Bonta<\/em>, striking down California\u2019s \u201cone-gun-a-month\u201d law as unconstitutional.<\/p>\n\n\n\n<p>California had banned most individuals from buying more than one firearm within a 30-day window. The state argued the restriction would help stop illegal gun trafficking and straw purchases. The court wasn\u2019t buying it.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"9th Circuit Deals Huge Blow To California Striking Down Major Gun Law\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/uCiWkFI-844?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><figcaption class=\"wp-element-caption\">California&#8217;s one-gun-a-month law is unconstitutional, per the Ninth Circuit. <\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>The panel <a href=\"https:\/\/cdn.ca9.uscourts.gov\/datastore\/opinions\/2025\/06\/20\/24-2036.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"ninth-circuit-strikes-down-californias-one-gun-a-month-law\" title=\"Ninth Circuit Strikes Down California\u2019s 'One-Gun-a-Month' Law\">ruled<\/a> that the Second Amendment protects both the right to own multiple firearms and the ability to acquire them without excessive delay. According to the judges, restricting how often someone can buy a gun amounts to a \u201cmeaningful constraint\u201d on that right.<\/p>\n\n\n\n<p>The court followed the framework set by the Supreme Court in <em>Bruen<\/em>, which requires states to show that <a href=\"https:\/\/gunsamerica.com\/digest\/the-best-modern-combat-proven-handguns-shotguns-and-rifles\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"ninth-circuit-strikes-down-californias-one-gun-a-month-law\" title=\"Ninth Circuit Strikes Down California\u2019s 'One-Gun-a-Month' Law\"  data-wpil-monitor-id=\"390\">modern gun<\/a> laws align with historical traditions. They found nothing even remotely similar to California\u2019s blanket purchase limit. Laws from early America banned sales to specific groups like Native Americans or the intoxicated\u2014but never restricted the timing or number of purchases for ordinary citizens.<\/p>\n\n\n\n<p>The panel also dismissed California\u2019s argument that new technology and modern crime required a \u201cnuanced approach.\u201d They found no evidence that bulk purchases were a unique modern problem. In fact, firearm availability and trafficking existed long before the current era.<\/p>\n\n\n\n<p>While some historical laws tracked sales or imposed licensing requirements, none flat-out banned law-abiding citizens from buying multiple guns. The court emphasized that constitutional rights\u2014including the right to keep and bear arms\u2014can\u2019t be rationed by calendar days.<\/p>\n\n\n\n<p>The ruling doesn\u2019t prevent the state from using other tools to combat <a href=\"https:\/\/gunsamerica.com\/digest\/hk-parts-owner-gets-4-years-illegal-gun-sales-tax-evasion\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"ninth-circuit-strikes-down-californias-one-gun-a-month-law\" title=\"Ninth Circuit Strikes Down California\u2019s 'One-Gun-a-Month' Law\"  data-wpil-monitor-id=\"391\">illegal gun sales<\/a>. But the judges made clear that delaying or limiting lawful purchases isn\u2019t one of them.<\/p>\n\n\n\n<p>This decision adds to a growing list of victories for gun rights under the <em>Bruen<\/em> standard. California can appeal to the full Ninth Circuit or the Supreme Court, but for now, the law is dead.<\/p>\n\n\n\n<p>Gun rights advocates hailed the ruling as a decisive blow against incremental disarmament.
