Richard Blumenthal <a href=\"https:\/\/www.blumenthal.senate.gov\/newsroom\/press\/release\/12\/12\/2025\/blumenthal-leads-senate-introduction-of-no-check-no-sale-bill-to-close-the-charleston-loophole\" target=\"_blank\" class=\"clickTracking\" campaign=\"senate-dems-push-no-check-no-sale-bill\" title=\"Senate Dems Push 'No Check, No Sale' Bill\">led<\/a> a group of 25 Senate Democrats in introducing the Background Check Completion Act, often branded as the \u201cNo Check, No Sale\u201d bill. Supporters say it would close the so-called <em>Charleston <\/em><a href=\"https:\/\/gunsamerica.com\/digest\/dems-urge-bidens-atf-to-close-gun-seller-background-check-loophole\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"senate-dems-push-no-check-no-sale-bill\" title=\"Senate Dems Push 'No Check, No Sale' Bill\" data-wpil-monitor-id=\"2249\">loophole by preventing firearm transfers unless a background check<\/a> is fully completed.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"BREAKING: New Gun Bill Would HALT Legal Sales Forever | No Check, No Sale Explained\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/mOW66s7eOvw?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Under current federal law, when a buyer attempts to purchase a firearm from a <a href=\"https:\/\/gunsamerica.com\/digest\/expect-background-check-delays-as-new-federal-gun-control-rolls-out\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"senate-dems-push-no-check-no-sale-bill\" title=\"Senate Dems Push 'No Check, No Sale' Bill\" data-wpil-monitor-id=\"2248\">federally licensed dealer and the background check is delayed<\/a>, the FBI has 72 hours to complete its review for buyers 21 and older. If no final answer is returned in that window, the dealer may legally proceed with the sale. For buyers under 21, the review period can extend to 10 days.<\/p>\n\n\n\n<p>Blumenthal argues that system allows prohibited buyers to slip through the cracks.<\/p>\n\n\n\n<p>\u201cIf you haven\u2019t <a href=\"https:\/\/gunsamerica.com\/digest\/universal-background-checks-pass-in-oregon\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"senate-dems-push-no-check-no-sale-bill\" title=\"Senate Dems Push 'No Check, No Sale' Bill\" data-wpil-monitor-id=\"2250\">passed a background check<\/a>, you shouldn\u2019t be able to purchase a weapon,\u201d Blumenthal said. \u201cNo check, no gun.\u201d<\/p>\n\n\n\n<p>According to figures cited by the bill\u2019s sponsors, 2,758 <a href=\"https:\/\/gunsamerica.com\/digest\/ak-47-hog-blaster\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"senate-dems-push-no-check-no-sale-bill\" title=\"Senate Dems Push 'No Check, No Sale' Bill\" data-wpil-monitor-id=\"2247\">firearms<\/a> were transferred in 2024 to people later determined to be legally prohibited from owning guns because background checks were not completed in time. Democrats routinely cite the 2015 Charleston church <a href=\"https:\/\/en.wikipedia.org\/wiki\/Charleston_church_shooting\" target=\"_blank\" class=\"clickTracking\" campaign=\"senate-dems-push-no-check-no-sale-bill\" title=\"Senate Dems Push 'No Check, No Sale' Bill\">shooting<\/a>, where the shooter obtained his firearm after a delayed background check, as justification for the proposal.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-cz-wins-major-military-contract\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/cz-wins-military-contract\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"senate-dems-push-no-check-no-sale-bill\" title=\"Senate Dems Push 'No Check, No Sale' Bill\">CZ Wins Major Military Contract<\/a><\/h2>\n\n\n\n<p>The legislation would <a href=\"https:\/\/gunsamerica.com\/digest\/sheriffs-oppose-california-lt-gov-s-attempt-to-confiscate-magazines-ammo\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"senate-dems-push-no-check-no-sale-bill\" title=\"Senate Dems Push 'No Check, No Sale' Bill\" data-wpil-monitor-id=\"2251\">require every background check<\/a> to be completed before a transfer occurs, eliminating the default-proceed option entirely. In practice, that would mean <a href=\"https:\/\/gunsamerica.com\/digest\/atf-genderqueer-gun-purchasers\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"senate-dems-push-no-check-no-sale-bill\" title=\"Senate Dems Push 'No Check, No Sale' Bill\" data-wpil-monitor-id=\"2254\">firearm transfers<\/a> could be delayed indefinitely until the FBI finishes its review.<\/p>\n\n\n\n<p>Companion legislation has been introduced in the House by James E. Clyburn.<\/p>\n\n\n\n<p>The bill is co-sponsored by a long list of Democratic senators, including <a href=\"https:\/\/gunsamerica.com\/digest\/another-anti-gun-hypocrite-exposed\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"senate-dems-push-no-check-no-sale-bill\" title=\"Senate Dems Push 'No Check, No Sale' Bill\" data-wpil-monitor-id=\"2252\">Cory Booker<\/a>, Elizabeth Warren, Bernie Sanders, and Adam Schiff. It is also endorsed by gun-control advocacy groups including <a href=\"https:\/\/gunsamerica.com\/digest\/what-everytown-taught-me-about-gun-safety\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"senate-dems-push-no-check-no-sale-bill\" title=\"Senate Dems Push 'No Check, No Sale' Bill\" data-wpil-monitor-id=\"2246\">Everytown for Gun Safety<\/a>, Giffords, Brady, and Sandy Hook Promise.<\/p>\n\n\n\n<p><a href=\"https:\/\/gunsamerica.com\/digest\/everytown-school-shooting-map-proves-gun-free-zones-are-magnets-for-atrocities-says-gun-rights-advocate\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"senate-dems-push-no-check-no-sale-bill\" title=\"Senate Dems Push 'No Check, No Sale' Bill\" data-wpil-monitor-id=\"2255\">Gun-rights advocates<\/a> have long countered that eliminating the default-proceed rule shifts the burden of bureaucratic delays onto lawful buyers, effectively allowing the government to block firearm purchases through inaction rather than due process. They also note that delayed checks do not automatically mean a buyer is prohibited.  Only that additional review is required.<\/p>\n\n\n\n<p>Whether the <a href=\"https:\/\/gunsamerica.com\/digest\/pro-gun-bills-advance-in-the-house\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"senate-dems-push-no-check-no-sale-bill\" title=\"Senate Dems Push 'No Check, No Sale' Bill\" data-wpil-monitor-id=\"2253\">bill advances<\/a> remains uncertain.
