Bonta<\/a><\/em>, has been winding through the courts since 2018. The court ruled 2-1 that California\u2019s <a href=\"https:\/\/gunsamerica.com\/digest\/nssf-praises-states-for-record-submission-of-disqualifying-mental-health-records-to-background-check-system\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"newsom-melts-down-after-court-smacks-down-ammo-law\" title=\"Newsom Melts Down After Court Smacks Down Ammo Law\" data-wpil-monitor-id=\"259\">background check system<\/a> for ammunition purchases imposes unconstitutional burdens on law-abiding citizens. Judge Sandra S. Ikuta, writing for the majority, noted that the law \u201cmeaningfully constrains California residents\u2019 right to keep and bear arms.\u201d<\/p>\n\n\n\n<p>Cue the outrage from Newsom.<\/p>\n\n\n\n<p>Calling the decision a \u201cslap in the face,\u201d Newsom fumed that it disrespected California voters and threatened public safety. \u201cCalifornians voted to require background checks on ammunition and their voices should matter,\u201d he <a href=\"https:\/\/www.kget.com\/news\/state-news\/newsom-responds-after-court-blocks-state-ammo-background-check-law\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"newsom-melts-down-after-court-smacks-down-ammo-law\" title=\"Newsom Melts Down After Court Smacks Down Ammo Law\">said<\/a>, ignoring the part where constitutional rights are not subject to a popularity contest.<\/p>\n\n\n\n<p>This sudden return to anti-gun rhetoric is quite the reversal from last week, when Newsom sat on Shawn Ryan\u2019s podcast, happily accepting a <a href=\"https:\/\/gunsamerica.com\/search?keyword=SIG%20Sauer%20pistol\" target=\"_blank\" class=\"clickTracking\" campaign=\"newsom-melts-down-after-court-smacks-down-ammo-law\" title=\"Newsom Melts Down After Court Smacks Down Ammo Law\">SIG Sauer pistol<\/a> and claiming he supports the Second Amendment. That lasted all of\u2026 five days.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-ar-15-armorer-s-wrench-get-one\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/ar-15-armorers-wrench-get-one\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"newsom-melts-down-after-court-smacks-down-ammo-law\" title=\"Newsom Melts Down After Court Smacks Down Ammo Law\">AR-15 Armorer\u2019s Wrench: Get One<\/a><\/h2>\n\n\n\n<p>Alan Gottlieb, Chairman of the Citizens Committee for the Right to Keep and Bear Arms (CCRKBA), wasn\u2019t buying it.<\/p>\n\n\n\n<p>\u201cNewsom\u2019s so-called newly found support for the Second Amendment vanished overnight,\u201d said Gottlieb. \u201cHe is a lying politician who can\u2019t be trusted. We warned at the time that his pro-gun pronouncement needed affirmation, and he has failed to deliver, just as we expected.\u201d<\/p>\n\n\n\n<p>Gottlieb also reminded Newsom\u2014and anyone eyeing a 2028 presidential run\u2014that the Bill of Rights doesn\u2019t come with a ballot box override.<\/p>\n\n\n\n<p>\u201cWe\u2019ve got some bad news for Gavin Newsom,\u201d he said. \u201cConstitutional rights are not up to a public vote, which the 9th Circuit panel recognizes, even if he doesn\u2019t. Neither are rights subject to essentially getting permission from the state, via a background check, in order for citizens to exercise them.\u201d<\/p>\n\n\n\n<p>Judge Ikuta\u2019s opinion called out the law\u2019s fees, delays, and the broad scope of transactions it covered. The court ultimately upheld a lower court\u2019s permanent injunction, scrapping the law as a whole.<\/p>\n\n\n\n<p>For now, California gun owners can breathe a little easier.
