Lopez: The 'Vampire Clause' Case\" data-wpil-monitor-id=\"1215\">Rifle &amp; Pistol<\/a> Association v. Bruen<\/em>, states could no longer deny <a href=\"https:\/\/gunsamerica.com\/digest\/springfield-armory-hellcat-380\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-wolford-v-lopez-vampire-clause-case\" title=\"SCOTUS Takes Up Wolford v. Lopez: The 'Vampire Clause' Case\" data-wpil-monitor-id=\"1213\">concealed carry<\/a> permits to law-abiding citizens based on \u201cgood cause.\u201d <\/p>\n\n\n\n<p>Hawaii, like New York, responded with new restrictions that effectively banned carry in most places: government buildings, parks, beaches, banks, and even private businesses.<\/p>\n\n\n\n<p>One section stood out: the Vampire Clause, which forbids carrying on private property open to the public unless the owner gives explicit permission.<\/p>\n\n\n\n<p>As GOA&#8217;s <em>Law and Ammo<\/em> host Phil explained:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cIt\u2019s like the vampire myth \u2014 you can\u2019t come in unless you\u2019re invited. But instead of bloodsuckers, it\u2019s gun owners asking permission to enter a gas station, grocery store, or restaurant with their <a href=\"https:\/\/gunsamerica.com\/digest\/cz-shadow-2-carry-full-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-wolford-v-lopez-vampire-clause-case\" title=\"SCOTUS Takes Up Wolford v. Lopez: The 'Vampire Clause' Case\" data-wpil-monitor-id=\"1214\">carry<\/a> pistol.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>In short, <a href=\"https:\/\/gunsamerica.com\/digest\/new-york-law-mandating-background-checks-for-ammo-brutalizing-gun-shops-gun-owners\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-wolford-v-lopez-vampire-clause-case\" title=\"SCOTUS Takes Up Wolford v. Lopez: The 'Vampire Clause' Case\" data-wpil-monitor-id=\"1216\">lawful gun owners could be forced to ask every shop<\/a> and restaurant owner for permission just to go about their day armed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-circuit-split-2a-meets-the-courts\"><strong>The Circuit Split: 2A Meets the Courts<\/strong><\/h2>\n\n\n\n<p>The Second Circuit Court of Appeals already struck down New York\u2019s version of the Vampire Clause in <em>Antonyuk v. Chiumento<\/em>, a lawsuit backed by Gun Owners of America (GOA).<\/p>\n\n\n\n<p>But the Ninth Circuit Court of Appeals, one of the most restrictive circuits on gun rights, went the opposite direction \u2014 upholding Hawaii\u2019s version as constitutional.<\/p>\n\n\n\n<p><strong>SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/smith-wesson-940-review-9mm-revolver\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-wolford-v-lopez-vampire-clause-case\" title=\"SCOTUS Takes Up Wolford v. Lopez: The 'Vampire Clause' Case\">S&amp;W 940 Review: 9mm J Frame That Runs Hard<\/a><\/strong><\/p>\n\n\n\n<p>That conflict between circuits is why the Supreme Court took <em>Wolford v. Lopez<\/em> up for review. One of the central questions before the Court reads:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cWhether Hawaii may presumptively prohibit the <a href=\"https:\/\/gunsamerica.com\/digest\/top-handguns-for-left-handed-shooters\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-wolford-v-lopez-vampire-clause-case\" title=\"SCOTUS Takes Up Wolford v. Lopez: The 'Vampire Clause' Case\" data-wpil-monitor-id=\"1212\">carry of handguns by licensed concealed<\/a> carry permit holders on private property open to the public unless the property owner affirmatively gives express permission.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>In the <em>Antonyuk<\/em> case, the Second Circuit said clearly:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cPrivate property owners may decide to exclude people from their property. But that power resides with the property owner, not the government.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-far-can-states-go-after-bruen\"><strong>How Far Can States Go After Bruen?<\/strong><\/h2>\n\n\n\n<p>Since <em>Bruen<\/em>, several states have tried to sidestep the ruling by labeling most of their territory \u201csensitive\u201d or \u201crestricted.\u201d<\/p>\n\n\n\n<p>Hawaii\u2019s carry law bans firearms in roughly 96% of publicly accessible land in Maui County, according to Judge VanDyke\u2019s dissent in the Ninth Circuit decision. He wrote that the law \u201ceffectively nullified the Second Amendment rights of millions of Hawaiians.\u201d<\/p>\n\n\n\n<p>Other states followed suit:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Maryland<\/strong> passed <strong>SB1<\/strong> in 2023, which defaults to banning public carry without explicit consent.<\/li>\n\n\n\n<li><strong>California\u2019s SB2<\/strong> added similar restrictions, requiring signs for any business that <em>allows<\/em> carry.<\/li>\n<\/ul>\n\n\n\n<p><em>Wolford v. Lopez<\/em> could decide whether those \u201cno carry by default\u201d rules survive.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-goa-s-role-and-what-s-next\"><strong>GOA\u2019s Role and What\u2019s Next<\/strong><\/h2>\n\n\n\n<p>Gun Owners of America helped set up this legal clash through its earlier victory in <em>Antonyuk v. James<\/em> (New York\u2019s case). <em>Wolford\u2019s<\/em> petition cites <em><a href=\"https:\/\/www.scotusblog.com\/cases\/case-files\/antonyuk-v-james\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-wolford-v-lopez-vampire-clause-case\" title=\"SCOTUS Takes Up Wolford v.
