id=\"h-\"><\/h2>\n\n\n\n<p>The Second Amendment Foundation (SAF) is throwing its weight behind a groundbreaking Department of Justice (DOJ) proposal that would finally reopen a long-closed door for nonviolent Americans seeking to restore their federal gun rights.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"768\" src=\"https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2025\/03\/mossberg-pistol-black-1024x768.jpg\" alt=\"mossberg pistol\" class=\"wp-image-213766\" 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>The proposed <a href=\"https:\/\/www.justice.gov\/ag\/media\/1408436\/dl\" target=\"_blank\" class=\"clickTracking\" campaign=\"should-nonviolent-felons-have-rights-restored\" title=\"Should Nonviolent Felons Have Rights Restored?\">rule<\/a>, published July 22 in the <em>Federal Register<\/em>, outlines a new application process for individuals prohibited from firearm ownership under federal law to seek relief from that disability. <\/p>\n\n\n\n<p>According to DOJ estimates, over one million applicants could take advantage of this restoration program in its first year alone.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cHaving litigated as-applied challenges for a number of disenfranchised individuals, it\u2019s good to see that this proposed rule provides a pathway to restore their rights,\u201d said SAF Executive <a href=\"https:\/\/gunsamerica.com\/digest\/vote-adam-kraut-76th-seat-nra-board-directors\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"should-nonviolent-felons-have-rights-restored\" title=\"Should Nonviolent Felons Have Rights Restored?\" data-wpil-monitor-id=\"270\">Director Adam Kraut<\/a>. <\/p>\n\n\n\n<p>\u201cFor years, the only mechanisms available\u2026 were the all-but-impossible pardon, seemingly illusory expungement\u2026 or an expensive and uncertain route of litigation,&#8221; he added. <\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-a-door-closed-since-1992\">A Door Closed Since 1992<\/h2>\n\n\n\n<p>Since 1968, federal law provided a means for prohibited persons to petition for firearms rights restoration through the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). <\/p>\n\n\n\n<p>But in 1992, Congress blocked ATF from using any appropriated funds to process those petitions\u2014effectively shutting the program down for over 30 years.<\/p>\n\n\n\n<p>Now, under a new rule and an interim order from the Attorney General rescinding ATF\u2019s authority, the DOJ itself will oversee the application process\u2014breathing life into long-stalled rights restoration.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThis proposed rule\u2026 is long overdue,\u201d said SAF Founder and Executive VP Alan Gottlieb. \u201cThe Second Amendment Foundation has been fighting for decades in courts to restore rights to people who are no threat to society.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-doj-acknowledges-the-constitutional-stakes\">DOJ Acknowledges the Constitutional Stakes<\/h2>\n\n\n\n<p>In the rule proposal itself, the DOJ stated:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>\u201cThis rulemaking reflects the Department\u2019s commitment to the Second Amendment as an indispensable safeguard of security and liberty&#8230; [and] a policy decision that the Department must find a way to both advance public safety and ensure that the rights of the people enshrined in the Constitution are not infringed.\u201d<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>That statement marks a significant tone shift from past DOJ and ATF practices, which often left rights restoration out of reach\u2014even for individuals with decades-old, nonviolent convictions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-comes-next\">What Comes Next<\/h2>\n\n\n\n<p>The <a href=\"https:\/\/gunsamerica.com\/digest\/cali-doj-attempting-expand-definition-assault-weapon-without-public-comment\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"should-nonviolent-felons-have-rights-restored\" title=\"Should Nonviolent Felons Have Rights Restored?\" data-wpil-monitor-id=\"271\">DOJ is currently accepting public comment<\/a> on the
