p>\n<p><em>Conclusion<\/em><\/p>\n<p><em>On behalf of one of the largest and oldest firearms rights groups in the United States, we respectfully suggest that the White House adopt following language to replace the erroneous explanation:<\/em><\/p>\n<p><em>&#8220;The Second Amendment seeks to preserve the United States as a free nation, by protecting the right of individual American citizens to acquire, own, possess, sell, carry and use modern firearms, both through service in a citizen\u2019s militia as a final line of defense against government tyranny, as well as other personal uses such as self-defense, hunting, and other sporting activities.&#8221;<\/em><\/p>\n<p><em>Please do not hesitate to contact me if we can be of further assistance in this matter.
