That federal law shields gun makers from liability when criminals misuse firearms, with narrow exceptions for statutory violations.<\/p>\n\n\n\n<p>But the Second Circuit disagreed. Writing for the court, Judge Eunice Lee said the plaintiffs \u201chave not met their burden\u201d to prove the law is unconstitutional in every application. The court found that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The law falls within PLCAA\u2019s \u201cpredicate exception.\u201d<\/strong> The panel ruled that because New York\u2019s statute specifically regulates firearm sales and marketing, it qualifies as an allowable predicate statute under PLCAA.<\/li>\n\n\n\n<li><strong>No violation of the Commerce Clause.<\/strong> The court said the law doesn\u2019t unfairly discriminate against interstate commerce or impose undue burdens.<\/li>\n\n\n\n<li><strong>Not void for vagueness.<\/strong> The judges ruled that firearm businesses have fair notice of what the law requires: \u201creasonable controls and procedures\u201d to prevent illegal use.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-s-the-big-deal\"><strong>What\u2019s the Big Deal?<\/strong><\/h2>\n\n\n\n<p>This ruling effectively guts PLCAA protections in New York. Multiple anti-gun groups <a href=\"https:\/\/gunsamerica.com\/digest\/saf-files-amicus-brief-in-pa-gun-rights-denial-case\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"second-circuit-upholds-new-yorks-backdoor-gun-industry-liability-law\" title=\"Second Circuit Upholds New York's Backdoor Gun Industry Liability Law\" data-wpil-monitor-id=\"316\">filed amicus briefs<\/a> backing New York, including Everytown, Giffords, Brady, and various blue states. The NRA and 20 Republican-led states supported the plaintiffs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-why-it-matters-nationwide\"><strong>Why It Matters Nationwide<\/strong><\/h2>\n\n\n\n<p>New York\u2019s strategy here is simple: if you can\u2019t ban guns outright, bankrupt the companies making them. This ruling gives other anti-gun states a green light to pass similar laws, creating a patchwork of liability threats that could force manufacturers to pull out of entire regions. While the decision only applies directly in the Second Circuit, its ripple effects could be enormous.<\/p>\n\n\n\n<p>NSSF has not announced whether it will appeal to the Supreme Court, but given the stakes, further litigation is almost certain.<\/p>\n\n\n<h2 class=\"wp-block-heading has-text-align-center\"
