That\u2019s a head-scratcher.<\/p>\n\n\n\n<p>Here\u2019s the scoop: early in Biden\u2019s term, ATF launched a policy that triggered automatic revocation of federal firearms dealer licenses\u2014even for minor, unintentional paperwork errors. <\/p>\n\n\n\n<p>Dealers found themselves losing their livelihoods over clerical slips. In 2023 they filed lawsuits on behalf of Morehouse Enterprises in North Dakota and Kill &amp; Tactical in Florida, challenging the policy\u2019s constitutionality. <\/p>\n\n\n\n<p>As these cases progressed, ATF would quietly drop the revocation, only to ask courts to dismiss the case as &#8220;moot&#8221;\u2014effectively playing whack-a-mole with legal challenges.<\/p>\n\n\n\n<p>They didn\u2019t back down. GOA took the fight all the way. <\/p>\n\n\n\n<p>In one case, ATF actually argued the policy didn\u2019t implicate the <a href=\"https:\/\/gunsamerica.com\/digest\/federal-judge-upholds-maryland-assault-weapons-ban-ruling-fall-outside-second-amendment\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-in-rebellion-against-the-trump-admin\" title=\"DOJ in Rebellion Against the Trump Admin?\"  data-wpil-monitor-id=\"144\">Second Amendment or violate federal<\/a> law. They claimed that dealers have no constitutional right to sell firearms\u2014something the White House publicly disputes. That kind of legal contortion could allow a ban on all gun sales, blinking out the Second Amendment entirely.<\/p>\n\n\n\n<p>Then Trump won again and reversed course, issuing executive orders that dismantled zero tolerance. Surprisingly, they\u2019re doubling down on defense of the policy. <\/p>\n\n\n\n<p>GOA now calls DOJ\u2019s position an &#8220;open rebellion&#8221; against the Trump administration. DOJ lawyers still argue: (1) the policy didn&#8217;t cause any injury; (2) revocations weren\u2019t automatic; (3) the Second Amendment doesn&#8217;t protect dealers&#8217; commercial activity. <\/p>\n\n\n\n<p>Yet ATF itself has admitted the policy was automatic and that minor mistakes punished honest dealers. These contradictions are all laid out in GOA&#8217;s latest brief at the D.C. Circuit Court.<\/p>\n\n\n\n<p>GOA\u2019s concern? <\/p>\n\n\n\n<p>Without a binding court judgment declaring the policy unconstitutional, a future anti-gun administration could simply reinstate zero tolerance\u2014again killing small businesses with a stroke. That\u2019s not theoretical: that\u2019s the reality GOA wants to stop.<\/p>\n\n\n\n<p>It\u2019s a stark illustration of how executive policy and court fights can pull in different directions\u2014even under the same administration. DOJ should be defending Trump\u2019s <a href=\"https:\/\/gunsamerica.com\/digest\/trump-declares-support-for-gun-owners\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"doj-in-rebellion-against-the-trump-admin\" title=\"DOJ in Rebellion Against the Trump Admin?\">reversal<\/a>, not doubling down on the prior regime\u2019s abuses. Instead, dealers remain at risk.<\/p>\n\n\n\n<p><strong>Why this matters:<\/strong> If zero-tolerance policies stand without a legal check, any future administration could weaponize the ATF at will.
