{"id":22484,"date":"2014-07-28T12:01:44","date_gmt":"2014-07-28T16:01:44","guid":{"rendered":"http:\/\/www.gunsamerica.com\/blog\/?p=22484"},"modified":"2014-07-28T12:01:44","modified_gmt":"2023-08-17T19:59:09","slug":"d-c-carry-ban-ruled-unconstitutional-federal-judge","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/d-c-carry-ban-ruled-unconstitutional-federal-judge\/","title":{"rendered":"D.C. carry ban ruled unconstitutional by Federal Judge"},"content":{"rendered":"<p>This past Saturday a federal judge overturned the District of Columbia&#8217;s ban on the carry of firearms outside the home.  <\/p>\n<p>In his 19-page ruling, U.S. District Judge Frederick Scullin Jr. essentially said that due to recent landmark Supreme Court ruling, District of Columbia v. Heller (2008) and McDonald v. Chicago (2010), its beyond question that the right to keep and bear arms extends beyond the home.  <\/p>\n<p>\u201cIn light of Heller, McDonald, and their progeny, there is no longer any basis on which this Court can conclude that the District of Columbia\u2019s total ban on the public carrying of ready-to-use handguns outside the home is constitutional under any level of scrutiny,\u201d wrote Scullin.  <\/p>\n<p>Attorney Alan Gura, representative for the five law-abiding plaintiffs who filed their suit way back in 2009, celebrated the victory but was quick to point out that an appeal from the District was likely.  <\/p>\n<p>\u201cWe won,\u201d Gura, the lead attorney for the Second Amendment Foundation, told Emily Miller of <a href=\"https:\/\/www.foxnews.com\/politics\/2014\/07\/27\/emily-miller-federal-judge-rules-dc-ban-on-gun-carry-rights-unconstitutional\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"d-c-carry-ban-ruled-unconstitutional-federal-judge\" title=\"D.C. carry ban ruled unconstitutional by Federal Judge\" target=\"_blank\" rel=\"noopener\">Fox News<\/a>.  \u201cI\u2019m very pleased with the decision that the city can\u2019t forbid the exercise of a fundamental constitutional right.&#8221;<\/p>\n<p>\u201cWe\u2019ll be happy to keep the fight going,&#8221;
