Read full <a href=\"https:\/\/gunsamerica.com\/digest\/carrying-the-taser-pulse\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-fbrief-challenging-nyc-stun-gun-ban\" title=\"SAF Files Reply Brief Challenging NYC Stun Gun Ban\">review<\/a>.  <\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>New York City continues to prohibit private citizens from possessing stun guns and similar electronic self-defense devices, tools that are legal and commonly used across much of the United States. <\/p>\n\n\n\n<p><a href=\"https:\/\/saf.org\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-fbrief-challenging-nyc-stun-gun-ban\" title=\"SAF Files Reply Brief Challenging NYC Stun Gun Ban\">SAF<\/a> is joined in the case by five individual plaintiffs and the Firearms Policy Coalition, arguing that the city\u2019s outright ban violates the Second Amendment.<\/p>\n\n\n\n<p>\u201cCourts all over the country have struck down bans just like this one as plainly unconstitutional,\u201d said SAF Director of Legal Operations Bill Sack. <\/p>\n\n\n\n<p>\u201cBut the District Court in this case found a way to uphold New York City\u2019s ban by improperly placing the \u2018common use\u2019 part of the analysis in the plain text portion of the test,&#8221; he continued.  &#8220;This error not only ignores express instructions to the contrary from the Supreme Court but also shifts the burden from the government to prove their ban is constitutional, to the Plaintiffs themselves to prove their arms are protected. Heller<\/em> and <em>New York State Rifle &amp; Pistol Association v. Bruen<\/em>, writing that \u201cThe City\u2019s defense of the decision\u2026 fundamentally is built on a misunderstanding of where the \u2018common use\u2019 principle established by <em>Heller<\/em> fits into the Court\u2019s clarification and elaboration of <em>Heller\u2019s<\/em> methodology in <em>Bruen<\/em>.\u201d<\/p>\n\n\n\n<p>SAF Founder and Executive Vice President Alan M. Gottlieb criticized the city\u2019s position.<\/p>\n\n\n\n<p>\u201cThe City\u2019s position here would be laughable if it weren\u2019t so frustrating and people\u2019s safety wasn\u2019t at risk. Their argument fundamentally is that electronic arms like tasers are so \u2018unusually dangerous\u2019 that they aren\u2019t even \u2018arms\u2019 as contemplated by the Second Amendment, and the legal analysis they propose to arrive at that conclusion is just plain wrong.\u201d<\/p>\n\n\n\n<p>The appeal seeks to overturn the District Court\u2019s ruling and reaffirm that New Yorkers have the same right to possess less-lethal defensive tools as citizens in other states.<\/p>\n\n\n\n<p class=\"has-text-align-left\" style=\"font-size:24px\"><strong><em>*** <a
