Hemani<\/em>, a challenge to 18 U.S.C. \u00a7 922(g)(3) \u2014 the federal ban on firearm possession by \u201cunlawful users\u201d of controlled substances. <\/p>\n\n\n\n<p>On paper, that sounds like the kind of <em>Bruen<\/em>-era opportunity gun owners should cheer. In reality? There\u2019s a long history of disarming people who are actively intoxicated (think \u201cno guns while you\u2019re drunk&#8221;). <\/p>\n\n\n\n<p>But there isn\u2019t a clear historical tradition of a 24\/7\/365 ban on gun ownership for anyone who uses a disfavored substance at any point. That\u2019s an especially big deal in the dozens of states where adults can legally use marijuana under state law while federal law still says it\u2019s illegal.<\/p>\n\n\n\n<p>The Fifth Circuit looked at those history-and-tradition questions and said the statute was unconstitutional as applied to <em><a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-1234\/362144\/20250602174403309_HemaniPetition.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-takes-up-marijuana-case\" title=\"Supreme Court Takes Up Marijuana Case And That Might Be Bad News!\">Hemani<\/a><\/em>. The Department of Justice asked the Supreme Court to reverse \u2014 and the Court said, \u201cWe\u2019ll hear it.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-why-gun-owners-shouldn-t-assume-this-is-a-win\">Why Gun Owners Shouldn\u2019t Assume This Is a Win<\/h2>\n\n\n\n<p>Two big reasons.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-1-bad-facts-make-bad-law\">1) \u201cBad facts make bad law.\u201d<\/h3>\n\n\n\n<p>This isn\u2019t a clean \u201cstate-legal marijuana cardholder wants to keep a home-defense pistol\u201d test case. According to the government\u2019s filings summarized by William Kirk of <a href=\"https:\/\/www.washingtongunlaw.com\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-takes-up-marijuana-case\" title=\"Supreme Court Takes Up Marijuana Case And That Might Be Bad News!\">Washington Gun Law<\/a> (see video above), <em>Hemani<\/em> comes wrapped in ugly facts: alleged ties and sympathies the feds highlight, plus admissions of regular drug use and drugs recovered during a search alongside a handgun. Even if some of that is disputed, it\u2019s exactly the kind of record that tempts courts to announce broad, government-friendly rules. If SCOTUS wants to draw a line that keeps \u00a7922(g)(3) largely intact, this is the perfect vehicle to do it.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-2-the-bandwidth-problem\">2) The bandwidth problem<\/h3>\n\n\n\n<p>The Court already granted another firearms case this term (<em><a href=\"https:\/\/www.scotusblog.com\/cases\/case-files\/wolford-v-lopez\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-takes-up-marijuana-case\" title=\"Supreme Court Takes Up Marijuana Case And That Might Be Bad News!\">Wolford v. Lopez<\/a><strong>,<\/strong><\/em> targeting Hawaii\u2019s \u201csensitive places\u201d carry restrictions). Historically, SCOTUS doesn\u2019t take many Second Amendment cases in a single term. But <em>Hemani<\/em> is a risky hill to fight on.
