Back in 1934, lawmakers admitted they didn\u2019t have the authority to ban certain guns outright \u2014 so they taxed them instead.<\/p>\n\n\n\n<p>But the game changed on July 4, 2025, when President Trump (under the \u201c<a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/1\/text\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-gun-groups-sue-atf-over-nfa\" title=\"Texas Gun Groups Sue ATF Over NFA\">One Big Beautiful Bill Act<\/a>\u201d) signed a provision eliminating those NFA taxes for everything except machine guns and destructive devices.<\/p>\n\n\n\n<p>That means you no longer pay a dime in \u201cmaking\u201d or \u201ctransfer\u201d tax for suppressors, short-barreled rifles, short-barreled shotguns, or any-other-weapons (AOWs) \u2014 yet you\u2019re still required to register them, submit fingerprints, home addresses, and wait months for ATF approval.<\/p>\n\n\n\n<p>The plaintiffs say that makes the entire registration scheme unconstitutional.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-protected-under-bruen\">Protected Under <em>Bruen<\/em><\/h2>\n\n\n\n<p>The second major claim hits from another angle \u2014 the Second Amendment. The suit argues that suppressors, short-barreled rifles, short-barreled shotguns, and any-other-weapons (AOWs) are all \u201carms\u201d in common lawful use, not \u201cdangerous and unusual\u201d items outside constitutional protection.<\/p>\n\n\n\n<p>Drawing on <em>Heller<\/em> and <em>Bruen<\/em>, the plaintiffs say the government has no historical tradition of requiring Americans to register protected arms or be fingerprinted to own them. <\/p>\n\n\n\n<p>Suppressors reduce hearing damage, SBRs and SBSs are common for hunting and home defense, and AOWs (like compact, smooth-bore pistols) are simply another category of bearable firearms.<\/p>\n\n\n\n<p><strong>SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/the-wonderful-world-of-wonder-nines\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-gun-groups-sue-atf-over-nfa\" title=\"Texas Gun Groups Sue ATF Over NFA\">The Wonderful World of the Top 5 Wonder Nines<\/a><\/strong><\/p>\n\n\n\n<p>Suppressors, it notes, reduce hearing damage, improve accuracy, and cut recoil, and they\u2019re legal in 42 states. The filing even points out that the U.S. Marines and countless police departments use them for hearing protection.<\/p>\n\n\n\n<p>The suit also cites ATF\u2019s own data showing more than 4.5 million registered suppressors in circulation, with virtually no criminal misuse.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-human-side-texans-pushed-out-by-paperwork\">The Human Side: Texans Pushed Out by Paperwork<\/h2>\n\n\n\n<p>Three individual plaintiffs \u2014 John Jensen, Jeremy Neusch, and David Smith \u2014 describe long waits, invasive fingerprinting, and personal privacy concerns that have deterred them from buying or transferring suppressors and SBRs.<\/p>\n\n\n\n<p>One plaintiff, Jensen, even cited a spinal injury and hearing loss as reasons he needs suppressors and a short-barreled rifle for safer, lower-recoil shooting \u2014 but says he won\u2019t risk the felony penalties of the NFA to get them.<\/p>\n\n\n\n<p>The business plaintiff, Hot Shots Custom LLC, says the red tape costs them money and customers every month.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-the-lawsuit-seeks\">What the Lawsuit Seeks<\/h2>\n\n\n\n<p>The plaintiffs want the court to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Declare the NFA unconstitutional for all firearms that are no longer taxed under the \u201cOne Big Beautiful Bill.\u201d<\/li>\n\n\n\n<li>Strike down the NFA\u2019s registration and enforcement mechanisms for suppressors and short-barreled rifles.<\/li>\n\n\n\n<li>Bar the ATF and DOJ from enforcing any related regulations.<\/li>\n<\/ul>\n\n\n\n<p>The case is officially <em><a href=\"https:\/\/shared.nrapvf.org\/sharedmedia\/1512119\/2025-jensen-nfa-suit.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"texas-gun-groups-sue-atf-over-nfa\" title=\"Texas Gun Groups Sue ATF Over NFA\">Jensen et al. v.
