And a lot of gun owners scratching their heads.<\/p>\n\n\n\n<p>President Donald Trump signed an executive order <a href=\"https:\/\/abcnews.go.com\/Health\/trumps-executive-order-marijuana-medical-research\/story?id=128516041\" target=\"_blank\" class=\"clickTracking\" campaign=\"how-pot-reclassification-affects-gun-owners\" title=\"How Pot Reclassification Affects Gun Owners\">reclassifying<\/a> cannabis from a Schedule I controlled substance to Schedule III, a move that opens the door to expanded medical research and signals a shift in federal drug policy.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Does Trump&#039;s Reclassification of Cannabis Mean Anything to Gun Owners?\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/19nQv4C9c-c?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>But if you\u2019re a gun owner, or hoping to become one, William Kirk, president of <a href=\"https:\/\/www.washingtongunlaw.com\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"how-pot-reclassification-affects-gun-owners\" title=\"How Pot Reclassification Affects Gun Owners\">Washington Gun Law<\/a>, says the short answer is simple:<\/p>\n\n\n\n<p><strong><em>This changes nothing for firearms possession.<\/em><\/strong><\/p>\n\n\n\n<p>In a recent breakdown, Kirk explains that while cannabis has been reclassified, it has not been legalized at the federal level. That distinction matters because under federal law, marijuana remains an unlawful controlled substance, regardless of what individual states allow.<\/p>\n\n\n\n<p>The problem lives squarely inside 18 U.S.C. \u00a7 922(g)(3), which prohibits anyone who is an \u201cunlawful user of or addicted to any controlled substance\u201d from possessing firearms. And here\u2019s the key point: that statute applies to all controlled substances, whether they\u2019re Schedule I, II, III, IV, or V.<\/p>\n\n\n\n<p>So moving cannabis to Schedule III doesn\u2019t remove it from the list.  It just moves it around on the list.<\/p>\n\n\n\n<p>Kirk also points to the real-world choke point for gun buyers: ATF Form 4473.<\/p>\n\n\n\n<p>Question 21F asks whether the buyer is an unlawful user of marijuana or any other controlled substance. Right below it is a warning that makes the federal position crystal clear: marijuana remains illegal under federal law, even if your state says otherwise.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-free-sbrs-are-coming-a-horrible-idea\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/sbr-vs-braced-pistol-read-this-first\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"how-pot-reclassification-affects-gun-owners\" title=\"How Pot Reclassification Affects Gun Owners\">Free SBRs Are Coming! A Horrible Idea<\/a><\/h2>\n\n\n\n<p>That warning is still accurate after reclassification.  And that means the form isn\u2019t changing.<\/p>\n\n\n\n<p>Gun owners are left with what Kirk calls a Hobson\u2019s choice. Answer \u201cyes,\u201d and the firearm transfer stops immediately. Answer \u201cno\u201d while knowingly using cannabis, and you\u2019ve potentially committed a federal felony by lying on the form.<\/p>\n\n\n\n<p>Reclassification does bring benefits.  Mainly, allowing more federally funded research into potential medical uses of cannabis. But it does not legalize recreational use, does not legalize medical use federally, and does not lift the firearm prohibition.<\/p>\n\n\n\n<p>According to Kirk, there are only two ways this situation changes:<\/p>\n\n\n\n<p>Congress amends the Gun Control Act of 1968, or the ATF radically reinterprets \u00a7 922(g)(3). <\/p>\n\n\n\n<p>Both outcomes, he says, are highly unlikely in the near term.<\/p>\n\n\n\n<p>Bottom line: if you\u2019re a lawful gun owner who doesn\u2019t use cannabis, this executive order means nothing to you. And if you do use cannabis, the legal risk hasn\u2019t changed one bit.<\/p>\n\n\n\n<p>As Kirk puts it, education (not celebration) is the real takeaway here.
