firearm trace data\u2014and a win for gun retailers who\u2019ve long argued the program unfairly painted them as complicit in crimes they had nothing to do with.<\/p>\n\n\n\n<figure the Clinton administration, the Demand 2 Program required firearm dealers to report when 25 or more guns sold by their shop were traced back to crime scenes within a three-year window\u2014what the ATF called \u201ctime-to-crime.\u201d <\/p>\n\n\n\n<p>But critics say the policy allowed gun control advocates and sympathetic media outlets to misuse this trace data in \u201cname-and-shame\u201d campaigns that damaged lawful businesses and risked public safety.<\/p>\n\n\n\n<p>\u201cFirearm retailers who follow the law were being targeted simply because criminals later misused guns they sold legally,\u201d <a href=\"https:\/\/www.nssf.org\/articles\/nssf-confirms-atf-demand-2-program-is-ending\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-to-end-controversial-demand-2-program\" title=\"ATF to End Controversial Demand 2 Program\">said<\/a> NSSF Senior VP and General Counsel Lawrence Keane. \u201cThis is a welcome step forward.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-a-tool-for-transparency-or-a-political-bludgeon\">A Tool for Transparency or a Political Bludgeon?<\/h2>\n\n\n\n<p>While ATF\u2019s stated goal was to use the data to aid investigations, past leaks of Demand Letter 2 lists\u2014such as those involving the Washington, D.C. Metro Police Department\u2014fueled controversy. The department became the sole FFL in D.C. for a time, handling legal firearm transfers. Yet when firearms they had legally processed ended up in crimes, they too were flagged under the program.<\/p>\n\n\n\n<p>\u201cIt wasn\u2019t because D.C. police did anything wrong,\u201d Keane said. \u201cIt\u2019s because the data doesn\u2019t distinguish between criminal intent and legal sales.\u201d<\/p>\n\n\n\n<p>NSSF has been especially critical of former ATF Director Steve Dettelbach, <a href=\"https:\/\/www.nssf.org\/articles\/atfs-tiahrt-violation-enables-media-name-and-shame-campaign\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-to-end-controversial-demand-2-program\" title=\"ATF to End Controversial Demand 2 Program\">who<\/a>, in violation of federal law, reportedly shared protected trace data with media and advocacy groups like Brady United. The Tiahrt Amendment\u2014which Congress continues to support\u2014strictly limits public access to such sensitive data to protect investigations and law enforcement.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-atf-s-own-words-undermine-the-program\">ATF\u2019s Own Words Undermine the Program<\/h2>\n\n\n\n<p>Even the ATF\u2019s own historical reports have emphasized that appearance in trace data doesn\u2019t imply wrongdoing. In its 1998 Crime Gun Trace Analysis, the agency <a href=\"https:\/\/www.atf.gov\/resource-center\/docs\/ycgiii-report-1998-trace-analysispdf-0\/download\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-to-end-controversial-demand-2-program\" title=\"ATF to End Controversial Demand 2 Program\">wrote<\/a>:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThe appearance of [a licensed dealer] or a first unlicensed purchaser of record in association with a crime gun\u2026 in no way suggests that either\u2026 has committed criminal acts.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-legislative-support-for-stronger-protections\">Legislative Support for Stronger Protections<\/h2>\n\n\n\n<p>The end of Demand 2 isn\u2019t just a policy shift\u2014it comes amid renewed legislative support to keep trace data private. <\/p>\n\n\n\n<p>NSSF has thrown its support behind Rep. Clay Higgins\u2019 bill, H.R. <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/1698?s=1&amp;r=1\" target=\"_blank\" class=\"clickTracking\" campaign=\"atf-to-end-controversial-demand-2-program\" title=\"ATF to End Controversial Demand 2 Program\">1698<\/a>, the <em>Law Enforcement Protection and Privacy Act<\/em>. The measure would reinforce the Tiahrt Amendment by holding violators accountable for misusing or leaking firearm trace data.<\/p>\n\n\n\n<p>\u201cThis bill puts teeth in the law,\u201d Keane said, calling it vital to ensuring trace data stays in the hands of investigators\u2014not activists.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-s-next\">What\u2019s Next?<\/h2>\n\n\n\n<p>While ATF has not yet made a formal public announcement, NSSF expects one soon.
