Carbajal-Flores, a case dealing with whether illegal aliens have the right to bear arms. But after <em>New York State <a href=\"https:\/\/gunsamerica.com\/digest\/springfield-armory-new-saint-victor-rifles-and-pistols\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"seventh-circuit-rules-illegals-can-be-disarmed\" title=\"Seventh Circuit Rules Illegals Can Be Disarmed\"  data-wpil-monitor-id=\"292\">Rifle &amp; Pistol<\/a> Ass\u2019n v. Bruen<\/em> overhauled how courts evaluate Second Amendment claims, Carbajal-Flores renewed his motion to dismiss the indictment, arguing the law failed Bruen\u2019s \u201ctext-and-history\u201d test.<\/p>\n\n\n\n<p>While the court still found the statute facially constitutional, it accepted his <em>as-applied<\/em> challenge\u2014claiming the government failed to prove he, personally, was dangerous or untrustworthy. <\/p>\n\n\n\n<p>Since Carbajal-Flores had no felony convictions and held a job, the lower court said he didn\u2019t fit the historical mold of those lawfully disarmed.<\/p>\n\n\n\n<p>The government appealed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-seventh-circuit-reverses-allegiance-is-the-key\">Seventh Circuit Reverses: Allegiance Is the Key<\/h2>\n\n\n\n<p>In a 22-page <a href=\"https:\/\/media.ca7.uscourts.gov\/cgi-bin\/OpinionsWeb\/processWebInputExternal.pl?Submit=Display&amp;Path=Y2025\/D07-16\/C:24-1534:J:Brennan:aut:T:fnOp:N:3398041:S:0\" target=\"_blank\" class=\"clickTracking\" campaign=\"seventh-circuit-rules-illegals-can-be-disarmed\" title=\"Seventh Circuit Rules Illegals Can Be Disarmed\">opinion<\/a> by Judge Brennan, the Seventh Circuit reversed. The panel didn\u2019t just uphold the statute\u2014it built a sweeping historical case showing that governments have <em>always<\/em> disarmed individuals who lacked allegiance to the sovereign.<\/p>\n\n\n\n<p>Citing English common law, colonial statutes, the Revolutionary period, and early state constitutions, the court drew a direct line from 18th-century disarmament of foreign nationals, Catholics loyal to the Pope, and others outside the political community, to today\u2019s prohibition on illegal aliens possessing guns.<\/p>\n\n\n\n<p><strong>SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/the-243-winchester-more-than-a-youth-round\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"seventh-circuit-rules-illegals-can-be-disarmed\" title=\"Seventh Circuit Rules Illegals Can Be Disarmed\">The .243 Winchester: More Than a Youth Round<\/a><\/strong><\/p>\n\n\n\n<p>\u201cThe law precludes only illegal aliens\u2014those who have necessarily forgone the naturalization process\u2014from possessing firearms,\u201d Judge Brennan wrote. \u201cBut an alien who obtains citizenship by taking the oath of renunciation and allegiance\u2026 is entitled to keep and bear arms like every other law-abiding American.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-no-room-for-as-applied-challenges-here\">No Room for As-Applied Challenges Here<\/h2>\n\n\n\n<p>Notably, the Seventh Circuit sidestepped whether <em>any<\/em> part of \u00a7 922(g) might allow for as-applied challenges after <em>Bruen<\/em>. But it shut the door on Carbajal-Flores\u2019s claim.<\/p>\n\n\n\n<p>Why? <\/p>\n\n\n\n<p>Because unlike the felon-in-possession law (\u00a7 922(g)(1)), which might sweep too broadly, the panel held that the illegal alien ban is perfectly tailored: allegiance-based restrictions have deep historical roots, and unlawful immigrants\u2014by definition\u2014haven\u2019t sworn allegiance to the U.S.<\/p>\n\n\n\n<p>So while other circuits wrestle with felons and restraining orders, the Seventh Circuit found \u00a7 922(g)(5)(A) sits squarely within the \u201clongstanding tradition\u201d of disarming non-citizens who haven\u2019t committed to the American constitutional order.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-a-win-for-history-based-gun-law-interpretation\">A Win for History-Based Gun Law Interpretation<\/h2>\n\n\n\n<p>For 2A supporters, the ruling is a prime example of how <em>Bruen<\/em>\u2019s historical standard cuts both ways: the government can\u2019t rely on interest balancing or policy arguments\u2014but when it <em>can<\/em> produce a solid historical analogy, its laws stand.<\/p>\n\n\n\n<p>The opinion acknowledged that illegal immigrants <em>may<\/em> fall under \u201cthe people\u201d protected by the Second Amendment. But even assuming that\u2019s true, Judge Brennan wrote, the government met its burden to show the regulation is \u201crooted in our Nation\u2019s tradition of disarming individuals who have not sworn allegiance.\u201d<\/p>\n\n\n\n<p>In short: if you haven\u2019t pledged loyalty to the U.S., the right to keep and bear arms doesn\u2019t apply\u2014at least not until you do.<\/p>\n\n\n\n<p
