Everyone rushed to pick a team. Pro-ICE versus anti-ICE. Pro-Trump versus anti-Trump. Gun people versus non-gun people. And in the middle of all that noise, the actual facts and the Constitution started getting trampled.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"The Truth About Alex Pretti Minnesota Shooting\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/Gz-dPb5SxbQ?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><figcaption class=\"wp-element-caption\">I think Noir hit it outta the park with his analysis. He didn\u2019t run cover for anyone; he didn\u2019t play partisan defense. He didn\u2019t pretend ugly facts weren\u2019t ugly. And, he did something that\u2019s increasingly rare: he stayed consistent.<\/p>\n\n\n\n<p>And consistency is the whole point of the 2A.<\/p>\n\n\n\n<p>Let\u2019s start with the uncomfortable part.  President Donald Trump. When asked about Pretti, Trump defaulted to a line that should make every gun owner cringe: \u201cYou know, you can&#8217;t have guns. You can&#8217;t walk in with guns. You just can&#8217;t.\u201d That\u2019s not just sloppy. That\u2019s wrong. Flatly wrong.<\/p>\n\n\n\n<p>In Iowa, Trump also told a <a href=\"https:\/\/time.com\/7358403\/nra-trump-clash-gun-carrying-rights-pretti-federal-agents\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"alex-pretti-shooting-trumps-idiotic-comments-2a-consistency\" title=\"The Alex Pretti Shooting, Trump's Idiotic Comments, And Why 2A Consistency Matters\">reporter<\/a>, &#8220;I don&#8217;t like that he had a gun. I don&#8217;t like that he had two fully loaded magazines. That&#8217;s a lot of bad stuff. It is not evidence of intent. It is not probable cause. Calling it out isn\u2019t betrayal. It\u2019s accountability. Rights don\u2019t survive on vibes or loyalty. They survive on consistency.<\/p>\n\n\n\n<p>At the same time, Noir refuses to lie to make anyone feel better. Was it smart for Pretti to show up armed to a protest involving federal agents? Probably not. But legality and wisdom are two different conversations, and collapsing them is how rights quietly disappear.<\/p>\n\n\n\n<p>Pretti didn\u2019t lose his Second Amendment rights because he was protesting ICE. He didn\u2019t lose them because people didn\u2019t like his politics. Based on the available footage, Noir lays out what looks less like a justified use of force and more like a cascading failure: poor situational awareness, escalating force, panic, and a situation that spiraled into lethal chaos.<\/p>\n\n\n\n<p>The most damning detail? <\/p>\n\n\n\n<p>Pretti appears to have been disarmed before shots were fired. An agent removes the firearm and moves away with it. Another agent, who was apparently not directly threatened, draws and fires from behind. Then more shots follow, even as Pretti is on the ground, motionless.<\/p>\n\n\n\n<p>That matters. Under <em><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/490\/386\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"alex-pretti-shooting-trumps-idiotic-comments-2a-consistency\" title=\"The Alex Pretti Shooting, Trump's Idiotic Comments, And Why 2A Consistency Matters\">Graham v. Connor<\/a><\/em> and <em><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/471\/1\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"alex-pretti-shooting-trumps-idiotic-comments-2a-consistency\" title=\"The Alex Pretti Shooting, Trump's Idiotic Comments, And Why 2A Consistency Matters\">Tennessee v. Garner<\/a><\/em>, deadly force is judged officer-by-officer, second-by-second, under an objective reasonableness standard. A gun <em>existing<\/em> is not the same thing as a gun being a threat. Calling this \u201cdefensive\u201d before the facts are settled doesn\u2019t help public trust.  And it doesn\u2019t help the agents involved if the evidence doesn\u2019t back it up.<\/p>\n\n\n\n<p>None of this means Pretti made perfect decisions. Stepping into an active <a href=\"https:\/\/gunsamerica.com\/digest\/the-mil-leo-only-guns-from-your-favorite-companies\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"alex-pretti-shooting-trumps-idiotic-comments-2a-consistency\" title=\"The Alex Pretti Shooting, Trump's Idiotic Comments, And Why 2A Consistency Matters\" data-wpil-monitor-id=\"3083\">law enforcement<\/a> confrontation while armed introduces real risk. Noir is clear about that. That means their margin for error is smaller, not larger. If the shooting continued after the threat was neutralized, that\u2019s not politics. That\u2019s law.<\/p>\n\n\n\n<p>And this is the most important takeaway: this case should not be hijacked into an ICE debate or a tribal loyalty test.
