Police Over AR-15 Ban\">lawsuit<\/a> against the District of Columbia\u2019s Metropolitan Police Department (MPD).  The lawsuit alleges that the city\u2019s firearm registration system amounts to an unconstitutional ban on AR-15s and other commonly owned firearms protected by the Second Amendment.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"DOJ sues DC over ban on semiautomatic firearms | NBC4 Washington\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/kSVYEq8t15E?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>At issue is D.C.\u2019s requirement that residents register firearms with MPD, combined with a sweeping list of firearms the city simply refuses to register. According to the DOJ, that combination functions as a de facto ban.  As it forces law-abiding citizens to choose between surrendering their rights or risking arrest for possessing firearms that are legal under federal law.<\/p>\n\n\n\n<p>\u201cWashington, D.C.\u2019s ban on some of America\u2019s most popular firearms is an unconstitutional infringement on the Second Amendment,\u201d said Pamela Bondi. A Horrible Idea<\/a><\/h2>\n\n\n\n<p>The lawsuit was filed by the Civil Rights Division\u2019s newly created <a href=\"https:\/\/gunsamerica.com\/digest\/dojs-civil-rights-division-2a-section\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-sues-d-c-police-over-ar-15-ban\" title=\"DOJ Sues D.C. Police Over AR-15 Ban\">Second Amendment Section<\/a>.  It signals that the DOJ is now actively <a href=\"https:\/\/gunsamerica.com\/digest\/gun-store-turns-records-new-york-state-police\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-sues-d-c-police-over-ar-15-ban\" title=\"DOJ Sues D.C. Police Over AR-15 Ban\" data-wpil-monitor-id=\"2204\">policing state and local gun<\/a> restrictions.  Not just defending them in court.<\/p>\n\n\n\n<p>Assistant Attorney General Harmeet K. Dhillon said the case is about enforcing long-settled law.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThe newly established Second Amendment Section filed this lawsuit to ensure that the very rights D.C. resident Mr. Heller secured 17 years ago are enforced today,\u201d Dhillon said, referring to District of <em><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/554\/570\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-sues-d-c-police-over-ar-15-ban\" title=\"DOJ Sues D.C. Police Over AR-15 Ban\">Columbia v. Heller<\/a><\/em>. <\/p>\n<\/blockquote>\n\n\n\n<p>That landmark 2008 Supreme <a href=\"https:\/\/gunsamerica.com\/digest\/saf-sues-connecticut-mag-ban\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-sues-d-c-police-over-ar-15-ban\" title=\"DOJ Sues D.C. Police Over AR-15 Ban\" data-wpil-monitor-id=\"2202\">Court decision struck down D.C.\u2019s handgun ban<\/a>. And held that the <a href=\"https:\/\/gunsamerica.com\/digest\/massachusetts-courts-decide-stun-guns-arent-protected-by-second-amendment\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-sues-d-c-police-over-ar-15-ban\" title=\"DOJ Sues D.C. Police Over AR-15 Ban\" data-wpil-monitor-id=\"2203\">Second Amendment protects<\/a> the right of law-abiding citizens to possess commonly used firearms for lawful purposes, including self-defense in the home.<\/p>\n\n\n\n<p>According to the DOJ, the District never truly complied.<\/p>\n\n\n\n<p>While D.C. technically allows firearm ownership post-<em>Heller<\/em>, the lawsuit <a href=\"https:\/\/gunsamerica.com\/digest\/hunt365-going-the-distance-the-long-range-hunting-course-by-outdoors-solutions\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-sues-d-c-police-over-ar-15-ban\" title=\"DOJ Sues D.C. Police Over AR-15 Ban\"  data-wpil-monitor-id=\"2200\">alleges<\/a> MPD has adopted a pattern and practice of refusing to register protected firearms, including AR-15-style rifles. As a result, residents are being forced into expensive lawsuits just to exercise their rights. But also federal civil rights law governing unconstitutional police practices. The case is being brought under the Police Pattern or Practice Act (34 U.S.C. \u00a7 12601), Executive Order 14206, and the Constitution itself.<\/p>\n\n\n\n<p>For gun owners, the significance is hard to miss.<\/p>\n\n\n\n<p>This isn\u2019t a private challenge or a gun-rights group filing suit.  It\u2019s the federal government accusing a local police department of systematically violating the Second Amendment.<\/p>\n\n\n\n<p>The DOJ also encouraged current or prospective D.C. <a href=\"https:\/\/gunsamerica.com\/digest\/ak-47-hog-blaster\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-sues-d-c-police-over-ar-15-ban\" title=\"DOJ Sues D.C. Police Over AR-15 Ban\" data-wpil-monitor-id=\"2201\">gun<\/a> owners who believe they are being unlawfully blocked from owning or registering a firearm to submit complaints directly to the Civil Rights Division.<\/p>\n\n\n\n<p>Seventeen years after <em>Heller<\/em>, the fight over what the Second Amendment actually means in the nation\u2019s capital is far from over. This time, however, the federal government is on the side of enforcement.
