A divided panel of the U.S. Court of Appeals for the Ninth Circuit has ruled that California\u2019s ban on open carry in large, urban counties violates the Second Amendment, delivering another major blow to the state\u2019s public-carry regime.<\/p>\n\n\n\n

In Baird v. Bonta<\/em><\/a>, the court held that California\u2019s prohibition on openly carrying firearms in counties with populations over 200,000 (covering roughly 95 percent of the state\u2019s residents) cannot survive constitutional scrutiny under the Supreme Court\u2019s Bruen<\/em> framework. <\/p>\n\n\n\n

The panel ordered judgment entered in favor of plaintiff Mark Baird on that claim and remanded the case accordingly.<\/p>\n\n\n\n
