McDaniels. <\/p>\n\n\n\n<p>The Citizens Committee for the Right to Keep and Bear Arms (CCRKBA) hailed the unanimous <a href=\"https:\/\/1dca.flcourts.gov\/content\/download\/2457057\/opinion\/Opinion_2023-0533.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-appeals-court-strikes-down-open-carry-ban\" title=\"Florida Appeals Court Strikes Down Open Carry Ban\">decision<\/a> as a \u201chuge victory\u201d for Florida gun owners.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"What gun owners should know after court strikes down Florida\u2019s open carry ban\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/A-avMQpdmuE?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>McDaniels was arrested on Independence Day 2022 for openly carrying a sidearm at a Pensacola intersection. He was later convicted and sentenced to probation and community service under <a href=\"https:\/\/gunsamerica.com\/digest\/goa-sues-florida-over-open-carry-ban\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-appeals-court-strikes-down-open-carry-ban\" title=\"Florida Appeals Court Strikes Down Open Carry Ban\" data-wpil-monitor-id=\"52\">Florida\u2019s open carry ban<\/a>. <\/p>\n\n\n\n<p>Attorneys Eric Friday and Chris Crawford, working with Florida Carry and with <a href=\"https:\/\/gunsamerica.com\/digest\/nearly-half-of-americas-attorneys-general-support-gun-owners-of-america-on-bump-stock-scotus-petition\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-appeals-court-strikes-down-open-carry-ban\" title=\"Florida Appeals Court Strikes Down Open Carry Ban\" data-wpil-monitor-id=\"53\">support from Gun Owners of America and attorney<\/a> Don Kilmer, appealed the case.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-austin-officer-shot-in-zilker-park-gunfight-homeowner-later-stops-suspect\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/austin-officer-shot-in-zilker-park-gunfight\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-appeals-court-strikes-down-open-carry-ban\" title=\"Florida Appeals Court Strikes Down Open Carry Ban\">Austin Officer Shot in Zilker Park Gunfight; Homeowner Later Stops Suspect<\/a><\/h2>\n\n\n\n<p>In Wednesday\u2019s opinion, Judge Stephanie W. Ray, writing for the First District Court of Appeals with concurrence from Judges Lori S. Rowe and M. Kemmerly Thomas, wrote: <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cFlorida law generally makes it a crime for an ordinary, law-abiding, adult citizen to carry a firearm openly in public. Stanley Victor McDaniels was convicted under that law, and he now appeals. He contends that this open carry ban is incompatible with the Second Amendment\u2019s guarantee of the right to bear arms. Guided by the Constitution\u2019s text and this Nation\u2019s historical tradition of firearm regulation, we agree.
