It wasn\u2019t a choice. It was coercion.<\/p>\n\n\n\n<p>That rule, enforced through Section 11E of the <a href=\"https:\/\/gunsamerica.com\/digest\/genderqueers-non-binary-option-form-4473\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"should-pot-smokers-own-guns\" title=\"Should Pot Smokers Own Guns?\">ATF\u2019s Form 4473<\/a>, meant tens of thousands of patients were barred from exercising their Second Amendment rights. <\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Should Marijuana Smokers Own Guns?\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/rE2p2pabevw?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Answer \u201cyes\u201d on the form, and you were instantly denied. Lie about it, and you risked federal prosecution. Even worse, the restriction didn\u2019t just block new gun sales \u2014 it meant existing gun owners with medical marijuana cards were technically barred from keeping the firearms they already owned.<\/p>\n\n\n\n<p>The message from the government was clear: if you treat your condition with cannabis, you\u2019re suddenly too \u201cdangerous\u201d to be trusted with a gun.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-court-s-ruling\">The Court\u2019s Ruling<\/h2>\n\n\n\n<p>That changed in Florida when a federal court <a href=\"https:\/\/floridaphoenix.com\/briefs\/court-rules-in-favor-of-florida-medical-cannabis-patients-who-want-to-possess-firearms\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"should-pot-smokers-own-guns\" title=\"Should Pot Smokers Own Guns?\">ruled<\/a> that the prohibition violated the Constitution. It recognized that alcohol \u2014 long linked to domestic violence and deadly crime \u2014 has never been treated this way. <\/p>\n\n\n\n<p>As <a href=\"https:\/\/gunsamerica.com\/digest\/nra-finally-hires-a-cool-black-guy-great-video-meet-colion-noir\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"should-pot-smokers-own-guns\" title=\"Should Pot Smokers Own Guns?\" data-wpil-monitor-id=\"131\">Colion Noir<\/a> noted, you can drink a handle of whiskey every night, pass out drunk, and as long as you check \u201cno\u201d on a form, you can still legally purchase a firearm. Yet a cancer patient lighting up a prescribed joint was branded unfit for ownership. That\u2019s not safety. That\u2019s hypocrisy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-rights-aren-t-popularity-contests\">Rights Aren\u2019t Popularity Contests<\/h2>\n\n\n\n<p>Noir made it plain: this was never about safety. It was about control. He doesn\u2019t like marijuana \u2014 hates the smell, hates the culture around it \u2014 but that\u2019s irrelevant. <\/p>\n\n\n\n<p>Rights don\u2019t hinge on whether you like the people exercising them. A right that disappears because of your medicine isn\u2019t a right at all. It\u2019s a <a href=\"https:\/\/gunsamerica.com\/digest\/governor-signs-colorados-permission-slip-gun-ban\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"should-pot-smokers-own-guns\" title=\"Should Pot Smokers Own Guns?\" data-wpil-monitor-id=\"130\">permission slip<\/a>.<\/p>\n\n\n\n<p>The ruling brings much-needed consistency. If you\u2019re high or drunk, you already can\u2019t legally carry. That\u2019s common sense. But banning people altogether for what\u2019s in their bloodstream off-duty was bureaucratic overreach.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-why-it-matters\">Why It Matters<\/h2>\n\n\n\n<p>This decision matters because it sets a precedent. If the government can take away your rights over cannabis, what\u2019s next? ADHD medication? Insulin? Any prescription that bureaucrats decide might impair judgment? The slippery slope is obvious, and the court\u2019s pushback is a major correction.<\/p>\n\n\n\n<p>For the 2A community, it\u2019s another example of why vigilance matters. Politicians and agencies will always look for new ways to chip away at rights.
