This time, challenging one of the most extreme consequences of modern gun law: permanent disarmament over a long-past, nonviolent mistake.<\/p>\n\n\n\n<p>On December 17, SAF and several partner organizations filed an amicus <a href=\"https:\/\/saf.org\/wp-content\/uploads\/2025\/12\/Williams-amicus-12.17.25.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-lifetime-gun-ban-dui\" title=\"SAF Challenges Lifetime Gun Ban Over Old DUI\">brief<\/a> with the U.S. Court of Appeals for the Third Circuit in <em>Williams v. Attorney General of the United States<\/em>, a case questioning whether the federal government can strip someone of their <a href=\"https:\/\/gunsamerica.com\/digest\/holiday-gift-guide-hunt-perfect-gift-hunter-life\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-lifetime-gun-ban-dui\" title=\"SAF Challenges Lifetime Gun Ban Over Old DUI\" data-wpil-monitor-id=\"2119\">gun rights for life<\/a> based solely on a decades-old misdemeanor DUI conviction.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Restoring Gun Rights - It&#039;s Complicated!\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/6c1JS1P5Yek?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>The plaintiff, Edward Williams, was convicted of DUI more than 20 years ago. No one was injured. No property was damaged. And there\u2019s no allegation, past or present, of firearms misuse. Yet under federal law, that old conviction still triggers a lifetime firearm ban.<\/p>\n\n\n\n<p>According to SAF, that result flatly conflicts with the Supreme Court\u2019s post-<em><a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-lifetime-gun-ban-dui\" title=\"SAF Challenges Lifetime Gun Ban Over Old DUI\">Bruen<\/a><\/em> framework and with American legal tradition.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-free-sbrs-are-coming-a-horrible-idea\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/sbr-vs-braced-pistol-read-this-first\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-lifetime-gun-ban-dui\" title=\"SAF Challenges Lifetime Gun Ban Over Old DUI\">Free SBRs Are Coming! A Horrible Idea<\/a><\/h2>\n\n\n\n<p>\u201cThe government\u2019s position defies <em>Bruen<\/em> and <em>Rahimi<\/em>,\u201d said SAF Director of Legal Research and Education Kostas Moros, arguing that history only supports temporary restrictions tied to present danger, not permanent bans for long-past conduct.<\/p>\n\n\n\n<p>The brief leans heavily on history\u2014and that\u2019s exactly the point.<\/p>\n\n\n\n<p>From the Founding through Reconstruction, laws addressing alcohol and firearms focused on current intoxication, not lifetime punishment. Colonial and 19th-century laws barred <a href=\"https:\/\/gunsamerica.com\/digest\/hunt365-june-backcountry-carry-solution-sig-sauer-p320-xten-10mm\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-lifetime-gun-ban-dui\" title=\"SAF Challenges Lifetime Gun Ban Over Old DUI\" data-wpil-monitor-id=\"2118\">carrying firearms<\/a> while drunk, not owning guns forever because someone once drank irresponsibly years earlier.<\/p>\n\n\n\n<p>That distinction matters under <em>Bruen<\/em>. In <em><a href=\"https:\/\/www2.ca3.uscourts.gov\/opinarch\/212835pen1.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-lifetime-gun-ban-dui\" title=\"SAF Challenges Lifetime Gun Ban Over Old DUI\">Range v. Attorney General<\/a><\/em>, the court rejected categorical disarmament untethered from present dangerousness. SAF argues <em>Williams<\/em> fits squarely within that precedent: a nonviolent offense, decades in the past, with no evidence of ongoing risk.<\/p>\n\n\n\n<p><a href=\"https:\/\/gunsamerica.com\/digest\/saf-files-suit-to-protect-4a-rights-of-high-school-gun-owner\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-lifetime-gun-ban-dui\" title=\"SAF Challenges Lifetime Gun Ban Over Old DUI\" data-wpil-monitor-id=\"2117\">SAF founder Alan Gottlieb<\/a> called the case a clear example of unconstitutional overreach.  He warned that federal gun bans have drifted far beyond anything grounded in history or common sense.<\/p>\n\n\n\n<p>If the Third Circuit rules for Williams, the implications could be significant.
