OK, How About the ATF?\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/usX61R1fh2c?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-immigration-refusal-vs-gun-confiscation\">Immigration Refusal vs. Gun Confiscation<\/h2>\n\n\n\n<p>Kirk explained that under federal law, states aren\u2019t required to help enforce immigration laws. \u201cThey do not have to assist,\u201d he said. \u201cThey also can\u2019t obstruct.\u201d<\/p>\n\n\n\n<p>That legal framework, however, led him to wonder what would happen if federal agents showed up not to deport illegal immigrants, but to confiscate guns from lawful owners.<\/p>\n\n\n\n<p>\u201cCould states in fact pass laws that said, \u2018Hey, we\u2019re not going to cooperate in any way, shape, or form with ATF for the enforcement of <a href=\"https:\/\/gunsamerica.com\/digest\/missouri-banning-federal-gun-laws\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"would-states-help-atf-confiscate-guns\" title=\"Would States Help ATF Confiscate Guns?\" data-wpil-monitor-id=\"319\">federal gun laws<\/a> in our state?\u2019\u201d Kirk asked. <\/p>\n\n\n\n<p>\u201cThe answer is yes, they can. And they already have done so,&#8221; he added. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-supreme-court-case-that-supports-states-rights\">The Supreme Court Case That Supports States\u2019 Rights<\/h2>\n\n\n\n<p>Kirk walked viewers through the 1997 Supreme Court decision in <em><a href=\"https:\/\/www.oyez.org\/cases\/1996\/95-1478\" target=\"_blank\" class=\"clickTracking\" campaign=\"would-states-help-atf-confiscate-guns\" title=\"Would States Help ATF Confiscate Guns?\">Printz v. United States<\/a><\/em>, which involved the Brady Handgun Violence Prevention Act. <\/p>\n\n\n\n<p>The Brady Bill had mandated local law enforcement conduct background checks for <a href=\"https:\/\/gunsamerica.com\/firearms\/handguns\" target=\"_blank\" class=\"clickTracking\" campaign=\"would-states-help-atf-confiscate-guns\" title=\"Would States Help ATF Confiscate Guns?\">handgun<\/a> purchases \u2013 essentially commandeering state resources to enforce federal law.<\/p>\n\n\n\n<p>Two sheriffs sued, arguing Congress can\u2019t force states to do the federal government\u2019s job. The Supreme Court agreed in a narrow 5-4 ruling.<\/p>\n\n\n\n<p>\u201cThe necessary and proper clause does not empower [Congress] to compel state law enforcement agencies to fulfill its federal task for it, even temporarily,\u201d Kirk summarized. <\/p>\n\n\n\n<p>Local agencies can volunteer to assist, but they can\u2019t be forced to do so.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-states-that-have-passed-no-atf-cooperation-laws\">States That Have Passed \u201cNo ATF Cooperation\u201d Laws<\/h2>\n\n\n\n<p>Fueled by fears of potential federal gun bans under the Biden administration, multiple states passed laws barring local law enforcement from cooperating with federal gun confiscation efforts.<\/p>\n\n\n\n<p><strong>These states include:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Arkansas<\/strong><\/li>\n\n\n\n<li><strong>Arizona (2021)<\/strong><\/li>\n\n\n\n<li><strong>Alabama (2022)<\/strong><\/li>\n\n\n\n<li><strong>Alaska (2010)<\/strong><\/li>\n\n\n\n<li><strong>Idaho (2014)<\/strong><\/li>\n\n\n\n<li><strong>Kansas (2013)<\/strong><\/li>\n\n\n\n<li><strong>Kentucky (2023)<\/strong><\/li>\n\n\n\n<li><strong>Missouri (2021)<\/strong><\/li>\n\n\n\n<li><strong>Montana (2021)<\/strong><\/li>\n\n\n\n<li><strong>New Hampshire (2022)<\/strong><\/li>\n\n\n\n<li><strong>North Dakota (2021)<\/strong><\/li>\n\n\n\n<li><strong>Oklahoma (2021)<\/strong><\/li>\n\n\n\n<li><strong>South Carolina (2021)<\/strong><\/li>\n\n\n\n<li><strong>South Dakota (2021)<\/strong><\/li>\n\n\n\n<li><strong>Tennessee (2021)<\/strong><\/li>\n\n\n\n<li><strong>Texas (2021)<\/strong><\/li>\n\n\n\n<li><strong>West Virginia (2021)<\/strong><\/li>\n\n\n\n<li><strong>Wyoming (2021)<\/strong><\/li>\n\n\n\n<li><strong>Utah (2021)<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Kirk emphasized these aren\u2019t merely symbolic. <\/p>\n\n\n\n<p>\u201cIf ever we were to have large swaths of firearms banned overnight\u2026 the only way those laws could even come remotely close to being carried out would require cooperation of local law enforcement,\u201d he said.<\/p>\n\n\n\n<p>\u201cThere are not enough federal agents,\u201d Kirk continued. \u201cThe government would never be able to hire enough federal agents to complete all of those tasks on a nationwide level.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-why-this-matters\">Why This Matters<\/h2>\n\n\n\n<p>These state laws create \u201ca very powerful barrier to the implementation of otherwise unconstitutional gun regulation,\u201d Kirk argued, protecting citizens\u2019 inalienable rights if future federal administrations attempt sweeping bans.<\/p>\n\n\n\n<p>Good to know, right? <\/p>\n\n\n\n<p class=\"has-text-align-left\" style=\"font-size:24px\"><strong><em>*** <a href=\"https:\/\/gunsamerica.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"would-states-help-atf-confiscate-guns\" title=\"Would States Help ATF Confiscate Guns?\" target=\"_blank\" rel=\"noreferrer noopener\">Buy and Sell on GunsAmerica!<\/a> ***<\/em><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In his recent video, Kirk broke down what\u2019s actually legal, what states have done so far, and why this matters for every gun owner in America.<\/p>\n","protected":false},"author":158,"featured_media":217866,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_specdata_upc":"","_specdata_placement":"","footnotes":""},"categories":[4024],"tags":[132,607,122],"featured":[],"hunt365":[],"class_list":{"0":"post-217865","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-news","8":"tag-buzz","9":"tag-news","10":"tag-r2kba"},"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v27.1 (Yoast SEO v27.3) - https:\/\/yoast.com\/product\/yoast-seo-premium-wordpress\/ -->\n<title>Would States Help ATF Confiscate Guns?<\/title>\n<meta name=\"description\" content=\"Kirk explains how states can refuse to help ATF gun confiscation efforts, citing Printz v.
